At Approximately 11:04 PM, August 2, 2021. ASP Trooper Zackery Smith of Troop D was traveling on a residential street road in FOREST CITY when he encountered a 07' Red Jeep Liberty with its right tail light not properly functioning. TRP Smith decided to stop the vehicle, and did just that in the parking lot of a business at 1809 Sidney Drive.
Upon Approaching the Vehicle TRP Smith greeted the male driver indentified as BRIAN DWIGHT HIGGINS and announced who he was, his agency, and the reason for the stop. After a few moments of conversation, the TRP notices a odor of Alcohol emitting from the vehicle and questions the driver who denies drinking. The TRP returns to his patrol unit where he asks for a secondary TRP.
The TRP returns to the suspect vehicle and asks the male to exit the car for FST. The male refuses. A physical altercation between the TRP and the Arrestee ensues, resulting TRP Smith draws his taser. As this is happening, TRP Tanner Hess arrives on scene for backup.
TRP Smith states several times "I am going to tase you" to which the male replies multiple times "You're not going to tase me." The Troopers successfully remove the male from the vehicle, yet he is still uncooperative and another small struggle ensues before TRP Smith shouts "Taser Taser Taser" and fires once into the back of Mr BRIAN DWIGHT HIGGINS. The suspect shouts and is taken into custody.
Moments later SGT Flemming arrives on scene as acting supervisor. Meanwhile the arrestee continues to shout profanity.
SGT Flemming has the female passenger exit the vehicle. Seconds later EMS/FIRE arrives on scene and clears the male medically. After a search of the vehicle, and a breathalyzer of the passenger to determine her ability to drive, the vehicle is released to her.
The man BRIAN DWAYNE HIGGINS was transported to the SAINT FRANCIS COUNTY DETENTION CENTER and charged with the following:
1. Obstructing Governmental Operations
2. Resisting Arrest
3. Driving While Intoxicated - 1ST DWI
4. Refusal To Submit To a Chemical Test.
