UK firearms law has always had some "weird" bits. There's a long list of nonsensical regulations which are presumably down to clueless lawmakers. Newbie airsoft fans have to suffer the ridiculous two tone regs, yet you can purchase CO2 or air pistols that are extremely close copies of Sig Saur, Glock, Beretta, Colt, Walther etc. As usual, the law ends up restricting the innocent, law abiding public with very little or no affect to criminals.

The whole UKARA thing was a bit daft. How things have changed. As a 1970s child my mates and I all had air rifles and would go shooting in the woods or on the canal. We would never consider acting in a threatening manner with them or do anything bad. We also all owned blank firing hand runs. I had an imitation blank firing 357 magnum and colt 45. There is an exception in the firearms act that allows you to own real firearms and ammunition without the need to hold any sort of firearms certificate. Section 11.4 allows someone who is operating a miniature rifle range (however there is no definition as to what operating a miniature rifle range is) to purchase and possess rifles and ammunition not exceeding .23 calibre without the need to hold any firearms certificate. Very strange that there are circumstances that you can hold a real rifle and ammunition for it without a certificate, yet to own a piece of plastic that looks like a rifle that only shoots plastic pellets you are more tightly regulated
@kylewilliams6091
@kylewilliams6091 Жыл бұрын
I have just had a look and there is further information available the range has to apply for approval so that the members can buy and use .22 rifles for target shooting and this normally entails and employee having a firearms license and the term used was “officer” in charge of all purchases of guns and ammo for club members .
@zuegma666
@zuegma666 Жыл бұрын
@@kylewilliams6091 that is not the case though, the exemption specifically excludes the need to hold a firearms certificate. What you are looking at is for a club to get home office approval to operate as a gun club. Section 11.4 overrides the need for that
@kylewilliams6091
@kylewilliams6091 Жыл бұрын
@@zuegma666 no it doesn’t because the range you are using (as a member or owner ) for section 11.4 needs all the correct approval from the home office . When I bought my realistic imitation deagle I had to be a member of a licensed airsoft club , so in both cases you need to be a member of an approved club to buy a .22 rifle or a realistic imitation airsoft gun .

Back in my day you needed ammunition purchased to be entered into FAC. But....Joe public could "legally" buy cases, powder,bullet heads, primers, a reloading press,...and a book to tell you how to put them all together. Thankfully responsible registered firearm dealers wouldn't supply them without sight of an FAC. They probably regretted it later after being shafted by the govt post Cullen report.
@zuegma666
@zuegma666 Жыл бұрын
@@kylewilliams6091 you are wrong. You are confusing a home office approved club where you need to be a member in order to have good reason to be able to purchase you own firearms and shoot them at that club, against a miniature rifle range where you can set one up by yourself, buy firearms and ammunition without a firearms certificate, not need any range approval and can allow other members of the public to shoot there. It is a well documented exemption that is also know as the showman’s clause as it intention was to cover mobile shooting ranges that travelled round with fairgrounds where you could simply just turn up and shoot there at close range target. There are also a number of clubs now that use the 11.4 exemption to allow people to just turn up and shoot without the need of being members.. There is a very well documented case about this as well where the police tried to prosecute someone operating under the section 11.4 exemption and the person was acquitted despite having 12 rifles and 47000 rounds of ammunition without having a firearms certificate and operating in a field next to the M25. ukshootingnews.wordpress.com/2020/07/09/m25-instagram-range-operators-acquitted/

I did some consulting on behalf of the industry when the VCRA was in the Bill stage. We did lobby for "airsoft" to be properly defined and exempted under the 2006 Act, but we were told that we were too small to be worthy of that. The Home Office wanted more restrictions, and seemed happy to keep everything as unclear as possible. Thankfully the 2017 amendments to the '68 Act (for which I can take no credit) are much clearer.

Seems very odd as there's no way someone who wasn't very familiar with firearms would be able to tell a replica co2 pellet/BB gun from the real one of used for illegal activities.

Possession of a BB gun that looks like a real firearm in a public place will amount to an offence of possession of an imitation firearm, regardless of the power of the gun itself.

