Ashleigh Merchant is the current president of the Georgia Association Criminal Defense Lawyers and the attorney who wrote the recusal motion against Fulton County District Attorney Fani Willis in the racketeering conspiracy case against Donald Trump and associates.
She appeared in the YSL trial on Monday (June 10) for Young Thug's lawyer Brian Steel after Judge Glanville held him in contempt of court for refusing to say who told him about a private meeting the judge had with prosecutors and witness Kenneth "Woody" Copeland. She told Glanville she and Susor are representing Steel as a “strike force” from the defense association.

I am a semi-retired 71 year old attorney of 45 years experience. I read the cases mentioned by Ms. Merchant and she is spot on correct. Also, I note the fact that old law is still good law until overturned. The judge is out of line in complaining about the age of a 2000 case and asked if she has a more recent case! Once a court establishes a precedent, it likely not necessary or reasonable to expect to find a later case. There are US cases 250 years old that are still good law! The judge CANNOT require an attorney to violate the law (breach the attorney client privilege) any more than it can require him to give up his note, or work product. Since the judge has declared this to be criminal contempt, Mr. Steele has the right to an attorney, a hearing, to call witnesses, and among other rights, to have an independent trier of fact. In fact, this horrible judge would be a necessary witness! The judge does not understand the difference between civil and criminal contempt, and when it ws explained, the judge refused to accept the wisdom of the Georgia Court of Appeals. The contempt, if any, did not take take place in the presence of the Court. A summary criminal contempt would be something that, for example, would disrupt the court proceedings -such an outburst or some obscene gesture. Here the Court, as stated by Ms. Marchant, is using the inapplicable Civil Contempt standard to try to coerce an improper response from Mr. Steele in violation of his duties to his client. This is an attempt at EXTORTION by the judge -can you say BLACKMAIL? Under the more applicable (but still improper) Criminal Contempt standard, the action that the judge complains of does not interrupt the proceedings and is subject to all due process rights available to a criminal defendant. In 45 years of trial and civil practice, I have appeared before biased, incompetent, and vindictive judges, but this sorry excuse for jurist is the most disgraceful excuse for a judge that I have witnessed. This man must be removed from the bench. He lacks judicial temperament, and obviously thinks that the law is something that he can ignore as inapplicable to him. Although I live in the South, I will under no circumstances go to Atlanta or Fulton County for ANY reason. The Courts are corrupt, the District Attorney is an immoral adulteress and a thief, and clean drinking water and a shower are not guaranteed. FACTS.

Excellent analysis, counselor. Manhattan has become just as bad. You have to engage in unethical behavior just to be considered for a judgeship. Has nothing to do with republican/democrat. Manhattan judges have always been 100% democrat. But they were hardcore jurists who ran tight courtrooms and took no nonsense. Now you have to pay huge money to the local democratic club to even be considered.

The judge has concerns about the security and privacy of his courtroom. The Attorney gained knowledge by illicit means. The judge has a right to know how that information was received to protect the integrity of his courtroom.

That's what bothers me most here. If the meeting were legitimamte, then his request might be reasonable. But if the meeting were a crime, he is demanding information on a whistleblower who acted (potentially) in good conscience. In the latter case, his order seems illegal and Steele's contempt doesn't exist, since (well, at least in Michigan) the order of the court needs to be a legal one for contempt to exist. Can't order a person to kill someone, for example.

I was a judge and the lawyer is absolutely right. Many judges do not know the difference between criminal contempt and summary contempt. This judge demonstrates his incompetence and lack of knowledge. The lawyer has the law on her side.

So, the “Costs” of further proceedings, assuming the Contempt is eventually accurately defined by the Judge who doesn’t seem to understand the difference, & eventually overturned & dismissed, should be awarded against the Judge as he deliberately brought it on through his lack of understanding (or bias) of the law itself…?

Well, you're not listening. He actually did admit he was wrong! He changed his position from criminal contempt to civil contempt, and then he sentenced him to 20 days! So, Steele's lawyers were able to win that argument!

@Lionsandtruth in this case it actually looks like he doesn't actually know the law, it's bizarre. He seems to think he can just do anything. Watching the whole debacle was eye opening. There's lawyers on YT that actually went over all the case law in detail through the proceeding, looked up all the cases cited, etc, and the judge isn't just mistaken, or has a different opinion, he's just flat out wrong about whole chunks of the case law. Everything's getting tossed eventually, Steele was actually smiling at the end. He knows how badly the judge messed up. And Judge actually doubled down on his bad and purely unconstitutional rulings he was so mad that he couldn't do what he wanted.

It's clear that he thinks his personal judicial authority puts him above any law. Whenever an attorney cites law that demonstrates his error, he punts to "let the appeals court correct me." What kind of justice is that? The accused has to wait around for a higher court to set things straight, after much time and expense, when the judge has the law in front of him now to correct his course? It's all ego with this guy.

Most Georgians don't consider Fulton County to be part of the state. Fulton County and the metro Atlanta area only have 53% native Georgians. Corruption seems to be everywhere but many Georgians are disgusted politically by Atlanta. It's like this in most states in the U. S., big cities are run by democrats and the rest of the state is conservative... you can see where the most egregious corruption is.

It turned into an hour and when he came back he sentenced Steel to 20 days in jail (10 weekends from friday 7pm till sunday 7pm) and Steel asked to be locked up close to Thug so they could prepare for court. I believe we haven't heard the last of this matter, Merchant sure isn't done yet. Wonder what day 89 is going to be like...

The judge had an illegal meeting. The judge can't talk to the witness without counsel....and he did. To cover his tracks, he made a big deal about the lawyer finding out ans tried to blame him. Ashleigh was able to explain the law that the judge was abusing and the Supreme Court stepped in and sided with her and put a stay on the lawyer having to go to jail. The other thing she did was expose illegal activity with Fani Willis office. She is by the book, I applaud her efforts.

@@user-rr4so1st5d Nobody has proven there even was a meeting, let alone that it was illegal. Steel's contempt however is an established fact - he refused to answer the judge when required to. Merchant's nonsense about a contempt finding requiring a hearing is complete nonsense.

He never had control of this courtroom. Just about every ruling he's made has been without legal basis and completely improper. He has already decided the outcome he wants and he's just doing whatever he needs to do in order to engineer that outcome, including breaking the law himself and then trying to hold somebody in contempt for exposing it.

He was going to take the 5th or do 2 years in jail until the secret meeting when the judge and the DAs told him they would keep him in jail until the last defendant was tried. In other words, the Judge was part of the prosecution!

I think the judge knew he was wrong but refused to admit it. He fell into continuity bias. That’s sad for the chief judge. He doesn’t get to make errors then say well the appeals court can handle it after verdict. Wrong! Ashley Merchant is a BOSS!

She wasn't part of his firm. She's Ashleigh Merchant, the head of the state Association of Criminal Defense Lawyers. She rushed away from whatever she was doing to defend Steele and point out to this judge and the DA that they were fundamentally wrong and would be held accountable for it. This is huge.
