So you moved to Mexico and love it here so much that you want to become a Mexican Citizen. Hold up, not so fast, there are some consequences that you may face if you obtain Mexican Citizenship. I am going to address those consequences and help you decide whether eventually obtaining Mexican Citizenship is for you. Also, if you already hold dual citizenship this video applies you so that you are aware of the consequences of holding dual citizenship.
I am here to address these consequences and explain how the consequences may not be in your best interest. I am also here to address that for a very small group of people getting their citizenship may outweigh the consequences.

I want to bring up something that was brought to my attention. I did make an error on my statement on social security. You can still collect social security if you renounce your US citizenship. I would like to thank the person who brought this to my attention because this is very important info. Here is a link showing that you can collect: www.ssa.gov/pubs/EN-05-10137.pdf

And about that woman and her children which were kidnapped back in June 2021 (still missing), the local news was covering it. The woman appears to have been traveling on 85 Libre, not the Autopista (which is way over priced). Local news was showing an increase in security on the Autopista, not the Libre route.

You have a very good point, rarely exposed or discussed. Local governments treat foreigners and tourists better than their local citizens. You have address the international law issues, rightly. But their is an unwritten rules that, in my point of view, is more important in practice that explain why you would be treated best as a foreigner. Tourists and expat are an IMPORTANT source of revenue for their country’s economy. They are protecting that. Aside of the international laws and treaties, foreign government and local authorities don’t want negative publicity. This principle apply to Mexico and several other countries that drive revenues from tourists and expat. If you have to obtain the citizenship, don’t publicize it. Try to be seen as a the foreigner by the locals, your social environment and the local authorities.

I like your style Mr DragonX. I have lived in Mexico for 35 years and have looked at the pros and cons of citizenship as well. My take is this- if you are thinking that owning land as a citizen, as opposed to a Fideicomiso Trust available to foreigners, is "safer", I would say that the Fideicomiso is a more secure title BY FAR, and even Mexican landowners pursue the Fideicomiso because it can not be challenged to my knowledge. I know many instances of challenges to Mexican land titles, especially by unscrupulous scammers who pay off the system to gain possession of valuable land, that end up in court sometimes for decades, but I have never heard of a Fideicomiso being overturned due to prior claim of the land. I heard one story years ago in which a Mexican Landowner subdivided and sold lots on his land, and Fideicomisos were issued on the parcels.....when another citizen came along and produced a much older claim on the land that was legal. The Gov awarded the "remaining" land to the person with prior claim, but said that "the lots with Fideicomisos were not to be challenged as that would betray The foreign confidence of "Trust Ownership" in Mexico....and the Fideicomisos prevailed. Your advice concerning the legal advantages of retaining citizenship of your home country holds water as well. I will not be pursuing Citizenship, though I plan on living out my life in this beautiful country with its beautiful people. Thank you for a concise presentation with your vast experience and cheerful demeanor.

@@RetiredLifeinMexicoNOBULL Yes, it is a small world. We almost bought a beautiful home in El Mirador a couple of weeks ago, only having been beaten to the punch by another buyer. When I watched your story, I related to it all. I'm 56 yrs old, and I retired a long time ago, but with a daughter here going to college and eventually graduating and going into the work force, we never had to really address the "what's next" question for my wife & I. But I have made a lot of friends in San Miguel and we were welcomed there more than we've ever experienced anywhere else on the planet. We've lived in Arizona for 20 years now, but the costs of living here are so high, and even though we can afford it, I'm just not sure I want to run the risks with the medical system here. In 2019, I chose to go to Guadalajara and have major surgery, and it was the best medical experience of my life. I think that we just gradually became acclimated with Mexico although I understand the risks. But with that said, I'm not from America and I migrated here myself when I was 25 and even back then the thought of coming to America was fueled with the news stories of gang wars, drugs, poverty, guns and muggings. That didn't stop me, and I've had a great life here because I wasn't afraid even though everyone around me would say, "Over the hill, there be dragons". Anyway I realize you are traveling in the USA right now, but if you find yourself back in SMA in August, my wife & I would love to take you and your wife out for lunch or something like that. We are all trying to get to know people there as we transition and your experiences are gold. Please do keep up doing the KZfaq thing. I have a podcast I've been doing for years now (www.beunconstrained.com) and I used to be a recording engineer in Hollywood so if you ever need help with anything to do with sound (and I'm not as good, but I can do videography) just let me know. I'd be happy to help out in anyway I can.

