question: contest is two main entries: 1) make a purchase, 2) refer a client and they are entered when person referred makes a purchase. (person that made the referral did not have to make the purchase, but the person they referred did.) is the second scenario considered an AMOE or does this promotion still require one? Thanks

That's a great question. You would have to check with your specific location's rules, but by referring someone who makes a purchase, that should cover AMOE requirement. To be safe though, you may want to simply add a basic AMOE option, such as email us ABC info and be entered to win or fill out this form with ABC info to be entered to win. This can help you capture a ton of relevant info that you can use to market to that person later, and there is also no misinterpretation about the purchase or any tangentially connected AMOE to purchases.

Let’s say you have the main way to enter giveaway by going to a form to fill out email, then having free additional action entries for visiting page, commenting on post, and the like. Could you add an optional entry action for making a purchase?

Great question. You would need to offer an alternate method of entry for the purchase option. Remember, anyone can enter for free, and complete each of those additional actions for visiting a page, or commenting on a post. So lets say you get 1 entry for entering, and 1 entry for 5 different actions you complete, you will have 6 entries total. Then there is an option to make a purchase. Someone can complete that and get another entry and have 7 total entries, while someone who does not want to complete that option can only have 6 total entries. If someone does not want to complete that purchase option, they need a way to obtain that entry without having to make a purchase, so you would need to offer AMOE specifically for that purchase option. @@ViralSweep ok I see, would having an option like sharing the contest on socials and getting entries per referral be the AMOE? Because then the entries wouldn’t be capped to a maximum entry amount. Or would the action to purchase have to have an amoe described within the action itself?

@@generaterevenue192 Action to purchase needs a separate AMOE in your rules -- you can do a separate entry form that people can sign up through to get X amount of entries as opposed to making a purchase, or you can do a mail in entry, where they can mail in a post card to your address to obtain their free entry.

If you create a paid subscription which gives access to a list of giveaways but any of those giveaways are free for anyone to enter is that legal?

Yes, as long as they are not paying to enter the giveaway, and you are offering a separate service that gives them a list of giveaways to enter, then it is legal.

@@ViralSweep just so I understand, I can have the entries that are related to purchases with as many as they want and limit my AMOE to 1 per day/week, etc and that's ok, right? As long as the AMOE's entry has the same odds to win as any other entry right?

Correct, each entry is weighted the same, whether the entrant got it via purchase or AMOE. It's just that participants can gain MORE entries by entering other ways, such as making more purchases, performing social actions such as liking/sharing social posts, etc...
