Will, Thanks for the video. My horror story with UPS: I shipped a framed piece of artwork with UPS, insured it for $300, UPS broke the glass in the frame then discarded the artwork instead of delivering or returning it, and on top of all that they refused to honor my insurance claim. In other words, they stole my artwork. I contacted the Fraud Division of the State's Attorneys Office in my state. They intervened on my behalf and I received a full refund for my artwork.

Great video Will! Your persistence finally paid off. I think these big shipping companies assume no one is going to take the time and trouble you did, so they push the insurance on customers, knowing full well that if anything does get busted, there's enough red tape in place that they'll never have to pay out on a claim. You confirmed my suspicion about adding insurance being nothing more than a scam. I've shipped close to 100 unbuilt model kits, through the US Postal Service. Luckily none got damaged.

Well done! Very well done! This reminds me of Allstate Insurance. One thinks they have an insurance policy but it's designed to be worthless to the insured and filled with jargon and exclusions, etc to not pay damages. (We lost a home down to the foundation for a wether related loss. They paid a fraction of the loss for us and other homeowners) UPS didn't expect you to stay the course and force them to honor the insurance. Imagine how much money they collect a year on "insurance"! Thank you for raising awareness so people can make an informed choice if they are purchasing "insurance" on their shipments. So proud of you! (Your work is incredible! It must have made your heart sink to see the damage after so many hours of meticulous work)

Will, I truly admire your persistency...wow! I manage a small business (Metrics Construction - Fence Post Extenders). UPS have lost few of our packages. One the them back in May/2020. It is now Feb/2021 and we have not received any payment. This kind of situation shouldn’t be tolerated in America. The big corporations are allowed so much power even when comes to court issues. This is ridiculous and so stressful. If UPS lose/damage a package, they should be the one coming after the shipper to compensate for the loss; yet, we are the one fighting for it. @@paulvigil1191 I’m not using either of them now. Someone I know had Fedex destroy something truly irreplaceable, and I just had UPS trash a laserdisc player I sent to an expert for repair. He fixed it and it was promptly trashed on the way back.

Yes how do I press charges on ups for hijacking my package lying multiple times that my package was delivered to the access point but they say they never got it changing the proof of delivery twice ..what good is the proof of delivery if they change it fit whatever fits their lies there malicious and think their to big to fail make you wait for packages like that's all you gotta do . Anyone recommend a good lawyer casue the punitive damages are priceless at this point . If I did my job. Like they do theirs I'd be homeless f ?? Ups I hope their bought and sold by FedEx casue at least I can pick my package up that needs to be signed for there a bunch of lies and born from there father the d?? L get a life

I had a similar situation but with an A/C unit and had an insurance policy for around $900. They claimed I did not appropriately pack it, so I immediately got into contact with my states attorney general and after they sent out a letter to UPS, I received my check, rightfully so, in the mail the next week. They intentionally deny claims and screw over customers. That free insurance money goes straight to their bottom line.

Thank you so much for your time put in this helpful video to a regular consumer like us. UPS KEEPS SCREWING MILLIONS OF PEOPLE FOR SO MANY REASON AS WEATHER DELAYS BUT HAVE COLLECTED FOR A ONE DAY EXPRESS DELIVERY. My frustration with all of this is there is not a lot we can do to sue them or for them to provide documentation to us for weather delay packages.

It seems to be their business model (pun intended). If you're feeling particularly nasty, get in contact with other people that have the same issue. Reddit is a good spot to start. Collect your statements and go at them. The issue is that this will involve lawyers and get expensive. Apple is currently working through a similar event involving "Right to Repair".

My two nephews worked for UPS at their Portland distribution warehouse and both said the same thing. The abuse packages take is intentional as the people unloading and loading the transports just toss stuff out. If it is marked fragile, they'll give it special abusive attentions. They both said that no one takes any care in the handling of packages. In fact, they take delight in damaging them. Both of my nephews could not tolerate this sort environment so they each found new jobs. UPS is fully aware of how their employee's handle the items you and I ship, but elect to do nothing about it because; productivity. The faster they can turn around the more money they make. That means no care is taken, just toss it, kick it, drop it, throw it, etc. I am surprise they haven't faced a class action by now.

