The actor playing the witness did a great job portraying true loss and sadness. Shes old enough to not break down over it but still cries. You can hear the sorrow in her shaky voice. But also the pure rage. She is right in front of the sick man who killed her family, bet if the story allowed it for her to climb over that bench and beat that man with her shoe. You gotta hand it to actors, it takes fucking skill to do this kind of stuff.

There are excellent theater actors in the New York theater world, many of whom made the rounds on the L&O franchises in-between times they were performing on stage. They were a casting director's dream. There's a saying: "Movies will make you famous; television will make you rich; but theater will make you good.". The woman who played the Bridget McDiarmid was an actress named Betty Miller (1925-2004) who did a LOT of theater on and off Broadway from just after WWII until 2002. She was very good.

@James Gray I don't agree at all. I feel like that is a very human reaction to have. Jurors are regular people and the average person doesn't have to deal with death in detail every day like lawyers and judges do. Some people are not emotionally equipped to hear a story about a family being blown to bits, told from the woman who was left to pick up the pieces. It's devastating. She's only on screen for a couple of seconds but I think she nails the uncomfortability and sorrow one would have being presented with that kind of evil, especially if they were not used to that.
@CharlieKay92
@CharlieKay92 3 жыл бұрын
@James Gray I said that I felt hers was a very human reaction to have, not the ONLY human reaction to have. No two people are the same. Every single person comes from different experiences that make them who they are and also shapes the way they would react to or handle such a story. Also, I know that we are merely exchanging opinions.. And I still feels as though that type of reaction could be warranted, especially for a more sensitive person that isn't jaded or pessimistic. Furthermore, I think her reaction could have been far more severe to warrant descriptions such as "hyper-emotional" and especially "deranged." She merely tears up and rubs her arm in visual discomfort.. When she could have cried out or fainted, for that matter.
@CharlieKay92
@CharlieKay92 3 жыл бұрын
@James Gray No, perhaps you misunderstood... The point that I was making is that no two humans experience things the same or have the same emaotional reactions.. So just because that was her reaction, doesn't mean that it's out of place in comparison with the people around her. No two people act alike. That's the point I'm making.

One day, afternoon, I was waiting for my parents right by one of those big red concrete mailboxes they have. By the entrance stairs to the Underground train. Finally my parents showed up. We walked away, down to Liecester square. We went to a movie there. Later, we heard that that very same mailbox exploded by an IRA BOMB! Some 4 hours after I had been standing by it. There are lots of small errors like that in the scene. She is clearly supposed to be Irish but the incident is supposed to have taken place on High Street Kensington. Its presumably part of the main land bombing campaign but the bomb is detonated immediately without time for codewords to be sent and so on. Its a drama by Americans so its unsurprising small details are wrong like that.

The show was written for an American audience by American writers, so even if they knew it was supposed to be "sweets shop", a lot of Americans would be confused because that could refer to a bakery that sold cakes and pies (to be fair, that detail wouldn't matter). You'll see inaccuracies like this in American television until the mid-2010s when studios start to realize that they can make money by paying attention to details like these.

so is it part of the American judicial process to allow untested testimony like that? She could be anybody saying anything. Seems like that sort of accusation would have had to have been tested in a court before being allowed to sway a jury

The defense could have cross examined her after she spoke. They didn't dare, as she was a sympathetic witness. Also, no reason to assume Stone couldn't provide proof if required.

Usually in pretrial, the prosecution and defense put all their cards on the table (evidence and witnesses), to avoid mind games or "sandbagging" the other side by surprising the court with a hidden trump card. That's when each side can file motions to strike or remove evidence, usually on "prejudicial" grounds, where they would have to convince the judge to do so. I'm sure there's tons more going on, I'm not an attorney so I'm not familiar with the whole process. If this witness was some rando, it would be brought up in pretrial and she would have been removed, however, Stone brought her in to testify against defendant's prior sworn testimony while the defense was presenting its case (this is yet another reason why it's a really bad idea to waive your 5th Amendment right and testify in your own defense). In real life, I'm pretty sure he can't just go "Surprise motherf***er!" on the defense like this, I'm thinking he would actually have to file a motion with the court, argue it out in chambers, then after the judge says, "OK Stone," bring her in as a rebuttal witness after corroborating her identity. But the show decided to skip all that because it can take weeks and they wanted the Perry Mason moment. Believe it or not, US courts really do care about the integrity of the facts in the cases they try, so no, if an attorney brought in randos to testify, he will eventually be disbarred for suborning perjury.

It's funny. She says satchel instead of briefcase. However, she uses the term "candy store". In the UK, it is referred to as a "sweets shop".

It was a stupid objection, because Stone is allowed to call rebuttal witnesses. Many defense attorneys in L&O are somehow ignorant of rather basic things because L&O is a character drama, and so it is heavily biased towards "the good guys": Law enforcement and prosecutors.

In retrospect, if she used “candy store”, she shouldn’t have used “Kensington High Street.” She should have referred to it as the main commercial/shopping street in Kensington. In NYC, there is a High Street near the Brooklyn side of the Brooklyn Bridge, and further southeast in Brooklyn there is a neighborhood called Kensington.

@@wheelyjon Yes. My point was that she was a bit inconsistent with her language. "Sweet shop" and "Kensington High Street" are expressions used in the UK as opposed to "candy store" and "shopping district in Kensington" that would be used in the US.
