Hello Ma'am, my spouse would be switching to a new company after 2 or 3 months. His visa expires in September 2023. Can I apply for a H4 visa with his previous employer' stamping and I797? After I get the Visa stamped, will the change in my husband's employer details affect my Visa in any way?

No not needed. If asked you can tell you plan to resign or on notice period.

I have applied for B1B2 visa in 2014 through some travel agent they filled the DS160 for me... But it was rejected at that due to that I don't have strong ties with my origin country it was my old passport... now I have my new passport...Can I apply for H4 visa now with my wife H1B application? But I don't remember what was filled in old DS 160 by that agent even I don't have the contact... Can you please tell me what should I do?

That’s ok! You don’t have to worry about that rejection. Just prepare well for the H4 interview. It will not be a problem as long as you have the right documents. Hey mam i applied for h4 visa 1 month later of my court marriage registry done bt our hindu ritualistic marriage not done that time like sindoor n saath fera we are like non religious family not believing on it so we done only Court marriage registry and exchange of flowers garlands and ring with presents of 80 close family and friends and i have photographs of our marriage day with everyone n also some rituals we were done... Is that any problem without hindu ritualistic marriage we did only Court marriage and apply for visa.. If they asked for sindoor and saath fera photographs i don't have bt i have other photographs where everything visible.. Plz help me i have interview in this last of the month..

That’s totally fine! The court marriage pictures are acceptable. If asked you can inform the VO that you just had a court marriage and after party!

Hi Pragnya Jaspreet here next week is my H4 interview my wife H1B interview has been done. please can u suggest what to answer if they ask why u have not attended the interview with your wife. Because we were facing problems in the CGI portal to attach the spouse. Waiting for ur response Thanku.

Hello Jaspreet, it’s not mandatory to attend interview with the H1B applicant. It’s just convenient. So they will never ask this question. Even if they ask you can tell them that you had technical difficulties in booking your interview together. But be assured they will not ask this. All the best!

For h4 visa there is No approval process (unless it’s extension or COS). So once you have your i797 all you need to do is book her an interview. That’s all.

1. It’s very common situation so don’t worry and most probably they will not ask this question. 2. If they ask, just answer that the spouse plans to travel at a later point of time.

You don’t need documents from Ministry of foreign affairs. Only marriage certificate is primary document. Try at your local council office for English version of your marriage certificate.

I recently got the English version of my marriage certificate from District Level Hospital where we can book an appointment, and they will register and translate the certificate in english if needed.

It’s going to be a little easier if you are going with your husband. Take marriage certificate. Some pictures. Prepare for questions like - marriage date - husbands profession - spouse employer - spouse salary

H4 visa shall be granted till the visa date of h1b visa of primary applicant. You have to renew the passport once expired and also keep the old passport with you.

Usually h4 without H1B stamp gets 221g. If that happens wait until H1B is stamped and update the info as per the directions provided and your visa will be approved

If you have received a physical copy then original else photocopy also works. Many marriage certificates these days are issued online. So taking a colour print out is perfect.

At least have 10-15. They will see!! If you get a easy to go VO they may see 2-3 but if you get a strict VO!! Be prepared.

Go for your interview and take passport size photographs of your child. If possible try to call and rectify the date of birth before the interview. Even if it’s not rectified don’t panic. Inform them they may ask for additional documents.
