To explain further... the cop you showed in your thumbnail wasn't ever on scene... he actually flat out told the other they violated the mans rights... he wrote up the officers... how was the cop shown a bad cop?? How did he squirm under questioning? What's the EXACT timestamp that he was squirming? Why do you utilize the fair use laws but can't grasp how anyone else would? Yes, there's nothing ever done when they call an emergency number for a non emergency/non crime. A lot of times, the callers trump up the situation to elicit a response, again, nothing is done. Once, I saw them call and report that they had a gun, I don't recall which auditor it was, but the caller did get arrested. This is a very rare occasion, probably went that way over the seriousness of the situation. They usually claim they are trespassing, when they haven't even been on their property. If the calls were properly reported, and the dispatch was properly trained, they would end at the call.

I wish the auditors, when confronted by someone from a business who says ‘I’m going to call the cops!’ would respond with something like ‘You are of course welcome to do so. However, you should keep in mind, that (1) that call will be recorded, and (2) if you make any FALSE accusations about me or my conduct (which, BTW would be easily disproven, as I have recorded my entire time here)... those could not only form the basis for serious criminal charges against YOU, but a costly civil judgement against both you personally AND the business. So, proceed as you see fit, but I urge you to think VERY CAREFULLY about what PRECISELY you wish to accuse me of.’ ______ ... would you like my civil lawyer‘s business card? Their eyes positively ‘light up’ at the prospect of a fully documented - and lucrative! - case of... ... are you ‘fully insured’ in regards to civil exposure of this nature? YES and to add the little female waitress that was so called scared of this guy, when she herself is so dumb to not know basic LAWS on sidewalk ROW. This bar needs to be exposed and Auditors need to hold signs in silence in front of the sidewalk, that the city allows for the bar to put tables on, and the Bar then thinks they OWN the sidewalk. I just can't believe how stupid business is especially about using the public sidewalk blocking the ROW with their picnic table

Exactly! Qualified Immunity needs to be either abolished or greatly rewritten with speicific guidelines around when it can be used. And "I believe it was true" statements from cops is not an acdeptable excuse for qualified immunity. That's just ignorance.

Jeff does not sue for big numbers. A lawsuit in a case like this would have a maximum settlement at about $20k. Jeff often includes a training requirement for police in his settlements.

10 years ago I got booked in Clayton county GA for driving on a suspended license. While getting searched the officer(K. Thomas) grabbed me and told me to start listening to him, I was doing everything he was telling me to do. Then all of a sudden he grabbed me by the throat and tackled me to the ground against a cinder block wall while holding on to my throat, was smashing my head against the wall. The whole time he’s screaming to answer him by he’s choking me and I can’t speak. He gets up abruptly and I stand up, there are now like 6-7 other cops gathered around with their hands on their weapons. I am shaking typing this. I still think about it often and wish I would have reported it, it all happened right under a camera. I don’t know why I didn’t, I did nothing wrong.

So where I am, having a permit and carrying doesn't mean you automatically have to show it. The law specifically states, "...a permit holder must inform a law enforcement officer of the fact that he is a permit holder and present the permit card when an officer: (1) identifies himself as a law enforcement officer; AND (2) requests identification or driver's license from a permit holder." That means that unless they are legally allowed to ask for ID, (i.e. RAS and all that), they can't just ask for the permit and you don't have to tell them. I've been stopped several times for valid reasons and they've NEVER asked to see my permit. EVER.

The police officers were wrong in what they did, they should be held accountable, so if there is a lawsuit, those officers should be the ones to pay for it, not the taxpayers.