Good info. Here is an odd reason someone (like me) _might_ get their Mexican citizenship rather than stay with permanent residency. US citizens who are permanent residents of Mexico are ineligible for Fullbright Grants in Mexico, but dual citizens are eligible. You seem to say Mexican citizenship is an either/or proposition-stating “ giving up US citizenship.” I don’t believe most Permanent Residents intend to give up US passports but merely to exercise our right to dual citizenship to take advantage of buying within 50 miles of the ocean.
@RetiredLifeinMexicoNOBULL
@RetiredLifeinMexicoNOBULL 3 жыл бұрын
Actually, I am not saying that you renounce your US Citizenship in any way by becoming a Mexican Citizen. It is not a either or situation. What I am saying is that you loose certain diplomatic protections. I also point out that even though you loose these diplomatic protections, it does not mean that the US will not intervene on your behalf, they will be limited in what they can do and México does not have to abide by certain rules if the US does intervene. I also do state that it is beneficial for those that want to own property by the beach and the benefits may outweigh the consequences and even give example of people who have lost their homes because their property was not secured as a Mexican Citizen. You have a very valid point but you must understand like I told another KZfaqr that lives in Rivera Maya and did a video on getting Mexican Citizenship that not everyone is buying property on the beach and actually this group is a minority of Expats within the Expat population. Maintaining your diplomatic rights in areas other than the beach may not be in their best interest. Another important note is that there are those that just want to practice their right to get dual citizenship because they love Mexico and feel part of the culture and those who would like a Mexican Passport so they can travel more freely. Your point is very valid as well as this other group I mention. I respect that and that is why I say it is a personal decision and can not advise anyone on what to do!
@jillcohndc
@jillcohndc 3 жыл бұрын
@@RetiredLifeinMexicoNOBULL I listened pretty carefully. You may wish to edit your video & insert “dual citizenship is perfectly acceptable to either country.”
@RetiredLifeinMexicoNOBULL
@RetiredLifeinMexicoNOBULL 3 жыл бұрын
Yes I did mention that dual citizenship is recognized in Mexico but that Mexico will consider you a Mexican Citizen first and your other citizenship will be secondary which presents several diplomatic hurdles and does not bound the Mexican Government to abide by certain diplomatic rules and in some cases because of these hurdles the US government will not intervene on your behalf. I even gave the insurance analogy to make my point. Yes you have two insurance but which one pays and what they pay is a different story although you have two insurances. I am very familiar with this and have dealt with dual citizenship on a diplomatic level. Both countries both recognize dual citizenship but at a diplomatic level it is another story. This even applies in the United States and believe it or not that is why some Mexicans decide not to naturalize. For example in the example of when I arrested someone, if the individual held dual citizenship, I was under no obligation to contact the Mexican consulate nor did I have the obligation to give consular officers access to the arrestee even though they were also a Citizen of México. I think you are misunderstanding the video. I never once mentioned that you give up your US citizenship! The only reference that I made to giving it up is those who want to avoid paying taxes. Look there are advantages and disadvantages and the answer is not black and white and like I said it is a personal decision and all I am trying to do is educate people as to the consequences and benefits of dual citizenship. For, a majority it is not convenient because like I said a majority of expats don’t live on the beach.
@RetiredLifeinMexicoNOBULL
@RetiredLifeinMexicoNOBULL 3 жыл бұрын
Another important thing to note is that many misunderstand the meaning of Dual Citizenship. Basically there are some countries that require you to renounce your citizenship in order to obtain citizenship in their country which is basically a form you sign or you may even be required to surrender your passport so they can send it to the US showing you renounced your citizenship. Being a dual citizen only means that the country you obtain citizenship in does not require you renounce your other citizenship. At a diplomatic level it gets more complicated. There is a difference between not requiring you to renounce your citizenship, which makes you a dual citizen, and the host country not acknowledging you other citizenship when it comes to diplomatic relations and agreements. Truth is that the only advantage to holding dual citizenship, apart from the reasons I mentioned, is the ability to maneuver both countries without having to worry about visas or residency but from a diplomatic standpoint you loose some diplomatic rights afforded to you on both sides of the border. I hope this clears things up for you and anyone else who was confused by this…😀

