Hi your video is very informative. I need your help regarding this we applied for a work permit after redundancy. I am in Ireland and today i got email form department that you submitted NOR form (Notice of Redundancy) can you please tell me if this a special form or if I can request the previous employer so they will arrange

Good info Terry. Question for you, I'm in a situation where I believe the company I work for will be sold in the next few years. The company is probably worth about 10m and would most likely be bought out by a multi-national tech company. If I was to be made redundant upon the sell-out how would I go about getting more than statutory redundancy? I've put 15 years of my life into this company and anything less than statutory + 3 or 4 weeks per every year would be a letdown. How or who would negotiate. Would redundancy need to be part of the seale agreement from our side? Surely it's in the buyer's interest to buy as little as possible in redundancy. thanks

It's up to the employer whether to make an ex gratia payment or not, you have no legal entitlement to one

Hi Terry, this is a question outside of this video's subject, but more widely relating to Irish Employment law. Do the Irish employment tribunals and appeal courts also use English employment case law as well as Irish when looking for comparable precedents when hearing a case? Lee

Hi Lee. English cases feature to a certain extent, especially if there is no relevant Irish ones, but exactly how much weight they carry in any particular decision I am not sure, to be frank.

@@terrygorry Thanks Terry. Would I be right in saying ECJ rulings on Employment law are also a considerations for the WRC and higher tiers employment tribunals and courts? Lee

@@1976Mrsmith Yes, they are factors to be considered. I do not know the exact hierarchy, however.

Hi Terry, I was made redundant in December. I accepted my redundancy as we were in the pandemic and I was afraid. Two months later they rehired my position under a slight different title for less money. I made an official grievance a few months prior to being made redundant. Would I have a case if I brought it to you?

The person rehired is also less qualified and has less experience

I don't know, I would need to learn all the facts before I could advise you. You would need to arrange a consultation. Call the office if you want to do this. If not Citizen's Information are good and free (because they are funded by the taxpayer)

Can an employee on long term illness DEMAND to be made redundant?

Yes, they can demand it but the employer cannot be forced to make them redundant. In fact, the next step for the employer may be to terminate their employment on the grounds of incapacity-that is, the employee is unable to perform the contract due to the illness.
