The worst part of this case is that McDonalds made the lady sign a gag order on the settlement, meaning she had to stay quiet for the rest of her life while the company ran an active smear campaign against her and the media constantly mocked her.

You know all of that because she did NOT have a gag order. If she did, she wouldn't be able to let that be known, that's the entire point of a gag order. She might as well have though, since an old, injured lady in the late 90's had much less of a voice than several major corporations with close ties to the media did.

My parents have told me that one time before I was born, they stopped at a McDonalds on the way to the beach. My brother, who is just six years older than me, had hot coffee spilled on him. It wasn't as bad as what happened here, but he still had to go to the hospital. He still had scarring years later. This case was probably only the tip of the iceberg of customer injuries.

Who puts coffee between their legs? Who? That's why it was a bad lawsuit. People need to take responsibility for their actions. If the lid wasn't on tight enough or she put the coffee in a safer method, then you have a point.

I watched the video. If she took responsibility, why did she demand Mcdonalds pay for her medical bills? She was not a Mcdonalds employee and should known how to properly carry coffee. Everybody knows coffee is hot.

I remember my professor bringing this up in my law class. The best part was the McDonalds lawyers where the ones that submitted the evidence about the several hundred people that had been burned. I'm not sure what they expected to come from that.

Quite simple: Their case was "Oh for Ronald's sake, we get peppered with these lawsuits all the time. Coffee is that hot because it's brewed at that temperature. Get that old crow out of here". The judge was not amused...

part of the presented argument was to establish that the excessive hotness of the coffee was part of the 'industry standard' as customers were said to have preferred a hotter brew that not. People getting burned was just part of the 'norm' and other establishments had similar concerns and injures for brewing hotter than needed and not responding to customer injury and safety concerns.

It's pretty sad how the media smeared Stella like that. I remember when I used to laugh about it, thinking Stella was an idiot. But now that I know what happened, it's really depressing.

Third degree burns??? oh my god. I'm a nursing student studying burns right now. I randomly thought about this lawsuit and Third degree burns are so serious especially for geriatric patients. I feel so bad for making fun of this law suit when I was younger.

Third degree burns are unfortunate, yes, but they can be caused by liquids as low as 120 degrees fahrenheit. 160 degrees fahrenheit causes 3rd degree burns as quickly as 2 seconds after contact with skin. So it may sound ridiculous at face value that coffee at mcdonalds can cause third degree burns, but really in order to avoid the possibility of this occuring they would have to serve coffee at ridiculously low temperatures such as 130-140 degrees. This is not a fair standard to set for fast food companies, especially when you consider that refrigerated creamer brings down the temperature another 20 or so degrees. By the time you creamed your coffe and drank it it would be room temperature, not desirable for anybody.

@@lukelblitz3627 She was permanently disfigured and spent her winnings from the McDonald's lawsuit on a live in nurse until she died. Terrible, horrible thing. McDonald's should have been forced to personally cover every expense she, her family and her descendants would ever have until the end of time. The CEO should have been forced to grovel at that woman's feet until he collapsed from exhaustion.

Here's some other interesting facts about this case since I saw a bunch lf misinformation in the video's comments: While coffee is supposed to brewed between 190 to 212 degrees Fahrenheit (so around boiling), it should served/drank at about 160. Think about it, who drinks boiling water? Your going to burn your tongue/mouth. Thats why when you get fresh brewed coffee or tea from places now they have to warn you. The problem with the McDonald's case is that they don't use fresh brewed coffee. They keep it in a warmer. So there is no reason it couldn't have been kept warm at a more reasonable temp like 160-170 as is the new standard. Instead they kept their coffee at near boiling temperature for no reason other than it was the "industry standard."

Mcdonalds kept the coffee that hot so people would drink it slower and request fewer refills. Refills on coffee used to be free.

My law teacher claimed that Stella was greedy and a bad person even though a documentray she showed us demonstrted the burns clearly. I stated correctly that she should have gone to court but she just told me that I was wrong and that she was nothing but a greedy old lady. I'm glad this video shows that I was right and she was so very wrong.

McDonald's actually kept their coffee 20°C hotter than the recommended. The reason for this is because the people who usually bought the coffee were construction workers who bought the coffee in their own cans and drank it after 1 to 1.5 hours. That coffee was not supposed to be drunk right after serving. Only problem is that they never told it to the customers who drank the coffee right after buying it.

@@aryamansinha6608 There two solutions i see for this. One is similar to what some states are doing with the plastic straws. McDonald's can still sell coffee that hot, but on request by the customer, made by a separate machine. The second solution is, if the construction workers wanted coffee that hot to store in their cans, then maybe they need to get up an extra hour earlier before heading to work, and brew it themselves at home on the stove top.

This was an AWESOME video, and I hope everyone shares it. I remember learning about this case in high school from a teacher who (I know now) clearly did not know the facts and in turn misled the entire class. I was ignorant until college where I learned from a poli sci professor the truth about the case, as I never thought to seek more information because it seemed like everyone reached the consensus that the case was frivolous. And if I hadn't learned the truth then it would have taken me until now to find out what really happened. It's sad how the media twisted this case. They were either lazy or malicious in their portrayal. And as for the real number of frivolous lawsuits, that's why we should always rely on empirical evidence from a reliable source! Good video.