There is nothing restricting non-MX citizens from purchasing property within 50kms of the ocean, if they do it in partnership with a MX Bank trust (fideicomiso). It lasts 50 yrs, can be renewed once more (I believe) and has a right to pass it down to one's heirs if needed. That said, retaining US citizenship burdens most expats in that they have a harder time opening bank accounts (not so much in MX, but more so outside) due to FATCA laws, have to report holdings of more than $10K of liquid assets in bank accounts, trusts, retirement policies, etc. annually to FINCEN, etc. Although these compliance requirements are not too hard to deal with if you have a good US attorney for this, failure to do this can have hefty penalties that have become a windfall to the IRS. Many renounce due to those restrictions, rather than to have land ownership or voting rights. However although this is not the case in all countries, MX and USA do not restrict dual citizenships. I have 2 already with other countries, and MX would be my 3rd. But that said, I'm happy to use permanent residency. I am, however, cognizant that MX immigration crackdowns are real (as our host here has done an excellent video on) and that there is no control over changes in administration (either in the USA or MX) that would harden the border entry requirements for non-residents, as we have seen at the land border with COVID restrictions (ie. only essential travel allowed). My concern would be that without a decent and legal means of residency, that as MX increases their automation and software systems, they will move towards a more restrictive entry policy. Considering the influx of asylum seekers from the south, this seems almost innevitable IMHO.

@RetiredLifeinMexicoNOBULL
@RetiredLifeinMexicoNOBULL 3 жыл бұрын
The case I mentioned is in the case of serious accident where there is a physical injury. This does not pertain to fender benders and minor injuries at least in most cases. They saying in Mexico if blood is shed as a result then you get put in jail. A long time ago it was for any type of injury but now it has to be physical visible injury in most cases but I have heard cases of people going to jail for minor injuries still. Also, in the case of whiplash that is a subjective injury and not a physical injury. The injury must be a physical injury before they send you to jail. Also, you mentioned you had to wait for your insurance to get there. Here in México, you usually call your insurance before you call the police. When they go out on these types of accidents and a person is driven away in an ambulance, they can mitigate with the police and prevent you being sent to jail since it is a subjective injury and prevent you from being arrested because it is the insurance company is the one who legally represents if you do go to jail. Actually, your insurance is the ones who will send lawyers to the jail to get you out especially if it was not your fault.

Something I've been curious about for a while is about Mexican-born Mexican citizens who acquired American citizenship. I obtained dual citizenship because of my parents. When I got my passport, the consulate told me I had to enter Mexico with a Mexican passport. However many of my relatives including my own parents, have not entered Mexico with a Mexican passport since acquiring American citizenship. They say that they get better protection if they use their Mexican passport but in their case, it doesn't matter because they are Mexican citizens? Also since they are Mexican citizens, aren't they required to enter as Mexicans with Mexican passports?
@sebastiannegrete9659
@sebastiannegrete9659 2 жыл бұрын
By Mexican law the Mexican nationality by birth can't be renounced, thus all your relatives which are Mexican nationals by birth are legally required to present a Mexican passport. In general the immigration authority will do a blind eye as long as they don't check each persons profile and it comes up that they are Mexican nationals. The problem is that if they ever get in trouble with Mexican authorities, sooner or later the records that proof that they are Mexican nationals will appear and thus they will be treated as Mexicans even if they have acquired other nationality. One important thing is to distinguish that Mexico differentiates citizenship and nationality, your relatives by entering Mexico with a foreign passport loss their citizenship status (not able to be elected or vote primarily) but they still keep Mexican nationality.