Yep. Been there myself. It’s indeed a stressful process for the regular person. At the same time, it’s an interesting learning experience. Glad you prevailed! (I did too, including suing a property owner for $4,000 for non-payment of general contracting work. 🎉)

Congrats on getting the compensation, and for sharing. I admire your persistance- we need more people like you in this world. So the only way to get absolute value for the insurance would be to use the agents own shipping materials and/or perhaps getting the agent to actually approve the packaging itself prior to signing for the insurance - (of course, they probably don’t provide a mechanism to secure their approval). So in most cases - the insurance is absolutely useless. Interestingly - there have been a number of high profile recent government investigations In Australia that effectively concluded that some financial corporations were taking monies from customers for insurance as part of investment packages, knowing full well, that the customers were never going to be able to make a claim against that insurance (or words to that effect) - those Banks were ordered by royal commission, to refund the monies - sometimes the ‘little guys’ do win.

Thank you for the video and all the info. I just had the same experience with ups they destroy a 1 1/2 transmission case housing made out of aluminum and claim it was box incorrectly in a exact box like the one you package your air plane.

Hey Will, I had a similar problem with USPS after insuring a package which was damaged in transit and missing half the contents. I didn't have to go thru as much as you did but it still pissed me off, although a official US guvment check eventually showed up for the insured amount. You live in New Mexico? I live in a tiny town east of Albuquerque, called Edgewood. Nice little town with almost no crime or other city problems, and I live close enough to Albuquerque to get things I can't find here.

I was informed yesterday that, (thanks to UPS) my new Gibson Les Paul is missing. they like to refer to lost (stolen) packages as such: Due to "Operating Conditions" your package is delayed. The friendly UPS rep informed me that it disappeared somewhere between California and Illinois.

This is a very interesting video. When I have to ship something like this that is irregularly shaped and fragile I run computer paper through a document shredder and pack the item in that and it seems to work really well.

Interesting scenario. I collected on claim through the USPS on a damaged model without problem. Submitted paperwork and pictures and check received about a week or so later. My only comment on your packaging is that it appeared any jostling/vibration/jolt went directly into/through the model as the foam was attached to the box. There was no where for that energy to dissipate or be absorbed. Glad you won and you learned to no longer ship UPS.

Hi Will, thanks for this video. I shipped a computer with a steel frame last weekend with UPS and they destroyed it. I called the case's manufacturer and the support agent said that the easiest way to achieve comparable damage was with a hydraulic press. I fully expect that they will force me to take them to small claims court

Very interesting story. I would contact your local Attorney General an ask about the sheriff taking 2 % of your judgement. That doesn't sound right to me. And I'm sure you would want to know if that was legit, whether you pay it or not. And you're right, it was cheaper to wait you out instead of paying a lawyer hundreds of dollars an hour every time you had a court date. In the end UPS saved money. Good video!

So, now we package everything important (even a big plastic box) inside a cardboard box that meets the specs. Should “win/skip” one part of the whole process. Still there would be probably others that would be revealed and special instructions as “no boxes in boxes”. Still this is a really good video. A friend of mine was in similar situation when he shipped a handmade fly fishing rod. He also took insurance, but missed the point of weight. So the tube he shipped it in (cardboard) ended up having forklift tracks on it... okay insurance..by weight...aka “20 buckish by every kilogram”...fly fishing rods don’t weight much....

I make custom clocks and have a Fed-Ex account. The dropoff stores have as much as a 40% markup or more so I quit using the UPS Store and stores like it. I still drop off packages there except I already have them labeled and ready to ship.

Ups lost four of my packages at an access point and gave them away to someone else who signed for them. I still haven’t had any compensation nor have I received my package and it has been exactly one month.

UPS damaged a couch that I shipped through them a couple of years ago and it cost me about $1400 , because I had to reimburse the customer . I had insurance through UPS , filed the claim , but they will not reimburse me . I even went through the BBB recently , and UPS reached out to me via email , but they continue to give me the runaround . I say we set up a class action lawsuit on there asses , if this is even possible , because this is not right .

Section 8! PERFECT! Congrats on your tenacity & enjoy the money. I use USPS and it does depend on which Post office I use. East Lyme, Ct. They admit their mistake and pay up{ 1 overnight package}. Groton, Ct., they deny everything, and have even stolen my paperwork, YES, THE FEMALE CLERK STOLE ALL OF MY PAPERWORK. {Copies not originals} I handed it over for her to review, she went in the back room came back out 10 mins. later and wanted to know how she could help me, then attempted to say she had never talked to me. BUT, Once I contacted D.C., everything was cleared up and USPS payed off, with apologies{ Clerk was removed from duties}. I've never use Groton, Ct. again. {1 overnight package, and 1 lost shipment of 5 models.}

One of their foot soldiers probably stole it or lost it. Just had to file my first claim with UPS and it came to my attention because my package was supposed to be here a week ago and its been sitting at the same facility for a week so im assuming one of their delivery people just stole it.

