For those looking for explanation of INDIAN FLYING FOX: First Explanation Simple answer, yes Fruit Bat/Indian Flying Fox is added in the vermin category Now, time for long answer: Previous Status: The Indian flying fox was initially considered vermin and placed in Schedule V of the Wildlife (Protection) Act, 1972 Why ? Because " Article 34 of original act- “vermin” means any wild animal specified in Schedule V; Now, being added to "schedule V" means that Flying Fox is under declaration (notification period) i.e., unless de-notified it will continue to be considered as vermin. Why ? Because article 62 of original act says- "Declaration of certain wild animals to be vermin.-1[The Central Government]may, by notification, declare any wild animal other than those specified in Schedule I and Part II of Schedule II to be vermin for any area and for such period as may be specified therein and so long as such notification is in force, such wild animal shall be deemed to have been included in Schedule V. " Point to note from above " So long as such notification is in force" Now where is this notification ? it is the same notification which enacted the WPA 1972 because it was added during the preparation of the act. [Now, this is my intuition ["I MAY BE WRONG"] because there is no amendment notification in the act itself] Present status: After WPA 1972 (Amendment 2022) [(34) “vermin” means any wild animal notified under section 62;] --> Under section 62 62. Declaration of certain wild animals to be vermin.-7[The Central Government] may, by notification, declare any wild animal 8[specified in Schedule II] to be vermin for any area and for such period as may be specified therein and so long as such notification is in force, such wild animal shall be 9[deemed not to be included in Schedule II for such area and for such period as specified in the notification]. Again what to note- "so long as such notification is in force" [ since it was never de-notified Therefore it still has the status of Vermin Category] Hope this answers your doubt !! Second Explanation Notification has not been released separately it was mentioned in the act itself when the act was enacted then the schedule V also got enforced which contained the vermin category as per section 34. Therefore, it is still in force unless a separate notification is released to de-notify it. Now after amendment it is placed under schedule II but since earlier it was declared (mentioned in schedule v) a vermin now the protection of schedule ii does not apply to it unless it is de-notified by a notification. As far as name is concerned it was mentioned as Fruit Bat in WPA 1972 and Indian Flying Fox after 2022 amendment in schedule II.