So, I’ve taken an interest in air soft and our garden is nice and long, providing the perfect place for some private target practice. We live in the country with only one neighbour. Even if I was UKARA certified and all that, attend regular air soft meets at my nearest site… if I were to do a bit of private target practice in my garden would I be in breach of the RIF regs? Secondly, and this is a purely hypothetical one that came about as part of a discussion with a chap on Discord. If my home were broken into, and a RIF was used as a form of intimidation/self defence would the owner of said RIF be liable for prosecution? Even if it was in self defence? It’s all a far cry from when I was little with those plastic revolvers firing caps off like a lunatic chasing imaginary baddies.

You can use an airsoft gun on private property where you have permission as long as no bbs leave your property I believe. Best to do it where you're not visible though since you never know when a nosey neighbour might decide to get involved.

I am a 16 year old living in England and I have been wanting to get into airsoft for a long time, however I understand that i cannot purchase imitation firearms nor realistic imitation firearms. However, I have heard from multiple sources that it is legal for a person aged 18 or over to purchase a two tone imitation firearm and gift it to a minor. I have scoured legislation to no avail, I can only find confirmation on the restriction of minors purchasing imitation firearms, not being gifted them by adults. I was just wondering if you could point me in a direction of where I could find this information? I called my local police department to ask and they simply stated that it wouldn't make sense so its probably illegal, however I don't want to leave it to uncertainty and miss out on the sport I've wanted to engage in for years and at the same time I don't just want to do something without legal confirmation. Thanks!

I'm no lawyer, but asking my local Airsoft shop they said that the law applies at purchase or resale only. Considering I've seen under 16's with Full-Black and Tan airsoft RIFS, I'm inclined to either believe it however take that with a massive grain of salt.

@@MeAMoose thank you thats incredibly helpful, ive heard the same thing from other places and after being directed to call 101 to make an inquirey on the subject, i was told that its probably illegal as it only makes sense to be, however i can think of numerous reasons it wouldnt be, ive also seen the legislation, which doesnt provide direct mention of the IF being gifted to a minor, yet i dont know if that means anything, i dont want to have missed something and i dont want to make assumptions based on my limited knowledge of how legislation works. i cant seem to get in contact with any legal professionals which is very annoying, but ill be taking this with a huge grain of salt and will continue on trying to get a definitive answer. thank you!

I want to shoot my air pistols (and, maybe my rifle, too) in my rear garden of a 3-bed semi, rented from a Housing Association. I've never seen anything clearly explained about whether or not I can, legally. The law on this, as usual, is vague/indecisive. Air guns can be damned dangerous and the use of them at home is fraught with potential accident scenarios, I happily admit to that being so. I just feel that I should be allowed to just get my guns, go out into the garden, having built the perfect backstop and fire away. It seems that my country's freedoms are being eaten away at, and life in the UK is becoming increasingly restrictive in such areas of life/hobbies.

It is certainly lawful to shoot sub 12 ftlb air rifles and 6 ftlb pistols in your own garden. I do it frequently without issue. The main factor is to ensure that any projectile fired does not leave the boundary of your garden, either directly or by ricochet. If it does and causes damage / injury, that is when the offence is committed. It is usually beneficial to engage with your neighbors so that they are aware, shoot with a moderator / suppressor fitted and have a backstop that deadens the sound can also help. There is plenty of guidance on the shooting forums / websites and BASC themselves. The only thing that may be a problem is if there is a specific rule within the HA agreement. I also don't know if this is the same in Scotland as they have slightly different laws regarding air rifles to the rest of the UK.

The rules etc regarding Airsoft and Airguns is draconian in the extreme, I know most people don’t like guns but nevertheless they provide sport and hobby/ pastimes for most responsible shooters. The Airsoft laws are a joke, why you may ask? You cannot buy a realistic imitation firearm unless you are a member of UKARA. Now if you buy an Airgun replica of say a so called assault rifle it looks just like the real thing,hard to distinguish between real and imitation but this is totally legal. I defy anyone to distinguish between an Airsoft version of the same gun with that of an air rifle version. Plus the Airsoft guns fire a projectile weighing a massive.........0.20grains leathal eh! with a power of around 3joules of muzzle energy. An air rifle fires a lead projectile weighing at least 16 grains with a muzzle energy of 12 ft/lb eg 16 joules, where’s the logic? I have owned both Airsoft and Airgun versions and find it totally mind boggling to realise that I can get five years for owning the wrong version. Like I said it’s a complete joke.