The real issue with UPS is shock. Boxes are often dropped from loading-deck height, and they can roll repeatedly on the conveyors. I've found the best method to prevent damage is to pack solidly to mitigate shock forces. The fact that your model was suspended from the foam probably led to the damage from inertia when the crate was dropped. Not that you're to blame - nobody expects their box to be thrown, dropped, and abused. The sorting process is automated, and the drivers just want to make their 100 stops a day. If you think your item could break if the box is dropped from waist height or kicked across the room, chances are UPS will break it. As a volume shipper, I'm better off preventing damage than trying futilely to collect on their useless insurance.

Would have to agree on the shock assessment. Most of the damaged guitars I have dealt with show evidence of that type of mistreatment - neck pocket cracks, dings on bodies where the shipping contained clearly impacted a hard surface, etc. I used crnge when an instrument was shipped through USPS - and actually favored UPS - but I've come to realize its exactly the opposite. Our UPS driver is wonderful, so it would seem the rough handling is happening elsewhere. But it's obviously happening.

Thanks for the video. I also had the idea of suing them in a small claims court in Atlanta GA where UPS corporate is located. I live in California so I would also sue them for travel and expenses getting to the court in Atlanta on top of the 1700.00 they owe me. I dont know if you ever thought of that angle or if that would work. Just a thought. Im thinking that would stop having to keep going back to court again and again. dunno?

My package is listed as “damaged”, however it was was noted at “all merchandise missing, empty carton was discarded”. So, being in UPS possession, my items were STOLEN by an employee!! I have not been able to speak to UPS directly, they have sent all correspondence to the UPS store. They use them to avoid dealing directly with the customer/victim. I will never use a 3rd party or UPS for shipping! I’m curious as to why there isn’t a class action lawsuit against UPS

Oh no... when you said it was some months ago, that you shipped the model... I kinda hoped it wasnt the B25... well, then you showed it was. Oh boy :D Good you won! Happily I only had one parcel that never arrived at the buyers with DHl. At least the guys said so - I suspect that he ripped me off years ago when I did not knew better about selling at ebay and so I gave the money and apparently the free model to the guy. Always used insured parcels since then and I am 100% happy :) sold and bought much and always shipped by DHL when possible. BTW Hermes is a pain in the arse. Avoid it when possible.

One other thing for everyone.... I found that if they dont respond when opening a damage complaint, to open a complaint with the BBB online. It takes 5 min . I did that once and they followed up within 2 days with me. Thats a national biz complaint site and UPS corporate doesnt want to get a bad record with them .

Thanks for this. I went through a dispute regarding non-delivery, excess charges and damaged goods in transit with UPS (UK) Ltd and got nowhere for 3 months. I opened up a Small Claims Court case and they settled within a week. My advice would be to keep a very accurate diary of events with dates so that you can present this in your case - its going to be a massive help when you file the claim. Dont be ground down, while the whole process is a massive waste of everyone's time, it is the principle that counts - if you know you are in the right, then dont let companies like this get away with it.

I am also looking into a small claims court case with UPS. I had bought a brand new Samsung 75 inch TV. The box was never opened. It was properly packaged from Samsung with padding, a proper box, and proper taping. I called Samsung and they said that they use UPS to ship their TVs. UPS claims they have a special "partnership" with Samsung, so if I use the packaging, it is insufficient, but if Samsung uses it, it is fine. I am not sure. There was a huge slit in the box and the TV was shattered. Anyone have any recommendations on that to do in this instance?

Insurance sales when you post the package are a great earner for the corporation. When things go south, the corporation's strategy is to make you the customer spend the money/time/resources. Can you imagine their costs if they defended each insurance claim ? Why would they bother ? Make the customer bear the costs while being ignored. Great that the tribunal was able to assist and they paid. I like your engineering evaluation/test/demonstration of your selected packaging. Simple and effective.

They factor in that only like 1% of people will take it as far as this guy did.I have to sue a car dealer and a lawyer said plaintiffs almost always win in these and most big corps factor that in for the very very low percent of folks that will fight them--the other 99% simply get worn out and give up.

