If you ALREADY have a green card by marriage to a U.S. citizen, you need to wait 3 years before applying for U.S. Citizenship. If you are trying to get a green card because you married a U.S. Citizen, then here is the key question: did your parents bring you into the USA legally, through an airport, or border crossing, or cruise ship terminal? Hiplease answer my question I am struggling and no one could answer my question, My husband american citizen has 4 names, given name, 2 middle names and the surname like ''Leonardo victor lawrence alexandre'' where victor and lawrence would be middle name, I130 only let me put ONE middle name, what should I do ???? also can i sign the forms with ink even if it was filled on adobe?

hey +Arthur Serratelli , I am the (American Citizen) Brother-in-law to a resident who is in the long process of having a non-lawyer represent him and fill out his paperwork for citizenship. He has an i-TEN? number he uses to file taxes, and has spent a few grand so far, my sister says they may not be able to continue using their current sponsor though (this non-lawyer lady has claimed the income requirement of the sponsor has increased by 2500$ since last year, which I believe is false because claiming a family of 4 at the Federal Poverty Level only went up 50$ from 2015 to 2016, and 50x1.25% is not 2500. I think she's a semi-scam, but I haven't spoken to the woman yet) So the question is, can I be a sponsor for my brother-in-law during his "Married to a citizen" application process? Also, they live hundreds of miles from me.

Thank you for taking your time Question about getting married with a tourist visa If someone comes with a tourist visa on vacation an gets married after 60 or 90 days how can that person proof that did not come with the intention on getting married. Do that person have to proof or show what he/she was doing during those 60 or 90 days. Once that person gets married I notice in the video they talk about showing proof of been married like showing pictures or paper work but the time frame of 90 days is not enough time to really show all those holidays or memorable times with family its seem that it would be better to way more time in odder to start the proses.

Ppl filing for your green card DO NOT send originals! if is a government issued document (on paper) like marriage license get a CERTIFIED COPY. (with its legal stamp) also REMEMBER to TRANSLATE all you foreign language documents (such as birth certificates) and this must have a stamp of an official and lawful translator. My wife went to her interview and there is no updated affidavit of support so she pass everything except the not enough income. But on my federal tax it's short by $500. But on my check stubs it states my year to date is over the 125% poverty income. My husband got a letter from the embassy stating I will need a co-sponsor. Do I need a co-sponsor or I can send them an updated Affidavit of support? I even got a letter from my employer stating that every year I get a %5 raise and it states my last year's income and my current year to date for this year. I will also be having some money in CD in the next 5 to 10 business days for 6 months. To be honest I don't have a co-sponsor. Chat Conversation End

It is best if you stay inside the USA and DO NOT go out until you have the green card in your hand (they mail it to you after the "marriage case interview") . . . I would only leave the USA if you absolutely had to, and only God knows WHAT they will ask you at the border . . . they could ask you about the marriage, the reason you left the USA before you got to the marriage interview . . . or . . . they may ask you nothing at all.

Levi Gerard if you married someone you will need to file a temporary residence and it has a condition of 3 years. After 3 and if you are still together then you can apply for removal of condition which it'll be applying for a green card. Ones she recover her green card she may apply for citizenship after 3 years:

As long as your marriage to your husband is recognized as "legal" in the place where the marriage took place, then the marriage is legal in the USA too . . . and USCIS will recognize it for green acrd purposes! Gino Tusciano the answer to this question depends on many variables. BUT, IF THE MOST IMPORTANT thing is to get married in HER home country, then you have only one real choice: the Immigrant visa. If I came to the United State as an immigrant on a visiting visa an I got married in tht six months period can I stay in the United States with my wife while my green card is in process or I have to go bck to my home country while my green card is in pending because they said if you stay over 6months your visa can be taken away

