But, as a lawyer and law professor, one of my biggest concerns is how Ohio's criminal law can and will respond to these crimes."*
Ariel Castro is the main suspect in the kidnappings, repeated rapes, and torture of three Cleveland women over several years. I read in another article on this case that is already considered a death penalty offense if you force a person to undergo an abortion (in this case a forced miscarriage) - can anyone corroborate/confirm/correct that?

Not caring is just as bad as advocating it. It's like not caring about a child being raped and just standing by, not doing anything to stop it. To say you don't care if that happens makes you just as guilty as approving it. Letting him "rot"? Deary me.

"Keeping a person in a cage to be beaten and raped until they are dead is what I'd call cruel and unusual punishment. " No need for the rape and beatings. Keep him in isolation. Society protected, and no cruel and unusual punishment, and no necessary rehabilitation.

The irony of justice among thieves. People who are put in prison or jail for rape, spousal abuse or child molestation are way more likely to get the shit beat out of them than those in there for other crimes.

btw, saying it's worse to get imprisoned because we happen to endorse and supply cruel and unusual punishment in jails, is not particularly civilized, it's not a good reason to keep someone alive.

How can you ever want to deny someone a trial? No matter how much you hate them, I'd always want to give them a trial. You have to know the person is guilty, otherwise you're hating the wrong person. Once found guilty though, prison, torture, death, none of it is enough.

I don’t think the death penalty should have been based on forced miscarriage, it should have been based on attempted murder _of the three women,_ through the acts of starving them, beating them, and forcing them to endure physical and psychological torture for an entire decade. Any of those three things could easily kill a person _on their own,_ let alone in combination.

Cenk's point on setting a precedent is correct. In the UK a foetus has never legally been a human being due to a 1790 ruling that "a child is not a child till it takes breath independently of its mother" This ruling was later overturned in a very emotive traffic case with a miscarriage and ever since the anti abortion lobby have been on fire despite being pretty much non existent before.

When they said that he starved them for two weeks and then punched them in the stomach until the baby was "aborted" I had to stop the video for a second. Man, that's some harsh shit.

Look at it this way. Do we punish people with tourettes for swearing? No. Do we punish people with Parkinson's disease for spilling our beer? No. Of course, what he done was much worse than the examples given, but the same principles apply. Punishment doesn't work, especially if he has psychological trauma, which he almost certainly does. You need to ask yourself what made him do this in the first place. Lack of empathy? Urge to harm? If so, then how and why did he get this way?

Nobody said it gives them a fee pass to commit crimes. If their crime is harsh enough, they need to be taken away from society so they cannot do it again, but to punish them for actions not under their control is just vile.

That is definitely a huge part of why I don't believe in the death penalty. Killing him would just end him and his miserable existence, there needs to be more done.

do you know almost every killer bargains to avoid the death penalty? the victims family should decide not people who assume prison is worse than death, if that were the case millions would not be making deals to avoid this sentence. it's selfish to the victims.

When I was 13, my mom used to buy name-brand clothes and purses from stores in my area and then sell them on eBay at a good price. She made a good amount of money and, at the height of her 'business', she bought a cheap mannequin from a friend of hers. The mannequin creeped me the fuck out at 13 and it continues to creep me the fuck out at 18. Mom rarely uses it now and she keeps it in the corner of the garage. As a result, I'm scared to go into the garage at night. The logical part of (1/2)

He wrote in a journal that he wanted to commit suicide, so capital punishment is exactly what he wants. Death is an easy way out compared to rotting/ getting raped in jail. Don't let him have death, let him suffer.

Allegedly, he was violently raped numerous times as a child. How do you know what life this man has had? You don't. And he probably does have a fucked up limbic system, which means he is a victim of that and has hardly any control over his actions. It's the equivalent to that guy who went on a raping spree, then found to have a brain tumour. He was fine after it was removed, but then started raping again...because the tumour had grown back. This guy was also a victim first.

"Revenge is nothing that comes from nothing" - No idea what this means. I am not neglecting the victims, this topic is not about the victims, it's about Castro facing the death penalty or not. Are you actually saying he decided to take part in being raped as a child? Let me make it simple for you. Would it surprise you to learn that these three victims will now have suffered psychological trauma and may very well act irrationally? What would you do if one then went on to harm another due to it?

no. A fetus is not a legal person. You can only murder people. You don't just get to say a fetus has rights when you feel like it. The crime was starving her, beating her, and forcing miscarriage on her, not murdering a fetus.

Not if the guy is under lock and key now. It's not like he is in the middle of raping a baby and needs to be taken out. In this case, the logic is to keep him out of civilised society until (if possible) he can be rehabilitated. The logic is not to murder him for your own blood-lust.

some states have laws about that some not, CNN has reported Ohio is a state where if they can prove that it's a murder. However, they may need physical evidence (like finding buried fetuses) which of course may be difficult assuming he didn't dispose of them at his house.

