Talking Feds with Harry Litman

Күн бұрын

The hiatus in the Trump trial gives us the opportunity to dive into other legal and political news for the first time in several weeks. A stellar panel of Jason Kander, Carol Lee, and Congressman Eric Swalwell assesses the debates, Haley’s endorsement of Trump, & the swing-state polls. We then consider the Justice Alito’s display of pro-MAGA flags outside of his two homes after January 6. Finally, we turn to the political implications of the NY trial, inc the likely impact of a Trump conviction.
-
TALKING FEDS PODCAST is a roundtable discussion that brings together prominent former government officials, journalists, and special guests for a dynamic and in-depth analysis of the most pressing questions in law and politics.

I recently interviewed a bunch of Trump supporters. I asked them which of Trump’s policies were their favorite. Not one could name a single policy. When I asked their opinion of Trump’s stated policies, some didn’t believe that he really said/meant it. Others said they didn’t know or care. When I asked them why they voted for him, two said that he was a good businessman, three said that he was a good Christian, two said they just liked him, four said he would save us from Biden. I asked what terrible things they thought Biden was doing, none of them could name anything. (Interestingly enough, abortion and immigration never came up but I’m in SC.

It truly is terrifying, how many ppl have completely surrendered to being told, what they should believe, who they should hate, and they never stop to consider any of it, theyve just disconnected their brains and eat it up raw. Personally, I think, there are 2 sections of Trump voters. The kind, u interviewed, who are just full of grievances and will mindlessly follow any1, who is telling them, that nothing is their fault or responsibility, that anything bad in their lives are due to others (and point to who they should blame/hate), and that theres nothing, they can do about, coz these evil ppl make sure of it. They dont even care, that he at best does nothing for them, he allows them to be victims and to hate, and thats all, they want. And then theres the other kind, who see him for, who he is, but they just dont care, as long as they can perceive an advantage to them personally, screw the country, screw every1 else, they just want, whats good for them. So much so, that a lot of them may get, whats good for them short term, but long term will be disastrous, and theyre blinded to it by the very short term thinking, that is very pervasive in the US, and their deep selfishness.

Haley was always thinly veiling her extremist views with moderatism. I saw that from the beginning. She is an opportunist just like Trump - she said what she needed to in hopes of gaining power and now she is doing what she needs to do to maintain power. She has no integrity and it was obvious to anyone who knows her history as Governor and her tenure under Trump. I am hoping that her supporters finally get the hint that there is no “better alternative” in the GOP.

I’m not sure Trump wants to debate. I think it is just a talking point, something for his base to grab onto, for the moment. Then, when it gets closer and closer, he will find some excuse, most likely something that he can say-like Biden is too old, or like you said, he won’t get a drug test.

However, it just might be, that hes bought into his own bs and actually thinks, that Biden is this dementia ridden weakling, who is just sitting in the WH having broth shovelling into his mouth. Oh, but also this malevolent crime lord in charge of a worldwide criminal cabal, who is personally persecuting Trump. Federal judges have lifetime appointments, including SCOTUS. They are appointed and confirmed by the Senate. Question: no one is infallible, not even a lifetime judge, so who and how are checks made to their judiciary errors and misconduct? Seems pretty important issue these days with Alito, Thomas and Cannon in Florida.
@dfuher968
@dfuher968 3 ай бұрын
Its also, why its all well and good to talk about a much needed ethics code for the Supreme Court, that they should at the very least adhere to the same ethics cose as the rest of the judiciary. Which is all well and good on paper. But an ethics cose is worthless without a real, useable enforcement mechanism. And we can see in the case of Cannon, that shes just ignoring the ethics code, by which she absolutely shouldve recused herself immidiately, and theres nothing, any1 can do, coz theres not enforcement mechanism to make her follow the code. Even tho the code in enshrined in law. Just like nobody can force her to decide on any of the many motions in the case, that shes been holding for many months, not now or ever, nor can any1 force her to actual set a trial date. Which is absolutely insane, that 1 single person has that kind of power, and there is zero accountability, zero recourse. There are very very good reasons, that no other democracy in the world has the insane judicial system, that u have in the US, and Cannon is only proving some of the huge problems with it, that could never happen in my country, coz there are actual laws with actual accountability and no single judge can change it or do, whatever the F they want.

On the topic of zombie laws, in my opinion, all laws should have a “sunset” date attached. While this will create more work for legislators, it also affirms whether a law is still relevant or should be amended, replaced, or just allowed to die. Of course, this can only work when there is a less hyper-partisan, more disciplined discourse amongst law makers. Let’s hope that we can get back to a semblance of that within our lifetimes.
@dfuher968
@dfuher968 3 ай бұрын
I would actually argue the opposite. That the extra work should be to automatically repeal a law, that comes under that definition, so its off the books no matter what. I would argue, that u guys have a lot of problems with laws, that do have a sunset date and have to be reauthorized, so theres a lot of drama and insecurity every few years and sometimes the laws just end up lapsing. Like the assault weapons ban. And why does the Violence Against Women act have to be reauthorized every few years??? In my country laws are on the books, until they are repealed, replaced or amended, period. We dont need the insecurity of, whether or not we'll still have our pensions next year, or if its going to be fine to be a wife beater again or anything of 100s of laws in the US, that only count for 5 or 10 years at a time. A country functions best with stability and knownledge of the law of the land. Even I know, that ur assault weapons ban worked beyond every expectation, yet when the 10 years were up, it had to be reauthorized, and by then Bush was president, Republicans were in charge, and they just did nothing and so got rid of it. Thats NOT, how legislative work is supposed to work. Its supposed to be such, that if u want to get rid of a law, u have an elected majority repeal, u should never be able to get rid of it by just ignoring a deadline. That is imo a huge part of the chaos of ur society. And thats b4 we get to so many other insane, often selfdefeating aspects, not least ur in many ways antidemocratic political system and politically controlled judiciary, where a minority through that control have been able to legislate, what they cant get an elected majority for, coz u also allow ur judges to legislate, which is NOT, how democracy works. And I could go on, but this is already a wall of text. I think, u get, what I mean.

Another key element is that in most incumbent situations, the incumbent is a known entity with a track record that can be attacked, whereas the challenger does not. It’s easier to make promises for the future when you don’t have an attackable track record. But in this rare situation we have two track records to compare and use as the backup for promises for the future. Trump’s track record is abhorrent.

It is extremely difficult, and almost impossible, to get a police job with a felony arrest, even if it does not result in a conviction. The same is true for misdemeanor arrests (see, Montana's Greg Gianforte), but to a lesser extent. But for politicians like Trump, a felony arrest or conviction is not disqualifying to be the chief law enforcement officer¹ (president) of the United States. The Constitution's "take care clause" says the president has a constitutional duty to "take care that the laws [of the United States] be faithfully executed." The president has no authority to engage in insurrection under the 14th Amendment and is prohibited from insurrecting by the take care clause.