Without knowing more that uou told me, the answer is -- "Yes, stay in the USA." You can stay if the green card is pending. In fact, DO NOT LEAVE the USA until that green card is in your hand. (FOR SPOUSE WHO ENTERED WITH OUT INSPECTION."In the past, a foreigner who was not inspected and admitted or on probation in the United States was not eligible for the state adjustment (unless protected by INA Section 245 (i)). That person, when applying for permanent residency of a US citizen spouse, for example, had to leave the US. UU And attend a consular interview at the US embassy. UU Abroad to complete the immigrant visa process. When leaving the USA UU After accruing more than 180 days or one (1) year of illegal presence, the 3-year or 10-year income ban was triggered pursuant to section 212 (a) (9) (B) of the Act. The exemption I -601 was later required. In Matter of Arrabally and Yerrabelly, 25 I & N Dec. 771 (BIA 2012), the Board of Immigration Appeals held that a foreigner leaves the United States temporarily in accordance with anticipated probation under section 212 (d) (5) (A) of The law does not depart from the United States in the sense of section 212 (a) (9) (B) (i) (II) of the Act. Anticipated parole is an administrative practice derived from the general probation authority in INA § 212 (d) (5), giving an individual who is in the United States a prior authorization to enter the United States after a trip temporary abroad. The US Citizenship and Immigration Service UU (USCIS) has the authority to grant early probation and issue a Form I-512L, an early parole authorization document. Form I-512L allows a Department of Customs and Border Protection (CBP) or another immigration inspector at a US port of entry to grant parole to an individual in the United States. Early parole does not guarantee later parole in the United States. The immigration officer conducting the inspection may, at his discretion, deny parole at the port of entry. In a series of AAO decisions cited by Matter of Arrabally and Yerrabelly subsequently, applicants who entered without inspection and subsequently obtained Temporary Protected Status (TPS), were allowed to use the anticipated conditional release obtained in accordance with section 212 (d) (5) (A) to temporarily leave EE. UU., Re-enter EE. UU and look for pending requests for the state adjustment. It was considered that they had NOT made an "exit" from the United States for the purposes of section 212 (a) (9) (B) (i) (II) of the Act. In other words, the illegal presence bars of 3 and 10 years were not activated. Accordingly, the applicants were not considered inadmissible under section 212 (a) (9) (B) (i) (I) and 212 (a) (9) (B) (i) (II) of the Act In addition, they were deemed to have been placed on probation in the United States, and are now eligible for the state adjustment under Section 245 (a) of the INA. In these cases, applicants were allowed to proceed with their applications for adjustment of status in the United States based on their marriage to a US citizen spouse. UU Equally important is that the I-601 extreme hardship exemption was considered unnecessary since the 3 and 10 year illegal presence bars were not activated. It should be noted that this "beneficial interpretation" using Matter of Arrabally and Yerrabelly would extend to any immediate relative of a US citizen requesting an adjustment of status (ie spouse, child under 21 years old or father of a US child or daughter). 21 years). In summary, this has been good news for those who received TPS since it was decided Matter of Arrabally and Yerrabelly. Hi Arthur, I am a UK citizen who is currently a permanent resident living and working in the USA (I married a USA citizen). I immigrated mid-2017 and don't have my physical green card yet as it is being mailed to me (I only have the 1 year I-551 temporary endorsement stamp). One point is that the original application was filed on a former USA address, so I told the border official at the airport of change in address. This sounds absurd but I arrived at USA borders late at night and the border official was a youngish guy and he was end of shift having a lark around with his colleagues. I firmly informed him to update my postal address for the green card but he was messing around and I don't have much confidence he actually updated It. Is there anything I can do to find out if a) address was indeed updated b) find out how much longer it will take?

I don't know if you would be able to help at all but my fiance and me are currently planning for him to come to the UK so we can get married, but I'm not too sure on what the first move would be for me to go to the US after marriage to live there? I have searched on google and it has mentioned about me getting CR1 Spouse visa, I understand it isn't going to be easy but I wondered if you had any knowledge on what it is I could do? The fastest route to go down maybe and what I can do to start the process and how long it will take? Many thanks for any information you could give me!

yes, some one can get here illegally thats why there is two types of waivers. 1601(those who entered legally) and i601-a (those who entered illegally)

ANSWER: YES! Unless there is an unusual circumstance -- like you are married, but your spouse is in (say, for example) a University in California and you have a job and need to work in Nebraska. Living apart for work / education reasons is ok. Living apart because you have fake marriage? No good. Fake marriage = fraud. If you get caught in a fake marriage, you go to jail.

My wife and I have been married for 8 years. We had a Green Card and lived in America for a year, I was offered a teaching job back in China and we went back. We stayed pass her 1 year out of country. It has been 3 years since we have been back to America. Do we need reapply for her Green Card again? If so we have no sponsor for her. My mother signed before but she passed away in 2013. What can we do? I am on disability now and my wife cares for me.

Michael Duncan Hi Michael -- if you did not (i) apply for a "re-entry permit" before you left the USA 3 years ago, and if you (ii) have not maintained a "residence" in the USA for three years, then yes, you need to re-apply all over again. Why? Because the green card requires you to permanently reside in the USA, and you can't do that while living in CHina for 3 years! Sorry Art

Axel Moredock if you already have a green card after 3 years obtaining it you can now file for a citizenship only if you are married to a US citizen.

Sterlove Etienne if you are still married to the guy and still together you can apply for a temporary residence after that probation you and the husband need to apply for an interview to obtain a green card.

That's normal. Sometimes they need to double check the file to make sure they have everything they need before they can approve -- the interviews go by too quickly sometimes

Hi Arthur. Thanks for the video. I am a Canadian who has just married an American spontaneously out of love (We are in the States). We are wondering if it is a good idea for me to apply for a non-working social security number or taxpayer number, before applying for the greencard so I can get things rolling, like opening a joint bank account and getting on my husbands health insurance? Or is it better to just continue paying for travellers insurance until my greencard is processed?

soEmmazing you can only obtain a social security card if your husband file for a petition to give you a temporary residency after you guys do that then you will be issued for an social security. If you had passed the condition then you may apply for a green card it takes two steps I know. You have to have a social security in order for your husband to add you in his benefits.

kashi king how long have you been married to this woman when she filed for divorce? Do you remember filing an application to petition her during your marriage? Did you receive a letter from immigration about your guys interview after filing an petition. If she divorce you before you two filed for a petition then she screwed herself up you should be happy because she can't get a green card if she end the marriage before all the proper petition done.

Nyxi if you are a us citizen you can petition her through k1( fiancé)visa when she arrive you must marry within 90 days of not then her visa is invalid. You can marry her in Mexico If you prefer and file a petition for her it'll take 6-9 months for her to arrive in 🇺🇸. Have you met in person at least one time?

Yes -- as a Canadian citizen, you have MANY ways to get immigration status in the USA: (1) THROUGH WORK -- your businesses can support an E-2 work visa or an L-1A work visa, and these (in the long term) can support a green card (2) THROUGH FAMILY -- if your wife of 3 years is an American Citizen, you can get a USA Green Card in 5 months. 5 MONTHS!!!