Setting an example doesn't work as a deterrent. There are 0 potential serial killers/rapists/etc who would not have done it if they heard that someone else got put in solitary confinement. You just want to torture people.

Abused kids grow up to identify either as an abuser or as a victim. I spent most of my life playing the victim during my drug addiction. I blamed it, and my suicide attempts, on my abuse. Not true; I'm an addict bc it's a disease and I'm clean three years now. I'm no longer a victim. Nor do I have any shred of sympathy for this sicko. The scariest thing is how he acted normal for so, so long before he was caught.

Yep. It's a whole new field of discussion that has been opened for debate when it has been discovered that a) free will doesn't exist, and b) if you have a psychological disorder then you are a victim of it. People can't get their heads around not wanting to punish people. But what does punishment achieve? Smacking a child causes underdevelopment in their brain, particularly with the parts which influence emotions, making them worse. Punishment has NEVER worked, and never will work.

Clearly he had one in which he seeked to harm others and that is my point. Obviously I am not advocating the murder of anyone who is physically ill, for example. I don't agree that prisoners being mistreated by other prisoners has anything to do with justice. I think it has everything to do with an instinct for cruelty. It's easier for society to vent their cruelty onto someone who's been cruel as well. Not to mention lots of innocent people are in prison and get mistreated as well.

*Sigh* He doesn't deserve worse. People get too lost in emotions rather than the science and logic. I have no doubt that this guy had been through some shit, and most likely has some deep psychological trauma, as all offenders like him have been found to have. Some people can't be rehabilitated and need to be locked up away from civil society, but to want this man who is now under lock and key to then be murdered is just as bad as what he done. It's not justice, it's revenge and murder.

The miscarriages are trivial compared to everything else he did. He's a serial rapist, serial torturer, hostage-taker, with a history of assault a mile long. If the death penalty is considered appropriate for anyone, it should be those people who are beyond rehabilitation - which he is - if you execute him, execute him because he's fucked in the head. Going after the miscarriages is like arresting an assassin for breaking and entering, but ignoring the murder.

No, my logic is, that they are going to be in prison the rest of their life with no chance of parol, & do nothing but drain on society, with zero chance to be able & turn their life around. The part that makes people a monster is when they go on and want them to be tortured for the rest of their life, so that person can get smug & think about the pain that they are in for their own pleasure. Amusing considering our nation is spiraling into debt, & we have people who legitimately argue to rid the death penalty for those who have life in prison w/ no chance of parole, so we end up spending far more money on say a murder of 5 people, to keep them alive for decades all because people want a sense of 'revenge' instead of actually trying to make the country better. Would you agree that a person with tourettes suffers some kind of brain damage? If yes, would you agree that the person with tourettes is a victim of brain damage? If yes, should we punish them for their actions? If you're answer is "No." to the first two, you are demonstrably wrong. If you're answer is "Yes." to the first two then you either want to punish them for brain damage which is not their own fault, OR you would want to help them recover (if possible) from such an affliction.

Explain why you think it's pathetic. These are the countries still using capital punishment. Afghanistan, Bahamas, Belarus, Botswana, China, Cuba, Egypt, Guatemala, India, Indonesia, Iran, Iraq, Israel, Japan, North Korea, South Korea, Lebanon, Malaysia Pakistan, Saudi Arabia, Singapore, Somalia, Suriname, Syria, Taiwan, Tajikistan, Tonga, United Arab Emirates, United States, Vietnam, Yemen. With the exception of Japan, NONE of those countries listed could be classed as civilised.

I think if you kill someone's unborn baby against their will it should be considered murder. You've literally killed a living and complex and unique organism that is on its way to be becoming a human being. There should be special laws for that. It should be murder. Now, If you want to say that if its WILLFUL/Consensual and that it is not a crime then okay...but this should definitely be a murder-like crime.

justice and revenge only both entail that if you ascribe to "eye-for-eye" justice, which is revenge. It's making punishment (suffering) the point of justice, rather than actually accomplishing a PURPOSE (deterrence, rehabilitation, removing dangerous people from society). "eye-for-eye" justice is a popular belief, but it's arbitrary. Why should the government be doing something that isn't benefitting society? Why should they be doing something simply to cause suffering?

Jail is not about punishment. Its about rehabilitation. Its the governement version of sending somebody to the corner for X amount of time so he can learn to calm down. Now, in some cases they will never get out because they cant go back to society. .

I agree, death for miscarriage is dangerous. So why not make laws to apply the death sentence for repeated rape, murder, or torture, based upon 100% forensic evidence. In this case we have rape, we have torture, and we have 110% evidence. Isn't rape or torture in some cases worse the death, the least he can get is a painful death in return.

Im so amazed these girls survived that beign starved for three weeks. Its just so horrific to imagine it, I feel like crying thinking about it. Those poor women who were just girls at the time they were captured.

Can anyone else not understand why putting someone in a cardboard box and closing it on them is bad? I mean, push on the box? My cat can escape from a closed cardboard box, why can't a grown-ass woman?
