On 27 July 2023, Ciarb's Iberian Chapter held the webinar (in Spanish language) titled "Has Brexit released the jurisdictional Kraken?", which comprehensively examines anti-suit injunctions from the standpoint of continental legal systems. This webinar brought together legal scholars, practitioners, and professionals interested in understanding the unique characteristics, challenges, and implications of anti-suit injunctions within common and civil law jurisdictions.
The discussion aimed to foster a deep understanding of antisuit injunctions by delving into the distinct principles, procedural rules, and theoretical foundations that shape their impact in continental legal systems and arbitration. It would serve as a platform for legal experts and thought leaders to engage in insightful discussions, share research findings, and exchange practical experiences related to anti-suit injunctions.
The expert panel focused on:
Continental Legal Perspectives: The conference will provide attendees with an in-depth exploration of how common law systems, rooted in legal traditions, approach anti-suit injunctions. Participants will gain valuable insights into the theoretical foundations, legislative frameworks, and jurisprudential trends that shape the application of anti-suit injunctions in these jurisdictions.
Comparative Analysis: The conference will examine the similarities and differences between continental legal systems' approach to anti-suit injunctions. By evaluating the diverse national legal contexts, participants will gain a nuanced understanding of how various civil law jurisdictions address jurisdictional conflicts and the enforcement of foreign judgments.
Practical Implications: The conference will go beyond theoretical discussions and offer practical insights into using anti-suit injunctions in continental legal systems with practical cases. Legal practitioners will share their experiences, strategies, and challenges in seeking or opposing anti-suit injunctions, providing attendees with real-world perspectives and best practices.
Case Studies and Precedents: The conference will present compelling case studies and landmark precedents illustrating the application of anti-suit injunctions within continental legal systems. These examples will shed light on the legal reasoning, judicial considerations, and outcomes in outstanding cross-border disputes, particularly with the arbitration, enhancing participants' understanding of practical implications and strategic considerations.
Panel Discussions and Networking: Interactive panel discussions could bring practitioners to exchange views and engage in critical debates about anti-suit injunctions. Networking opportunities will enable participants to establish connections, collaborate, and engage in fruitful conversations with experts in the field.
This event aimed to enrich participants' understanding of this critical legal tool within the context of civil and common law jurisdictions. It provides a platform for legal professionals to exchange knowledge, explore emerging trends, and develop practical insights into applying anti-suit injunctions in continental legal systems, particularly after the UK left the EU.
