Hello everyone, I wanted to provide my experience of getting H4 I94 extended. I am on H1 and my spouse is on H4. Both of us have visa stamping till Mar 2023. I got my H1 extended through premium till Oct 2025. Once I got my I795 (it has the I94 attached at the bottom), I traveled to Cancun along with my family last weekend. We stayed there for 3 nights. No Mexican visa is needed as I have my H1stamped till Mar 2023. While returning to the US, when we give our passports to the immigration officer I requested both of us have our I94 extended till Oct 2025 based on my approved I795. This is important to say while handing the passports. The officer took both of our fingerprints and stamped the passports. After collecting our bags I checked the site and saw both of us had I94 extended till Oct 2025. My port of return was Miami. I thank Reddy and Neumann for their video but also all of you who have left valuable inputs as comments which helped us.

Hi Abhinav, you have your H1-B approved till Oct 2025 (that is clear). Before travelling to Cancun, do you have H4 or H4 EAD approved, you have mentioned I-795 (which is H4 EAD) approved which is confusing since it is a straight go-to work since H4 EAD is approved? Can you kindly clarify with respect to H4 and H4 EAD terms the above situation as we are in the same Mar month visa expiry. Currently my H1B visa extension is in premium processing yet to receive the approval. H4 and h4 EAD expires on 19-Mar-2023. Once after my H1-B premium approval, what is the best way to get H4 or H4 EAD extended? Right now, planning to go for H4 stamping process in India to travel back to US so that I-94 get extended accordingly. Just want to check this Cancun option how it works with respect to the above mentioned scenario possibilities. Kindly provide your experience.Thank you.

Unfortunately, crossing the border for H4 renewal didn't work for us. Seems like it depends a lot on the CBP officer. In fact, they reduced my H-1 i94 also to match with the visa date. My "guess" at this point of time is that, system may not allow I94 validity for more than 3 years and some officers are not aware of how to get around that.

Does the F1 visa get extended beyond the date of entry after returning back from Mexico on valid I-94? If yes, by how much time is the visa extended?

My i539(L2) and EAD renewal is pending but L1 is approved till 2024, Wouldn’t i535 application be abandoned if I travel to Mexico to get I94 updated? Wat if they don’t update my I94 based on L1?

Question : Mine H1 and wife H4 and H4 EAD now filled for extension in normal processing if I got h1 extension approved and my wife H4 EAD expiring in Nov 2022 and I-94 also but when she got new I-94 she will be eligible for auto renewal of H4 EAD as we filed H4 EAD renewal with h4 renewal ?

Hi there, I have a scenario, I am on H1B and my wife is on H4. Both our stamps are expired. We both got our I797 approved and valid till 2026. My wife H4EAD is still pending and for i94 update we want to use AVR. We still have valid i94 but want the i94 to be extended to 2026. Can my wife travel alone to Canada and come back using AVR. Is there any risks in doing so?

For the Automatic Revalidation, should we have the unexpired I-94 from CBP site or the unexpired I-94 from previous H4 extension on I-797 would be enough? Also, is traveling to Canada through air a good option to get extended I-94?

Hello. I have a question. My wife's H4 EAD application is pending approval but her H4 VISA Extension application has been approved (I-797A approval notice) which has an I-94 attached at the bottom. Wondering if she qualifies for auto-extension rule. Thanks!

Can H4 I94 be extended by going to mexico 5 months before expiry H4 I94 expiry based on new extended H1B I797 ? H4 EAD Expiry date - Aug/25th/2022, H4 I94 Expiry date - Dec/12/2022

Hi, My spouse H4 & H4-EAD gets expiry on April-2022, we applied for H1B(in Premium), H4 & H4EAD extensions. In-order to get H4-EAD 180 days extension we need to have H4 Visa extension ? or by default the H4-EAD gets extension without H4 approval behind April-2022 please suggest best suitable options for me...

In-order to get H4-EAD 180 days extension we need to have H4 Visa extension ? Yes ( see my question in comments above and discussion on this topic).

Yes, if your spouse's H4 expires when you are traveling, that is after April 2022. No, if she's travelling before April 2022 and your extension is already approved.

I have applied for h1b, h4 and h4ead extension concurrently. My h1b got approved today under premium processing. If my spouse goes to Canada with H1B i797 and get h4 stamping and reenter US with new i-94, Will her h4ead extension that is currently under processing be denied? or should we have to update USCIS with new i-94? or reapply for h4 EAD altogether from scratch.? Thanks.

My H1b is approved until 2025 and h4 of spouse is approved too until 2025 and we have h4 -i797a approval notice from USCIS. H4 EAD extension is pending. Do we get auto extension of h4 EAD as we have h4 approval and approval notice valid until 2025. ?

I am assuming uscis approved your H1 and H4 both together under premium? In your case you should get automatic 180 days extension based on the H4 I94 on the approval notice.

@@rohitagl which center it was filed ? Mine was filed in Nebraska in premium and H1 got approved in 1 day on Dec 8th, however H4 and H4 EAD filed concurrently are still pending. Hope I get some good news like you this week on the H4 approvals.

Should the spouse of a H4 get stamped in order for H4 to use spouses newly approved I797/ I94 while re entering USA and trying to get automatic revalidation.

Not required. If the primary H1 has got extended I797 and H4s I94 has not expired then the H4 can use the H1 Spouses extended I797 for automatic revalidation. We did the same via. Land border on Laredo, TX mexico border CBP and they extended the H4s I -94 for 3 years for a $6 fees. Overall process entry to mexico and come back to US and permit issuing took 15-20 mins total. We just entered Laerdo mexico side and took a U turn and re-entered. At re entry tell them you are here to get the I94 extended.

I have Tried Canada land border.. Tried 2 /3 times.. but no luck. they clearly said, we cant extend I-94. Apart from that, they clearly said, As h4 renewal is already applied and case is pending with USCIS, we cant grant the I-94 based on H1's I-94. which may contradict with USCIS decision on h4. To be honest, I am not satisfied with their reason. I believe they just escaped with that reason.

We do not advice Land border - the people who tried the land border in Mexico did not get their I-94 extended.

@@rahulreddy2409 is it better to apply for H4+H4 EAD after H4 I 94 updated? I agree that land border may not extend I 94 until new H1 I 94 but what are the chances that crossing border by air will get desired extension? In any case CBP officer may say we can't grant new I 94 because your H4+H4 EAD still pending with USCIS? We don't have real data from people who successfully got I 94 updated either by crossing border while H4+H4 EAD pending or not pending. USCIS should give clear instructions to CBP to extend I 94. In one way USCIS provides a solution for H4 EAD delays and on other hand CBP officer at port of entry refuse to extend. It's a confusing situation.

@@rahulreddy2409 We went to Laredo, TX land border yesterday. CBP extended the H4 I94 for 3 years same as extended H1s . The overall process of entry to Mexico , Re entry to US and permit issuance took 20 mins.

I wish I saw this video earlier and I would NOT have tried entering Mexico via land border. Forget about not giving us new i94 instead the cbp officer put RED FLAG on both of us :( CBP officer was very intimidating and had some kind of grudge on Indians and We are now gutted not sure what will happen to our future. Please help @rahul reddy

@divya: can you explain more about your scenario? I am planning to do the same in sep-end . Both me and my wife have valid stamped H1 and H4 till Jan-2023. Now I got approved H1 i797 until jan-2026 . Planing to go the mexico border via land and get the i94 extended for my wife based on my approved i797. Do you think cbp officers are not extending i94 in this scenario?