Law Enforcement Public Employees (LEPEs) have come to realize that if they can make the reasonable case that they were 'acting in good faith', that will preserve their qualified immunity. Towards this end, they have learned to make up and self-promulgate laws they espouse to be acting upon, as some expressive or declaratory proof that they believed them; or to yell out loud, STOP RESISTING when they are cuffing someone so they can at some point add resisting arrest or assault charges; or to declare that the person is causing a public disturbance (when the citizen is not or when the only 'disturbance' is caused simply by the police response) just so they could say in a future interview or testimony that they were acting in good faith. This diabolical practice is perpetuated by the bad supreme court doctrine of qualified immunity. This is a basic and growing element of LEPE corruption. That is why video evidence is critical. In the United States, qualified immunity is not a law, but rather is a legal principle of federal constitutional law (fabricated by SCOTUS rulings) that grants government officials performing discretionary (optional) functions immunity from lawsuits for damages unless the plaintiff shows that the official violated "clearly established statutory or constitutional rights of which a reasonable person would have known". It is a form of sovereign immunity less strict than absolute immunity that is purported to protect officials who "make reasonable but mistaken judgments about open legal questions", extending to "all [officials] but the plainly incompetent or those who knowingly violate the law". [See Pierson v. Ray, 386 U.S. 547 (1967); Harlow v. Fitzgerald, 457 U.S. 800, 818 (1982); Malley v. Briggs, 475 U.S. 335, 341 (1986); and Ashcroft v. al-Kidd, 563 U.S. 731, 743 (2011)]. If you really want to stop police violence and tyranny, legislate universal body cams 24/7, legislate limitations to or an end of 'qualified immunity', require bonds for misdemeanor charges, reform Law Enforcement Public Employees (LEPEs) training (to include deescalation training, case law on constitutional rights and protected activities), require every LEPE to verbally identify themselves and spell their names immediately upon request; require all LEPEs to provide issued business cards with officer's name, position, badge number and email along with the employing agency, address and phone number; and require every LEPE to verbally identify their direct supervisor's name and spell that name immediately upon request, prosecute LEPE misconduct, revoke certification, create a publicly accessible LEPE complaint and discipline database and require every agency to review before hiring and stop sole internal investigations (all complaints and LEPE involved incidents to be reviewed by elected civilian review board with subpoena powers), and make it legal that anyone can video inside ANY courtroom under our Freedom of the Press.

The improper application of QI is the underlying problem, which could mean not understanding it's use, or just plain corruption. QI should only be used as a defense again civil suits except when it applies to violations of the written or case law and the Constitution. It should NEVER, EVER be applied to criminal violations. If the LEO in question breaks the law and is criminally charged, QI should never even be thought of being applied. If the LEO violates the Constitutional rights of a citizen, knowingly or not, QI should never be applied. This is 2024. Everyone has a computer in their pocket or in their car so there is NO reason that a LEO can't look up the law and or the Constitution, or boundry markers for a sidewalk or property. It's available to everyone. So in the case of this video, they should have known that panhandling wasn't a crime, standing on the sidewalk wasn't a crime and the business doesn't own the sidewalk next to the road. Therefore, NO QI. So when should QI be implemented?? Let me give you an example: LEO are responding to a robbery and the suspect description is white male, brown hair, brown eyes, shorts and a hoodie, last seen running down anystreet USA. I'm out jogging on anystreet, white male, brown hair, brown eyes, shorts and a hoodie. They detain me, cuff me, search me and give me the ride. While at the station they bring in another brown haired brown eyed, shorts and hoodie wearing white male. They get additional info that the white male is 5'4" tall. I'm 6'4" tall. So they release me. Should I be able to sue them for false arrest or should QI apply in this case since they really were acting in good faith of the law?

Hi from the UK - I have seen this video several times and each time it winds me up when the Sarge says that the two officers BELIEVED that what Jeff was doing WAS a crime. If it were a citizen who said they didn't know something was a crime but they did it in good faith the Courts would tell them that 'ignorance of the law' is no excuse for breaking the law and find them guilty anyway. But it seems it is ok if you are a police officer - bonkers innit?

Oh, but they are law enforcement. The aren't the lawyer. That's the argument Supreme Court makes. Imagine, for a citizen, there is no excuse for the ignorance of law, but if you're a "law enforcement", you can be assumed to not know all the law and can make unlawful/illegal mistakes.

This is very typical of police catering to the whims of a business. Protecting property and business owners takes priority over individuals' civil rights. These police officers take an oath to defend the Constitution, which enshrines individuals' civil rights, but will invariably break their oath in sacred covenant to business and property owners.