So my claim process was an absolute nightmare with UPS. My claim was for a curved monitor I bought online and arrived damaged. I highly recommend you AVOID using the “pack and ship” service. Every or most UPS stores offer this, in my situation that only delayed the process furthermore. I paid close to $200 to have them pack the monitor since it was a complicated item to ship and it still arrived damaged (even though they packaged it). I was able to get compensated for it after about 35 days precisely. Here are all the pointers I can think about that may help your situation. - Do not use their pack n ship service. - Make sure the box you’re planning to use has a box certificate or they will use this against your claim if it doesn’t. - When insuring/declaring value of the item be sure you include the WHOLE cost of the item (that includes taxes, shipping, etc) and have an official invoice to back up that information. They will tell you to only declare the value of the item but they will not cover taxes nor shipping costs so be sure to declare the whole cost. - The reason I mentioned to avoid using their pack n ship service is because in the case the item arrives damaged (like my case) the one handling the process is the store manager and not yourself. So this means the store manager can take life (like in my claim) processing everything. So save yourself frustration and don’t try this method. - Take pictures exactly the moment the item arrives outside your front door or when opening the item. They don’t accept video files for whatever reason but pictures is good enough. I hope this info helps, don’t hesitate to reach out for any help!

I sell on ebay and just found this ups claim thing out the hard way, I buy my label through eBay so i was third party and they approved my claims immediately but they won't send me the checks and each agent tells me something completely different I gave up

great video, i have my judgement and am waiting to do my writ of execition to ups, i am staying with this until its finished. i am a nurse so i want to make ups pay for a box they lost. it could have been infant formula or medicine sent to someone in need. yes you are correct ups is about the bottom line profit rather than having any decent moral human standards. thank you K Allen bsn RN

I need to do this. Ups lost my package valued $1200. I keep filing a claim and the local ups store that I sent out the package from keeps telling headquarters that I closed the case. Which isn’t true. I keep calling back headquarters to reopen the case. Now I’m thinking of suing them for my package and emotional damages.

It happens because heavy boxes sometime comes down the conveyor to the designated chute and slams into the package. Now imagine alot of packages above your package on the chute pressing against it from gravity.

Thank you for sharing your experience with UPS. I am early on in my determination to hold UPS accountable for a package I had the UPS Store ship to my son. It contained over $2,000 worth of his electronics including a Nintendo Switch and Apple products. It shipped June 21 and shows it was delivered to the mail room June 23 where my son is staying. But it was never received there even though it was signed by an individual in the mailroom. When the delivery is signed for it is acknowledgement for receipt of all of the packages listed, however the individual package was never scanned at that location where my son was. Unfortunately, I only took out $800 worth of insurance. My claim has been denied because it shows it was delivered. No it was not. My son never got it which can be proved because the package never made it to the unit my son was in and they keep record of that. The owner of the UPS store said he can’t do anything because it shows it was delivered and he more or less accused the mailroom individual of taking it which is absolutely not true and the two mailroom workers will sign a letter stating it was never received. What can I do when UPS dismisses it as “delivered” and will not pay the claim? I thought having the store package the items was a good idea but one of them remarked “oh wow, a MacBook Pro” when he saw the items. Your video was helpful even though my circumstances are different. How can a company be allowed to continue with such greedy and dishonest practices?

My package was undeliverable and they abandoned it but on the contract it says if undeliverable , return package to sender. Now they're scrambling if they can still recover it.

Just getting into this video and the question might already be answered but what was the consignment actually worth? I am considering taking UPS to small claims court currently for a much smaller figure but it is the principle. No damaged item but a failure of performance. One very upset customer who has received an item he cancelled because it was late. Our UPS Account Manager sent a return to sender request via email to them the customer services people but they still delivered it and now they expect me to fund the return cost. I do not see why, irrespective of their Terms and Conditions, they should not be held to account for their inactions ie failure to collect on the correct day. The UPS Driver did turn up at our collection point, an industrial building with many businesses in, but left without taking our parcels because another company didn't have theirs ready and he just saw red and reacted angrily and stormed off. In their T's and C's, it expressly states that they will not be held accountable for their failures.

I sent a Leatherman tool in for warranty repair. I purchased $300 dollars of insurance for the tool and Leatherman proceeds to tell me (with pictures sent) that they received a package with no tool inside it. I filed the claim through UPS and they are giving me the run around rather than paying the claim. This happened back in december.

Sir you are a lot of help im in nm I sent a 3d printer and the ups driver dropped the package resulting in the product not working the receiver sent me a video of the driver dropping it with time stamp and date and the pictures required the info you gave is a lot of help thankyou I have insurance on the package in question

Hi I’m sorry for bugging but I was just wondering if you would know, I purchased a saw at Lowe’s they delivered it I refused it and the driver took the package back. Lowes never gave me the credit I filed a dispute and they said that they are unable to find a package therefore they are not giving me the credit the only thing I have is the video of the driver from my home surveillance system showing him taking the package back putting it over his arm and leaving. Do you think I have a chance in small claims court with only the video?

