The fact that the public has to remain calm while police officers violate our rights is truly terrifying. When our rights are being violated we should be mad as hell and fight like hell - and those we charge with defending those rights should instantly be held accountable for violating them. It's insane that anybody would think it's on the public to calm down bad policing!

@dWFnZWVr3 ай бұрын
@@neilgodfrey6578 Unless it’s aggravated (which this isn’t), trespass is a civil matter, which means the police have no power to remove you or interfere. They can observe and they can ask you to leave, but they cannot force you. Case law has repeatedly stipulated that aggravated trespass cannot be applied to those merely engaging in photography or filming. Aggravated trespass requires intentional obstruction of lawful activities or commission of crime. For example, a burglar commits aggravated trespass as they enter private property to commit burglary. Similarly, case law has covered the use of section 43 of the terrorism act (which police often try and use) for those filming; it’s been ruled that such filming must be covert not overt. Thus, many civil claims have been successfully made by auditors against the police for unlawful arrest under this legislation.

Excellent audit Yorkshire. Acting as a representative for the landowner, but paid for by the taxpayers this is private property. He may be right or not, but the easiest way to keep the public out of sensitive areas is with clearly marked signs and some kind of barrier. No need to look like Colditz castle. I think once you are asked to leave regardless of implied right of access you must comply. Otherwise you risk being trespassed. You can research and challenge the decision/action another time. Sign next to pavement says Badge Holders Only. So there is no implied right of access: there's a very clear denial of access. End of. The sergeant only told you what the others told you - it's private. Once you know that (even if you missed the sign on the gate and barrier), it is clear you have no right of access. Our taxes pay for lots of things but we don't have a right (implied or otherwise) to access them: forces bases, prisons, schools, Houses of Parliament, government offices. I pay for electricity but I have no right to enter a power station or the company's offices. Even if I own a property, when I lease it to tenants, I have to give notice to access it because it's private to them. Private means private, regardless of who pays for it or who it belongs to.
