For the past five years, drug and alcohol attorney Mark Astor has focused his practice on getting people into treatment for substance abuse and mental illness through a variety of means including, sometimes, utilizing the Baker Act.

The baker act is very much abused in Florida, it's used to assert power not to actually help people.

Agreed! They hold you against your will, and abuse you (over 24 hrs without food or water), FORCE medical procedures on you, yell at you, and even on occasion are beaten up by cops. You have no way to contact loved ones, and worst of all, ANYONE can get you Baker Acted, even if it's just because you are "sad".... It's scary stuff. I'm amazed this is allowed in the USA...sometimes they even hold you over the minimum of 72 hrs.

Don't take your loved one to the hospital for a Baker act unless you hate them and want them to be put in a facility like jail for several days and be very upset at you for subjecting them to the humiliating deplorable treatment.

Truth. They come out worse (more traumatized) than before they went in! THEN, you get a hefty BILL. If you truly care about your Loved one, AVOID Baker Act at all costs! There are other ways if it TRULY is an "emergency". What's worse is that many folks with MEDICAL issues are confused with mental health issues, and guess what? If you go in under Baker Act, the UNDERLINING MEDICAL ISSUE is not addressed!!!!!!!

In some situations it’s necessary. I’d rather put someone there then let them lives take there own lives. This should only be used in an emergency and it’s absurd and these facility’s are rarely helpful tbh.

I would never, because I was put in Lakeview , my records missing, it's like I was never there. Because they grabbed me, and I was held there a week and my medication from my doctor was withheld and i was given meds for a disease I don't have. This medication resulted in horrible nightmares and night terrors . I'm going to write a book about this.

The baker act needs to be repealed. No one should be force to go. Also no one should be billed for a forced stay. The hospitals and just running a scam to make more money by holding people too long

I've worked as a mental health technician for a few years in Jacksonville and I'm traumatized, just imagine how the patients are...there needs to be a huge change in mental health "help".

@@nathanm2664 if you’re familiar with the area, the one that’s about equidistant from the the crossings at Santa Fe apartments and the Publix that’s across the street from SF College. It’s the one where it kinda looks like you’re driving into a forest. I think it’s still technically a part of Shands?

It's about getting your insurance money, not to help people. If you don't have insurance they release you rite away. If you have Medicare your there for 2 to 3 weeks.

The cops just believe what my mom says. The 2nd time she just said that I wasn't taking my meds and behaving crazy and they just took me. I have lost custody of my son.

ERs and facilities in Florida make huge profits so are not motivated to make honest evaluations: at least $2.1 billion annually. USF made a report on numbers of detainments across a 12 month period. About 37,000 children, some as young as 5 yrs, are Baker Acted annually; only recently parents by law must be notified. What a traumatic thing to do to a child.

It's ridiculous when you don't do anything crazy or suicidal, and don't know about the baker act, and a cop asks you "did you say you were going to kill yourself" and you're like "yea, so" then click, click, off to the facility for 24 hours, forced to give blood for testing then hit with a $4000 bill a week later.

Yeah not to mention my hospital bill was literally $1,000 for ONE DAY and this was AFTER insurance!! I live in Ohio where things are pretty cheap, I couldn’t imagine the costs in more expensive states.

My ex boyfriend (who was a detective, now fired) had me baker acted. We weren’t together in the same city even. He lied and told police I was suicidal after a phone argument the night before, then the next morning I wake up in my apartment to 6 police officers around my bed unexpectedly, me not even dressed, asking to go through my phone, forcing me in cuffs and off to a mental health facility with no questions on my end. I was told by Melbourne Florida police to sign myself in voluntarily or I would be required to stay longer, so I did. THEN I was told at the hospital that If I didn’t wave the 72 hr hold, Id have to be held longer and go in front of a judge, suggesting I could potentially be waiting for weeks or months…. They ended up making me stay for two weeks. Everyone else I talked to in there was also told to wave the 72hr hold and it seemed a two week stay was the norm. The ease of which that nightmare happened had me to terrified to stay in florida and I moved away. That law is MUCH to easily abused. I wish some reporting would be done on specifically being pushed into waving the 72hr hold. I suspect the real reason is money… [the place I was sent to was Circles of Care, Melbourne Florida]. TLDR: 1-Baker acted by an out of town boyfriend, no questions asked. 2- Police let into my locked apartment by groundskeeper. Awake surround by all male cops while Im sleeping, didn’t knock to wake me. Wasn’t dressed, asked to go through my phone and looked through my stuff. Handcuffed and put in squad car. 3- Pushed by cops to sign into hospital voluntarily 4-Pushed by circles of care staff to wave “voluntary” 72hr hold 5- Held involuntarily for 2 weeks solely from a phone call by an ex boyfriend saying I was suicidal whose “credibility” came from being an out of state detective. -- The story on that detective ex boyfriend of mine is a whole nother nightmare. Full of harassment, intimidation, trying to get me to commit suici* for real, multiple number changes, hacked devices, comprising photos, moving states and no clear way to prove it was him… I wash my hands of it all. Im just glad he’s no longer working with a PD as far as I know. Complete psychopath.