A good video. The actual documents are not that difficult to work through. The colours are specified for the permitted colours, so presumably if it was not one such colour combination it would also fall outwith permitted law and could land you on sticky ground. Anything that looks realistic is an immatation firearm amd its sale is restricted. Ownership less so. But then you are stuck with where and how it can be used. A firearms certificate is also not a valid ticket to purchase such a thing. It's bonkers but there we are. I don't recall there being such restrictions on the private purchase or exchange of RIF. Unless this is implicit in the clause about purchase. IIRC. it is purchase and not aquasition. My son wanted one to use on our own land, i got some unwanted airsoft items in factory black. All above board as far as i can tell. The restriction is on purchase amd not possession. Could a neighbour call the firearms unit and have us shot in our own home.. probably. Would that go down well with society today ? That could go either way with the idiots we have everywhere. Curiously when i contacted the local firearms and explosives office (police) they were somewhat relaxed about garage tinkering and making chemical or stored energy projectile devices.. the cloinfurze potato cannon as an example. Its not rifled. Doesn't use regulated propellent. Has no controlled components etc. Yet it would put a spud through you at any reasonable range. He was unclear as to the licences he complied with, but said the video was not released until things were in place. Simply don't cause alarm. Don't get caught with a defined item that falls into licence territory without said licence. Don't get caught with a prohibited item. Even if you have permission to use airsoft on private land, if there is public access or observation then fully expect it to cause alarm; then you can get shot in someone else's garden too. Do you have faith in our authorities and population ?
@alistercarmichael4990
@alistercarmichael4990 Жыл бұрын
@Tom Thumb Thank you for clarifying. As I did say it may be that the sale or purchase is not applicable to private sales. As you have cleared up it is the sale that is covered irrelevant of what guise that takes. As it happens we were given the items, no exchange or reward, if that makes a difference. Further to your point re lethal barreled weapon. Surely that would cover anything with a barrel and a muzzle energy greater than or equal to the threshold. Much as a screwdriver is a tool and not a weapon it appears to become one of it is being used for anything other than screw driving. Circumstances apply but not that many to make it questionable. Content for another video doubtless.

Apologies if I have misunderstood. But how does an air pistol escape being considered a realistic replica firearm? Personally I would prefer all guns to appear to be obviously what they are and would prefer all air pistols to look as such, but they are often modelled on real pistols.

airsoft laws make zero sense in this country, what is stopping someone with a real gun painting it a bright color to make ppl think it is an airsoft gun and then go on a rampage. and the fact that people who want to just do some target shooting or collectors still need it painted a stupid color.but also you can get an air rifle which is alot more powerful and it doesnt need to be painted at all :S

Why are imitation firearms more regulated? Simply because members of public who own real firearms with certificates are (mostly) responsible people with training that know not to brandish a firearm at other members of the public. The issue and following regulations for airsoft weapons was brought in when incidents occurred where certain youths easily obtained and took to using imitation weapons to obtain goods illegally (threatened and robbed people) and were subsequently shot dead by firearms officers who were unaware that the weapons were fake. I was told of one incident where a person with mental health issues approached a military base and brandished an imitation AK47 at the soldiers on guard.... the result was messy! So unfortunately these "toys" needed to be regulated to protect stupid people from themselves.... which pretty much sums up most of UK law and health and safety acts. Stupid/maliscious people will use items outside of their intended use and get early access to the afterlife and the government/emergency services get the abuse for not stopping them so then laws are brought in to stop such incidents only to receive backlash about how mean and oppressive these new laws and regulations are. Damned if you do damned if you dont. Makes you feel like maybe we should just take off all the safety warnings and laws then let Darwinism deal with the rest.....

@@armedready1 Yes, and yet if a law is found by a judge to go beyond it's wording then you are treated as if you knew this already ("ignorance of the [unwritten] law is no defense"). My problem with him here though is that this law is totally unjust; it does absolutely *nothing* to fight "violent crime", it criminalises the innocent, harms innocent legitimate interests and all whilst putting toys under tighter restrictions than some otherwise identical guns. And yet I have little doubt that if pushed he would fully support it but as with his views on knife crime be unable to provide hard evidence to support that position. Kind of disappointing given he works in a field where powers of analysis & debate are pretty important.
