When defendant raise his counter claim, it becomes new plant for which plaintiff to file his WS and even if the original plaint/suit is decided or settled the counter cliam continues as new separate suit. Thanks, Practicing Advocate fm Mumbai

सर सीआरपीसी 154 में प्रथम सूचना रिपोर्ट में प्राथना पत्र में अपना नाम पता देना जरूरी है। लिखित प्राथना पत्र डाक द्वारा भेजने पर प्राथना पत्र में अपना नाम पता देना जरूरी हैं। डीएम तथा एसपी को भी प्रथमा सूचना डाक द्वारा भेज सकते है ।

SC ruling is that, u cannot file pvt. Complaint directly before the magistrate court. Mandatorily u need to follow 2 prior steps 1) U/s 154 (1) crpc complaint to Sr PI of local police by giving ur all contact details and descriptions of the offences committed, if he ignores then 2) after 15 days same Complaint U/s 154 (2) CrPc to CP or SP. , if no fruit yields, then after 15 days 3) U/s 156 (3) u r entitle to file ur pvt cmplt before magistrate seeking directions to police for Registering FIR (needs to engage an experienced Advocate here)
