The plaintiff says her former roommate was a nightmare to live with, and she’s suing him for unpaid utility bills. The defendant argues that he and his roommate had an agreement that guests couldn’t stay for four consecutive days, and she broke that rule. The defendant also claims he was overcharged for rent, so now he’s countersuing.

she doesnt have to if she is the lease holder. She makes the rules for everyone else just as the landlord makes the rules for you who renting the place or your boss tells you not to be late then he comes in late . I dont find this program to be more than entertainment since the judge seems to always be acting for the camera, it seems scripted, and if he was suppose to be awarded in his counter suit, he would have to had shown damages to justify what the judge warded . I am in small claims court enough to know that anything that is awarded has to show that you suffered some type of loss, and, tip toeing around her is an annoyance not a loss. Also, since you are the one agreeing with the term of her renting the room , she doesnt have to follow the rules that is being made since she is not the one agreeing to the term that are being signed. I have rented places that the owner says not guest and you can not park in our drive way but that didnt stop the owner from having his friends over and parking in his drive way. I have rented from subleasing that came with rules that the person leasing didnt adhere to but I couldnt complain because the rules governed my behavior as the renter and not the person renting the place so this judge is full of ish but again, these programs are scripted and this is not how a real court operates. Now, every court in the US first sends the parties to mediation to try resolving the issue and then at trial if there wasnt an settlement this is not how the proceeding would go . I guess this garbage is more like arbitration than an actual court but scripted so the judge can act like a E list celebrity on camera

​@bjvu9460 , Maybe you're in small claims court all the time because you don't know or understand the laws. I am a landlord, and as I'm sure 99.9% of smart landlords do, I have my tenants sign a lease. That lease pertains to all the tenants occupying the residence, and all parties are required to sign that lease. The lease is a legal, binding contract between all parties. Every lease I have ever written has specific clauses regarding overnight guests, and sub-leasing, which is exactly what the planttiff is doing. Overnight guests are not allowed for more than 4 nights total in one consecutive month and no one is allowed to sub-lease any part of the house or apartment. Unless her landlord has nothing in the lease barring her from having extended guests or sub-leasing, which I'm sure they do, she is in violation of her lease. Unless every person who she has a "contract" with was approved and authorized by the actual owner who is the only legal landlord, she has no authority to make rules for anyone. You cannot rent a house or apartment and tell the landlord that you are the only one that is going to be occupying it and therefore you pay rent based on one person living there. If the rent includes any type of utilities, (water, sewer, trash, heat, electric, etc) it is based on how many people will be using the utilities. One person is not going to use as much water or other utilities as 4 people would. Therefore the landlord would require to be notified in advance and want to approve any new tenants that may be occupying the unit. The planttiff has absolutely no rights to collect any money from anyone who is not a documented lease holder with the legal landlord and can be evicted immediately and sued by the landlord for the extra rent and utilities that they may have collected from her due to the illegal subleasing. Just because she holds a lease doesn't give her the right to act like a landlord for others she chooses to bring into the property. All the rent collected from tenants is due to the legal landlord, that is why we don't allow subleasing. She was charging her roommates $900.00 a month plus 1/4 of the utilities that she stated were gas and electric. That no doubt means that the landlord was paying the water, sewer, and trash every month, and she was probably collecting at least 2-3 times what her actual rent was, making her rent free. It's called a scam, and it's illegal... As for the rules, no, she can't just do whatever with them either. The landlord makes up rules for a reason. They want the tenants to be aware of the expectations that are required to be followed prior to deciding whether or not to rent the property. I have a list of rules that need to be followed by tenants and they are each given a copy of them along with the lease to go over prior to signing the lease and rules acceptance form or putting any money down to hold or rent the property. Every tenant has their own documents, and everyone states the exact same thing. They all sign each document so everyone has original ink signatures, no copies, ever. I make the rules based on not only the laws and ordinances in the location of the property, but also for the safety, responsibility, comfort, and peaceful living arrangements for every tenant and the neighbors who have just as much right to live peacefully in their homes as my tenants do in theirs. I believe that every tenant has the right to live in peace in a house that is well maintained, and that they are proud to have friends and family visit and be proud to call it their home. They may not own it but they are paying to live in it and therefore it is their home. I also expect the same from my tenants and because I make my lease/rules very clear, maintain my properties extremely well and charge a fair price for rent rather than a price that makes me rich and my tenants poor, and I don't keep security deposits for things that are unnecessary or considered normal wear and tear. I have a successful tenant/landlord relationship with my tenants, long-term tenants, and a waiting list for my properties. I've been renting out properties for over 35 years and I have only been in court once and have never had to evict anyone. It's as simple as following the laws for tenants and landlords and treating each other with respect. I treat my tenants as I would want to be treated, not as a business deal. Maybe you need to figure out why you're in court so often and make the changes needed to prevent it, whether you're a tenant or a landlord.

Exactly know she should have ate his portion of the utility bill because she was probably making a killing of the Airbnb. And now she renting out all three if not all 4 rooms in her apartment. She got more than what she wanted after everyone moved out. And knows good damn well she was over charging them for rent once she started the business.

That plaintiff is gross. It’s inappropriate to rent out someone else’s property on Airbnb. She was profiting off of someone else’s property which feels like a boundary violation. I wonder if her lease has a clause about subletting and if she violated that. She should have just eaten the utilities.

Which is good for her but if you are making this much money and it ultimately was a better arrangement for you especially after all the other roommates left then just eat the 200 dollars for utilities.

This "not so bright" plaintiff has opened a XXL can of worms for herself. She's probably in for a very nasty surprise when her landlord sees/hears about this "little business deal" she's got going on with his house......the one that he pays property taxes on. I'm sure her landlord does not know she is sub-letting her room. A case here in France went to court and the tenant had to pay the landlord all the money they had gained from renting through airbnb and it was retroactive by 4 years. And needless to say, the tenant was evicted...