Just an fyi, state states "UP TO 72hrs". Meaning if a psych cleared you after 6 hrs, you should be sent home.

I have been baker acted twice in Florida in 2 different facilities in a months time... I was so horribly abused in the first hospital I'm a tiny petite female who is a lesbian and was being targeted by staff more then 3 staff members at a time. The second facility was if not just as bad possibly worse. I had 2 seizures and other patients were trying to get staff to help me they instead laughed at me and said I was lying, I could have died, and now suffer health problems from hiting my head during a seizure. Never Ever take anyone you love here!!! It's completely traumatized me in ways I honestly can't even say. I have such bad PTSD from it!!!

If a kid misbehaves or the parent wants them out of the house the parent can literally involuntarily bakeract them and lie to the police

My 8-year-old son was admitted yesterday, 2/14/24, to a behavioral center because the police applied this law to him. They say that he tried to poke the teacher with the pencil, that the boy screamed that he hated his life and the he hated everyone, it was easier for the school to call the police THAN placing him with the school counselor, the school called me after the police took him away, for many schools it is easier to apply this Baker law than to spend resources to help to children with special needs, my son has an IEP, he is diagnosed by a psychologist, psychiatrist and neurologist but that does not matter to them in the meetings the first question is what medication are you giving to the student and that the nurse can give it to them at school too, the department of education should do more audits and children's mental health organizations should be more active in protecting children's rights God knows what I have sought help and I have cooperated externally to help my son why the department of education Education just puts them in a small unit and that solves it. If any lawyer reads this please help me

Florida police in brevard county abused the baker act on me. I was walking my dog when i was surrounded by police. This, they said, was because of a comment i made to my sister on the phone while in jail. Im a Christian, and all i said was that sometimes life is so tough i wish i was with Jesus. Not sucide, Christians dont believe in taking ones life. Heres the kicker, i made the statement 8 days before they baker acted me. Obviously i was not in a mental crisis, i was back working, taking care of my family, and when they came, i was out walking my dog. Its crazy what they get away with. I moved away from Florida as i dont trust the judicial system at all!!!

I got "Bakered" last week, was out in an hour. It was a false-flag attempt to circumvent probable cause and failed because i caught the failure to articulate Heller. I was then subjected to kidnapping and theft of my property. The motel owner was actually very surprised to see that I had returned and was able to claim my things before he could loot them and toss them in the dumpster. I think Homestead expected I'd be gone for 72. I survived. I escaped. I'm safely somewhere else. Who wanna hear the audio?

They took me from my home , kept me a week, I was drugged with horrible mind altering drugs and given no water , I was too drugged to get up and get any water , my kidneys shut down for three days, my urine looked like an old persons brown . I thought my husband was dead because they didn’t tell him , no record of this at the court house . I had a doctor who wasn’t notified. I still suffer ptsd from this nightmare lakeview is a horrible place to be

This has literally been going on for decades in every state. Half the Baker Acts are completely unnecessary. Nothing new or Covid related.

Central Florida Behavioral Hospital, The Vines of Ocala, and Palm Point (all UHS facilities) are notorious for initiating a baker act. Some of the staff who had the authority to do this where also a little drunk on their power, but this just keeps happening. Great job guys, keep ruining lives under the guise of “saving lives”. We all know you’d still bill their insurance