@H Rico You are absolutely correct about the jail thing. You will not get out of being sent to jail if you are a foreigner. That is the reason, I pointed it out in the video. Many people use the argument that I’m not doing anything illegal, I won’t ever have to worry about going to jail. The consulate rights apply when you are actually detained. Getting in an accident is a perfect example of being sent to jail even if your not doing anything illegal. Thanks for your insight…😀

Are there any documented cases of a permanent resident holding a property through Fidecomiso, where the bank went bankrupt and the individual ended up losing their property? Good and accurate advice. However, I believe setting up a Mexican corporation is another way for a foreigner to own coastal and border properties. Wouldn’t work if the property is primarily the foreigner’s residence, but for a business it is an option. Rental properties, hotels, restaurants, etc.

So, imagine that a Mexican citizen moves to the United States and eventually gets dual citizenship. In this case: (1) Would the Mexican government provide any help to this person if they are arrested in the United States? (2) Would the United States be obligated to notify Mexico of the arrest? (3) If the person is traveling in Mexico, or moves back to Mexico to live permanently, would Mexico be obligated to notify the United States of an arrest made in Mexico? Of course, I'm only mentioning arrests here, but I suppose help between the two countries would apply in other circumstances, too.
@RetiredLifeinMexicoNOBULL
@RetiredLifeinMexicoNOBULL 3 жыл бұрын
Actually, you bring up a good point. When I was working and arrested a dual citizen in the US, I was under no obligation to contact the Mexican Consulate. We treated the person as a US Citizen. Same philosophy as in Mexico. Yes, your dual Citizenship is recognized by both Countries but your primary Citizenship is where you live if that makes sense? This is the problem dual citizens face in both Countries. Now with that being said, you still have the right to contact either government to ask for assistance but they are not under any obligation to assist and in most cases diplomatically respect the other country and won’t assist. Now if the case is high profile or extreme there are cases when they will step in but diplomatic rules will not apply if they do. People misunderstand this video that I am stating that you give up your Citizenship to the other country and argue that both countries recognize dual citizenship. Yes they do but that only means that the country that recognizes dual citizenship does not require you to renounce your citizenship if you become a citizen of that country. Some countries require a person to renounce their original citizenship in order to become a citizen of their country. What people need to recognize is that there is a difference between a government recognizing a secondary citizenship and diplomatic rights. Actually, even in the US, there are some government jobs that require you to renounce your citizenship to any other country for reasons of National Security. I hope this answered your question.

Interesting video but I am not sure I agree with you. The USA is for the most point is not going to do much beyond notify your family you got arrested, political pressure will only be applied if it is in the USA's best interest. I have seen political pressure applied for dual citizens many times, one famous one happened when some dual citizens were killed in the colonies. At first the Mexican government wasn't going to do anything but the US government pressed for an investigation because they were dual citizens. Also regarding your car example, if you have insurance that pays a bond, you will not be jailed, it is just a matter of having good car insurance. As a foreigner in Mexico you have no rights in Mexico, technically even as a permanent resident that residency can be revoked at any time. A Mexican citizen can never have their residency revoked (although this is highly unlikely to happen) . Also, dual citizenship does not prevent you from any money owed to you from a USA source such as a pension, social security, and/or USA based investments. The only problem I see with being a dual citizen is you can't join the army or be the president of either country. Also, you are very unlikely to get a job for the state department in either country because neither country is going to want to make you a diplomat knowing that as soon as you cross the border you are no longer subject to their jurisdiction (this also the reason many federal employees are prohibited from going to Mexico).
@RetiredLifeinMexicoNOBULL