My friend rents 6 acres with a house. There is another small house that he rents out also. He also rents out space for cars, boat and trailers. Landlord found out so now he has to give landlord a percentage of what he receives from those spaces. It is better for him then just raising the rent because people come and go out out the spaces. Money motivates people!

Instead of paying hotel fees, you can pay double to stay in someone else's house without any of the amenities and usually chores to do? Plus you are basically in a roommate situation. Sounds like waaaay more trouble than it's worth. Get a hotel, make a mess, leave.

Fr I never understood how getting an air b n b is better than staying in a hotel… there’s a cleaning fee plus paying for each nite, then ppl act like cooking is a plus, like why would I want to cook on vacation unless I’m there for weeks

Motels have daily, weekly and monthly rent offers. Even the shabbiest motels are better than giving up my privacy and putting up with people's BS or having them put up with my BS. Peaceful solitude is worth shelling out a few extra bucks if need be.

I could never have a roommate. My house is 3,000 square feet and I live alone and would never even consider renting out any part of it. Way too many issues with roommates. I mean, a big portion of the cases here are roommate or landlord-tenant issues.

I wouldn't want strangers in and out of where I was renting. You want to rent your rooms that way then wait till your existing renters are out . That's an increase in utilities too that existing renters shouldn't have to be charged too. Glad he got some money back.

What nerve the plaintiff has for moving in AirBNB ppl when she has tenants that signed leases! Seriously how selfish. She acts like she owns the apartment and is entitled to any profits made. I’m sure the owner will have something to say once this episode airs. It’s a problem in this country……..me,me,me. But then goes crying to JM when she thinks he owes her money. Think about it, if one of the guests get hurt or refuse’s to leave, they will sue the owner, I mean, he could get sued for everything she/he owns BECAUSE OF HER. All the profits should go to the owner and this selfish woman should be immediately evicted and lose her deposit at the very least.

If you rent a room in your house, you can not then rent it out to others b/c that is a breech in the original agreement, unless there is something written by the roommate that they agree to it. (Written lease or contract in the beginning, then a verbal agreement afterwards to over ride. It has to be a written agreement then). It disrupts the peaceful enjoyment of the place you rented with other people coming & going. I’m glad she lost. She’s in outer space thinking she had a case against him. Edited to add: As for Harvey’s question. Yes, the guy has a legal right to leave without a 30 day notice. She violated the original agreement. Just like if you have cockroaches & your landlord did nothing to correct the issue. It’s called a warrant of habitability. Edited again to add: just watched the ending in the hallway. On any day that girl had to sleep in the living room I would make sure to make a full continental breakfast make lunch cook dinner and dessert and play music and be talking on the phone in that kitchen because girl you were not about to take up the entire common area and we all got to be quiet because you want to rent out to Airbnb

Great idea. I would also have considered sleeping in the common area myself if I was her roommate. I'd love to have heard her argument as to why I can't use the common area for sleeping. I'm sure in her mind she'd feel that she's the only one allowed to do that. Some people.

So you rent a room in a home, and as part of the deal everyone shares a common area. Then to bring in some extra cash she gives up, rents out, her room for B&B stay-overs. Yet when all is said and done in her mind, it's the shared common area she claims for herself, WOW! Don't get me wrong the dude sounded too drunk and wouldn't remember the truth, even if he was shown a video!

The fact he asked her parents for a condom shows that he's more responsible than most. I'm not sure why Judge Milian would try to scold him for trying to be responsible. I don't care if he asked the mailman, neighbor, or Santa Claus. The fact he was asking people if they had a condom is a good thing. Too many people are having unprotected sex and bringing children into the world when they can barely take care of themselves. The plaintiff sounds like she's running an illegal operation. She mentioned a landlord, so she doesn't own the home and she's renting her room out on weekends on Airbnb. Then, she had the nerve to sue the roommate after she created a horrible living situation for him. No one wants strangers in and out of the house they're renting a room in. Not only is it uncomfortable, it's a safety issue.

I've never heard of anyone having the nerve to rent out a shared rental space as a B&B. It's not her home. She didn't own the place she was just renting along with the other roommates right? How would that be ok with the landlord and the other roommates? Then she says it was one of her roommates that suggested the B&B but she didn't have to actually do it. Maybe the roommate mate was being faceciois because she was so bossy and demanding, who knows how it came up, but it wouldn't make sense to want people barging in on the space they are renting. I thought B&Bs were like when you live alone and have a quaint big house with many rooms and some offer breakfast. Doubt this girl was serving breakfast in the garden area. The nerve of all this.

Wonder if her landlord knows that the plaintiff - who seems sweet and well spoken - rented their apartment out on air bnb? I would kick her out asap! I have a love/hate relationship with airbnb/vrbo - I stay at them when I'm on vacation, but now I have many houses on my street that are short term rentals and I hate the fact that I have constantly changing neighbors. Some are nice and respectful, some aren't. I would not want to live in an apartment under those conditions. Judge made the right call.

I would be extremely angry if my roommate rented out her room to Airbnb, thereby giving me an additional roommate that I didn't agree on, and the woman's crap would be all over the living room, because she's using it as her bedroom. I would also insist that the contracts say overnight guests can't stay longer than 2 days, unless everybody agrees in writing, definitely NOT five days.

If I were the landlord , I would have sued this plaintiff idiot for the maximum , for breaching the contract in putting my property up in Airbnb without my consent . Yep I wouldve sued for a portion of the utilities too because when people rent out places they have no obligation to be mindful of hiw much water and electricity they are using. I know when I go to hotels my showers are always insanely long... it's something about that water staying so hot lol
