Among other things, the reason the Constitution applies to the NSA, including the Bill of Rights, is that the Bill of Rights does not apply to Americans per se, but to everyone American government interacts with. For example, it does not say "Congress shall pass no law abridging the right of Americans to do X", it says "Congress shall pass no law abridging the right to do X". That means no law AT ALL, not just no law affecting Americans. That's the way the whole Constitution functions. The NSA gets its legitimacy (such as it is) from the Federal government, which gets its only legitimate power from the US Constitution. The NSA doesn't magically grow extra powers, its powers are limited by that origin. When it violates the right to privacy of ANYONE, it is violating the Constitution and therefore its own legitimacy. Every assassination it or the CIA conducts is the same amount of illegal as if it were the FBI assassinating a Congressman.

NSA seems to act in accordance with Emergency War Powers under Article II Section 2 of the Constitution. This "War Time" Commander in Chief rule, by means of Agency Partners, appears to be a continued implentation of the Law of War (Title 100, Lieber Code) as seen in 12 STAT 319, and Title 50, Sections 212, 213, 2461-2465.

The only legitimacy one can get from a legal document is that derived from the intent of those who created it. There is no question that the Founders did not intend for a state of perpetual, undeclared war. So the NSA is as unconstitutional under the "War Time" premise as if it were just made up out of nothing, with no constitutional justification at all.

Until all conventions came about. It was rewritten for rules for war. Do more research. It’s a big mess but American Jurisprudence takes precedent above all because the only Supreme Law of Land is the US Constitution. Research more. Nice citation of one part of history and not the others following. Research all American Jurisprudence first which topples all laws with the US Constitution.

I cannot, and more than likely, will not believe a single word these fellers say. They're whole existence has been to have an edge intellectionally and psychologically over their fellow human. For an immediate and/or ultimate good? Only they know that. However, with that same advantage much bad and evil can easily be perpetuated. Be good to one another. Make all efforts to capture this spirit. It will do the rest.