Your disagreements are duly noted but I must clarify some things here. I have repeatedly mentioned that the US Consulate is not a get out of jail free card. I was assigned to the State Department for 3 years and worked in a field where we dealt with this frequently. As you say that the consulate can not do anything other than advise your family is not totally correct. They serve several diplomatic purposes when a foreigner is arrested. Including ensuring that your human rights are being observed, helping with obtaining local counsel and yes advising your family immediately. When you are a dual citizen, Mexico will consider you Mexican first and those diplomatic rules don’t apply. For example in your family example, if the Mexican authorities are not required to contact the consulate, it could be weeks or even months before you can advise your family since the Mexican Government has no obligation to advise your family or consulate. Also, it is important to note that there is a difference between diplomatic pressure and political pressure. There are certain diplomatic pressures each country has a right to if another country is not following certain rules. This is where your protection comes in to play. I also, never said that dual citizenship restricts you from drawing money from any foreign source. I did make a mistake that I duly note in the comments when I spoke about people renouncing their US Citizenship for tax purposes. I had stated that you couldn’t draw social security which I was corrected on and acknowledge in my comments. As far as joining the Army as a dual citizen, I am not sure about Mexico, but you can in the United States. As far as the car accident thing, yes if you have a good insurance policy the company has lawyers that can bond you out but depending on the seriousness or circumstances of the accident, even with good insurance that can take days and even weeks. This is where it is important to have the consulate contact. They can even help make sure you get bonded out by keeping contact with your insurance company lawyers. You are correct about being President. Now in the US, you can hold public office except for the Presidency. In Mexico, you can not hold a public office unless you were born here. Also, having worked with the State Department, we had several people who were dual citizens. Where dual citizenship comes in to play when working for the US government is with Security Clearances which I can’t really discuss. Also, there is no restriction by any agency on government employees traveling to Mexico. US government employees from any agency can in fact travel to Mexico. Now with some agencies, security clearances come in to play but it does not restrict employees traveling to Mexico. The only time government employees are restricted from traveling to a foreign country is when there is a safety risk or threat to government employees in that country. Also, employees stationed here in Mexico have certain travel restrictions placed on them for safety reasons. Look, there are many valid reasons a person may want citizenship including having pride in the new country in which you live. There is nothing wrong with any of these reasons. My goal is to educate people on what they are getting into if they choose this route. Nothing more, I am not advising against it and even list the reasons it may be advantageous.

@RetiredLifeinMexicoNOBULL

@Noslen Sesom I have never been asked that question actually. I get my income from a US government pension so I have no choice and I am a permanent resident. There is a lot of debate on this issue and I am not a tax expert. A lot of people working from home for US companies here argue that it is foreign earned income since they are physically working in Mexico and some argue that it is not because the income source is from a US company. Now if your income is foreign earned you can claim the foreign income credit and my understanding is that you have to report it, but then again I am no tax expert.

My best advice would be to join the SMAllende Friends (not to be confused with the Newcomers and Friends Group) Facebook group and the San Miguel de Allende group. These two Facebook groups often list properties for rent. Also, when posting questions to the group, I have found the people in these groups to pretty very honest in their answer. Since I live on the outskirts, I am not very familiar with which neighborhoods most expats gravitate to. It would be best asked in those groups. They both have a very diverse group of people who live throughout the city and could probably give better advice than me.

Being married to a Mexican Citizen, I would advise going straight to permanent. The only advantage to Temporary would be if you want to bring a US vehicle with you. Also, another catch to Temporary Residency being married to a Mexican Citizen is if you want to convert to Permanent, you have to hold temporary a minimum of 2 years. So basically you are tied in to two years before you can convert to permanent. Best off going straight to permanent. Also, don’t have to renew like TYemporary.

@Guac’n’Roll You do not have to renounce your your US Citizenship. Both the United States and Mexico both recognize dual citizenship. There are definitely advantages of having dual citizenship but this video was to point out what you give up as a dual citizen which many people don’t realize. As a dual citizen here, Mexico considers you a Mexican Citizen first and then recognizes your other citizenships after that regardless of where your original citizenship is from so in the case of consulate assistance from another country, if you are a dual citizen, Mexico does not apply Diplomatic protections to you even though you also hold a different citizenship. Although a majority of foreigners living in Mexico never have to use these protections, I thought it was important to point out. I have seen cases where several dual citizens start demanding or threatening consulate protection when they have no standing. It is a personal decision and many people get their citizenship for different reasons that benefit them. This video in no way is to discourage anyone from getting their Mexican Citizenship. This video is to educate on the consequences so people can make informed decisions. That is the main goal of my channel. Hope this helps.:.😀