I think I’ve been had. I won the bid for $329.00 new iPad mini. The shipper generated the shipping label on 9/15/2021. Since then I checked tracking and gotten many different answers as far as was the item delivered to my PO Box? Many times on the way. Once or twice delivered On 10/1/2021 message states dropped off at loading dock. On 10/4/2021 on the way. On 10/05 /2021 will be delivered at 5Pm. On 10/05/2021 states delivered to customer at 8:08pm. Supposed to be delivered my PO Box. I have been home since 5:00Pm and have not received anything. I got a feeling the shipper Intercepted and redirected the delivery. How can I proof this if I have to to Amex? Please help senior nam vet. Thank you

I'm going through almost exactly the same thing right now, except they are only paying out $1000 for the $2500 speakers they smashed up because I "used a third party shipper.... THE UPS STORE!!!" That's some shady b-s if you ask me. In any case, I was wondering if during your exploration of UPS legality you came across anything about the UPS Store (as a franchise) reimbursing anything for damaged goods (or if you can even submit a claim with the individual store in hopes of reclaiming the money owed to you by UPS)? Thoughts?

Thanks! Someone stole the package I sent to my grandson for his birthday. They have a ring in various geographical areas. Employees of UPS are in on it and they know it. Been a year and that keep saying they sent my check but I have not received it. Gonna go to small claims court

Good to hear you got your right in the end. UPS is by far the worst shipping company ever. Very poor package handling, customer service is a nightmare. Avoid UPS at all costs.

When you put "Fragile" on a box, UPS (United Package Smashers) see red and will purposely throw it around. I worked at UPS a long time ago, i watched a group of loaders one time playing hopscotch on packages no joke.

I hate UPS and the way they treat their employees! I used to clean the floors at the UPS hub here in Columbus, and packages are thrown onto conveyor belts.

Thanks for sharing this information. I had 2 separate UPS mishaps recently. In one case, I had a 5K guitar shipped from Canada to the US, it arrived damaged. Since it was insured, I thought I'd make a claim. UPS said it'd take 8 days, so 4 months later, after 100s of phone calls and emails, I finally received a check for the full amount. Pretty certain if I had not persisted, it would still be unresolved. In another case, the shipper got the UPS Store to pack but they mixed up shipping labels and instead of receiving a 2K guitar, I received a $10 plastic container. In this case, fortunately the shipper reimbursed me, I don't know if he ever got his guitar back.

Did you check go through. After a year of battling I just received and check and it bounced. My bank charged me $20 free for the UPS bounced check.

@@shanec8812 , the bank put a hold on it for a week but it did go through, I was concerned however because UPS wrote a check to the UPS Store then the store manager wrote a personal check to me, seems very strange

@@shanec8812 in my case, the UPS Store did the packing, so they are considered to be the shipper, and seems the UPS default is to send the check to the shipper even tho I filed the claim and fully paid for guitar, good luck with your claim, hope it is resolved soon.

I have a feeling I'll be going through this in the coming weeks. I ship 1000s of packages worldwide each year for my husband's business. We have had numerous packages destroyed by UPS and their claims is process is ridiculous. Thankfully our website host now offers shipping insurance through an insurance company and we haven't had any issues with them denying a claim. Where I'm running into an issue is I mailed some irreplaceable motorcycle body work to a painter in CA and the box was damaged when it was returned to me. They are making me jump through hoops to get paid even though my claim has been approved. I purchased 18k worth of insurance as it's for a 1 of 200 bike that is no longer in production and the company is no longer in business. They are wanting proof of purchase of the specific item but how exactly am I supposed to show that if the bodywork comes on the bike and without the bodywork the bike's value is pretty much nothing. I could part it out but I own a dealership, not a mechanic shop! If they don't want to actually pay for the insurance they shouldn't let you purchase it. If they want to make sure the value of the item is the insurance value amount then they should make you provide proof at purchase of the label. UPS is a scam but unfortunately we don't have a lot of other options for shipping. I should mention the shipping label was $569!

The insurance is a joke also. I had a package that was damaged with insurance a month ago. Just received the check this week and it bounced. Not only that, my bank charged me $20 for the bounced check and UPS is giving me the run around on getting a new one. UPS is a total scam. Use the post office because they will actually help if you need it.
