The plaintiffs, a mother and daughter, hired the defendant to make a prom dress for the daughter. She says the defendant didn’t make the dress in time and it wasn’t finished by the time prom came around. The plaintiffs are suing for the prom dress deposit, rental car expenses, and emotional distress. The defendant argues she was able to provide a dress, but then the plaintiff changed her mind at the last minute. She’s countersuing for defamation of character.

The plaintiff knowingly and maliciously posted the dress online claiming it was finished, and tagged the defendant as the dressmaker. That was a flat out lie and the defendant lost business because of it. I don't know why JM didn't agree to compensate her.

@@tommyjones6866 Because unfortunately she did make the dress. the lie was that it was 'finished'. Which in order to say she was defamed, the posts would have to say that it was unprofessional or the like for a dress like that to be finished, rather than just that it's ugly. Granted, yes, it's ugly because it's unfinished, but that goes into opinion based on what's there, and not an opinion based on the lie. "The dress is ugly" could be about the unfinished wip. "The FINISHED dress is ugly" is acknowledging the lie I would say punitive should have been brought up because they did knowingly lie.

i think judge mathis would have awarded the defendant for the defamation because the dress and the dress maker were misrepresented by the plaintiffs .

This whole case was wild. From the ugly dress, to it going viral and being shown on several national talk shows, to mom's inappropriate court outfit, to the audacity of mom to sue for $4k for "emotional distress" and transportation over a prom dress. Get tf outta here. Yeah, the dress wasn't looking great. But the defendant didn't deserve to be nationally humiliated and sued for $5k. Mom was greedy and pathetic. An embarrassment.

I believe the defendant should have won her defamation suit. The dress that was posted WAS NOT the finished results, and the mom posted it as if it was, so yes that is defamation. The mother is straight garbage, and a poor example for her daughter.

I don't agree with the judge here. Absolutely anything can look terrible if it's not finished. A house with no walls isn't going to look fabulous, is it? The Plaintiff did the wrong thing posting an unfinished dress claiming it was the final thing. The defendant was in fact defamed. Another poor judgement by Judge Milian.

I been saying that for a long time. Dress Right Dress in court. Yes, judges can make that happen. Prior to females coming to court, in writing before they come to court, NO FOR SALE SIGNS allowed in court, revealing cleavages, short minds skirts/dresses, will not be allowed and your case will not be heard. If judges do not do that, have some Dollar General/Family Dollar Store inexpensive Sheets in court to put on those FOR Sale signs.

Exactly! Could buy one off the rack and have it altered versus having one custom designed. In the end, she used part of her friend's dress which was probably store bought and had it altered. So in a sense, she still had part of a store bought dress.

I feel like if the defendant didn't ask for so much I would have given some money for the defamation countersuit. We all know that dress wasn't ready and there's no telling what she could have pulled together overnight. If they trusted her to create a masterpiece in two weeks then she must have some skills.

Eh, I just don't think the verdict should have gone that way. She should have been able to keep the 100 dollars for what she did do. It should have been a dismissal on both sides quite frankly. Deposits are non refundable and defamation is telling something untruthful about the other side which the plaintiff DID do. I hope the defendant is prosperous in her fashion career and hopefully she learns something about overbooking herself.

The mom is not as cute as she thinks she is and she needs to grow up wearing a citi trends outfit to court... You might not be much older than your daughter but you are the MOM.... you're raising your daughter to be like you... Not the move... To the defendant.. Small thing to a giant... This mother was vindictive. She turned a $100 refund suit into a $5,000 claim. I expected the judge to rail at her for trying to get meals out of the poor defendant, as if she wouldn't have had to eat otherwise. The judge didn't, but then ... hotel fees?

One thing I haven't seen discussed in the comments yet--where was mom when this high school child was sitting out until midnight? Waiting on a dress? If Judge Milian spent more time trying to get to the details of the case and not as much time trying to giggle and squee about prom night stories, she might have arrived at the correct verdict. Milian LAUGHED at the viral exposure--based on the lie that the dress as pictured was complete--that led to death threats. She labeled the (again unfinished) dress as ugly and then laughed at the result. Hell, maybe the defendant should sue Judge Milian for defamation.

JM failed the defendant in this case. Yes posting stuff online isn’t defamation by itself until the consequences of that post get so serious the defendant gets death threats and potentially has to give up her livelihood. I felt really bad for her even though she screwed up the dress.

I definitely think she was very disregarding of the defendant. She still worked and put time into getting the dress done. She should have been able to keep the 100 dollars. This is what she does to make a living and the plaintiffs 100 percent slandered her. It was not just the dress was bad, they lied and said that it was the finished product and she had proof stating not only was it not but that it wasn't going to be finished as the plaintiff lied and said.

Judge Milian has a thing about "events" for young people (particularly young women). If it's a prom or a sweet sixteen or a quiceanera--the law goes right out the door. Milian is ALWAYS more interested in looking at the pictures and gasping about how beautiful they looked and then decides the case in favor or the young lady regardless of the actual facts.

@@scooneil So true, it's usually women around her daughters ages that she favors, but to laugh at the defendant... that was cruel. The disregard she had when it was very obvious the defendant was hurt by what the plaintiffs did was extremely aggravating. It's not funny to have your work slandered and then to be humiliated on NATIONAL TELEVISION by their untruthful post. She should have won her defamation case. That was not okay and it was very disrespectful of JM to treat it like it was not a big deal.

The plaintiff and her daughter were wrong. The young lady was clearly wrong for putting lies on social media and if one lady could make a top to a dress in one day. They should have allowed the defendant to finish the dress she ask for. Where was mom when she was being fitted for it.. judge need to be ashamed it wasn’t finished