@hectorpast7 There are advantages to having dual nationality but many individuals do not know the consequences of naturalization. Also, it may not be common but foreigners do get in trouble here in Mexico, to include being falsely accused. I have handled several of those cases in the past. The bottom line is that as a dual Citizen, Mexico considers you a Mexican Citizen first so if you do get in trouble, things like US Consulate protection is not guaranteed or if something happens to you and your family calls the US Embassy for help, they may not be able to help you. This has happened a lot with dual nationals that are victims of crimes here In Mexico. Yes, I know because I spent time as a diplomat and am aware of such cases. Maybe if it is high profile enough the US government will intervene but if not you are out of luck having the US government put pressure on Mexican Authorities to solve the crime. I am just here to educate individuals on the consequences of naturalizing. The decision is up to the individual if the benefits outweigh the negatives.

I understand the point, but I’m gonna go out on a limb and say that France’s diplomatic relations probably aren’t as strong as the US. The US has a lot more treaties and active collaboration with Mexican law enforcement and military than a random European country. So while I’m sure being a Mexican citizen would deprioritize you for diplomatic assistance from the US - if it was an especially egregious case of human rights violations the US would still intervene. However, dealing with corruption in law enforcement and the judicial system is a risk you assume living in just about any foreign country and the US can only do so much.

Thank you for sharing the information. I'd like to add another possible/potential negative consequence of getting naturalized in Mexico (I'm not sure if I'm right): Article 37 B) of the Mexican Constitution: "La nacionalidad mexicana por naturalización se perderá en los siguientes casos: I. Por adquisición voluntaria de una nacionalidad extranjera, por hacerse pasar en cualquier instrumento público como extranjero, por usar un pasaporte extranjero, o por aceptar o usar títulos nobiliarios que impliquen sumisión a un Estado extranjero, y II. Por residir durante cinco años continuos en el extranjero." Which means that if a naturalized Mexican citizen subsequently obtains other citizenships, his/her Mexican citizenship may be revoked by Mexican authorities (i.e. according to the Mexican Constitution, Mexico restricts naturalized citizens from obtaining other citizenships subsequently). So getting naturalized in Mexico may not be a good idea for those who are planning to obtain other citizenships subsequently. What do you think about what I mentioned, sir? @@RetiredLifeinMexicoNOBULL I was about to delete my comment because the level of quality information is very high. And you deserve 5 out of 5 stars. I'm also considering to get my MX dual citizenship because my father lives and owns property in DF and Zacatecas. The plan is for me to move to DF and manage the rental property there and retire. I will not relinquish my USA citizenship. I think maybe being a MX permanent resident might be the best recourse. Thank you and you are awesome. I love your video, and also the comment section is full of great information too.

I was born in Mexico to two American citizen parents. I have not been to Mexico since 1956. My birth certificate is from Mexico. Based on what you are saying, if I travel to Mexico on vacation & I’m arrested, my duel citizenship can hurt me. I’ve been thinking about moving to Mexico due to the political situation here in America, but now it’s not looking like such a good idea.😮 I just can’t live with the fact so may of my Republican x friends think it was a good idea to put Hispanic children in cages. Even though my Spanish is abysmal, I identify Hispanic.

Wow, this is interesting….I wouldn’t want to become a Mexican citizen por nada…I would rather rent a place for cheap than lose my home.

I’m a PR in Mexico. I own land, built a home, everything in my name. The only thing I can’t do is have a Mexican passport, or vote. Which either doesn’t bother me. As you say, I think for safety reasons, I wouldn’t give up US citizenship or become a Mexican citizen. That’s another reason I prefer to stay away from tourist areas. I was involved in several accidents bc idiots here don’t know how to drive, and nobody got arrested. Paid me off and there u go, police where I live don’t care. Lol