I've watched this a few times and I feel terrible the few times i've told it to other people... I've told it completely wrong. I wasn't alive when this happened so i wouldnt have known any better. I just heard it once and spread it like gospel truth. Adam's right. While the campaigners were REALLY good at their jobs, Stella should be hailed as a hero for getting the temperatures for coffee and other hot drinks to be lowered. And I shall definitely spread the truth about this. And let her be recognised for what her case did. And for those who think mcdonalds is not responsible. If you are serving food or drinks that are potentially hazardous if handled incorrectly then it is a DANGER! If the coffee was normal hot then I would be entirely on Mcds side. But hundreds of people suffered severe burns that is a direct result of their product. THAT is their fault if it came from them.

@@kereminde I don’t see why a keurig instant serve coffee maker puts out coffee at 192 degrees. People gobble it up every day at their own risk. 190 is a full 2 degrees cooler than what McDonald’s and many other companies at the time was putting coffee out at. Because at 160 degrees people complained of cold coffee.

Actually, no. Since Liebeck, McDonald's has not reduced the service temperature of its coffee. McDonald's policy today is to serve coffee at 80-90 °C (176-194 °F),[33] relying on more sternly worded warnings on cups made of rigid foam to avoid future liability, though it continues to face lawsuits over hot coffee.

In my criminal justice class we where talking about this case and my teacher had only heard of the version that the lawyers made so he thought that she was being dumb and driving with coffee in her lap.

I admit that I fell for this line of misinformation too when I heard about it. “Oh my goodness, what a greedy person! Imagine hot coffee being hot.” Im glad I learned the truth and I think we all should be determined to avoid jumping to conclusions based on skewed news articles in the future.

Unfortunately Mr. Kohr lost the case, and what with how the media/public viewed what happened, it's clear people have learned literally NOTHING from this...

He never had severe burns and that wasn't why he even tried to sue. He claimed that he spilled coffee on this leg and it activated his Chron's Disease which caused part of his intestines to have to be surgically removed. That's not how Chron's Disease works and the jury ruled against him. It had nothing to do with 'severe burns'.

Bacteria dies at 140 and 165 degrees the dishwasher at my work place gets to 170 and that sh*t makes the dishes hot as F. WTF are they thinking about making coffee 190 degrees.

It's the standard brewing tenp. The coffee that you make with your hime brewer is exactly the same temperature. Serving coffee any lower would cost money and time, and it wouldn't even significantly reduce the potential for injury.

@@DanknDerpyGamer It's true that on a graph, necessary time exposed to liquid for third degree burns has an exponential relationship with the temperature of the liquid. This doesn't tell you what temperature doesn't cause near instantaneous third degree burns. According to cpsc-dot-gov, most people suffer third degree burns after 2 seconds of contact with 150 degree water, which is 30-40 degrees cooler than the coffee which burned Liebeck (if you ask her attorneys). At 140 degrees, it takes 6 seconds of contact, and by 130 degrees, it takes a fairly safe 30 secs. Lets not forget that there is also an exponential relationship between the heat of the liquid and the rate at which it cools. It takes a long while to cool coffee to a "safe" temperature like 130 degrees (something like 30 minutes). Lets also not forget such a temperature isn't considered ideal by most customers. It's too cold, especially right after adding refrigerated creamer like they have at most fast food joints (all the ones I've been to anyway).

Just an FYI, 190 degree coffee is a great temperature to make coffee at; however, it shouldn't be maintained there. According to the National Coffee Association, 195°F to 205°F is ideal for optimal extraction.

@@alyssawilliamson3924 Extraction at 198°F is fine, but you drink it at around 160°F (as it is served by the major coffee chains like Starbucks). Serving at 190°F + in a thermal styrofoam cup no less is absurd. Now shove that same cup into someone's hand driving through in their car and you end up seriously burning a lot of people needlessly. Keep doing it after hundreds of people file complaints and you are negligent. They do not serve at this temp any longer.

I was a kid when this lawsuit happened. It made news here in Australia (and from what I've heard, many other countries too). The story was presented to us like 'American's are constantly sueing over crazy things, a lady sued McDonald's because she spilt hot coffee on her lap. She got millions of dollars just for that.' Without knowing the facts everyone thought it was stupid. It's seems only in recent years the truth is starting to be more widely understood. It's a shame this woman died in 2004, back when people were still laughing at her.

Frivolous lawsuits have been a chronic problem here in US, and it's making people with legitimate suits look bad in that way. It's kind of like the boy who cried wolf. Eventually the public is not going to believe even the legitimate cases, Because their just going to think it's another nonsense suit, and that consumer error is only to blame. This may have been part of why all the misinformation and slandering.

This reminds me of another story I heard about where many people who shop at Wal-Mart are accused of stealing because their self checkouts don't properly register their items or something. Many customers get banned or fined for this and while some have gone to court to prove their innocence the company just doesn't care to fix the problem because the amount of money they make outperforms any amount they spend on court cases.

I thought that instead of lowering the serving temperature they just added caution wording on the coffee cups saying it was hot. I haven't read too deep into it but that's what one article said.

They lowered the serving temperature to the actual industry standard of 160° F (71.1° C), yes, but 160° F is still hot enough to give third degree burns

I learned about this case in legal assistance classes. Juries award high punitive damages to give defendents food for thought before disregarding safety and ethical standards again. Though some people specifically go after "deep pockets, most plaintiff aren't even asking for those amounts.

The legal limit of the coffee temperature should be 130-140° F. The McDonald's coffee is past 210° F. Fyi 212° F is the boiling point of water. She was served boiling hot coffee that burned her skin, tissue, and fused her labia and her skin together. For what reason? Mcdonald's didn't want people to be able to finish the cup of coffee and so they made it boiling hot so they wouldn't have to give free refills
