The plaintiff says he bought a granite kitchen countertop from the defendant, but it felt rough, so he complained. He says the defendant told him that was the way it was supposed to be. The plaintiff says the sealant was wrong, so he’s suing. The defendant says he installed it correctly and even went to the plaintiff’s home to fix it but got stood up. He’s countersuing for lost time at work.

youd be surprised i work in a company where we give our cx 15 min for response we have to call leave voice mail txt msg nd just to cover our selfs we record that where present at cx address with no answer nd even then cx will still say they were home yet they never cared to answer any form of contact nd complain about how noone showed up

The plaintiff was in the right. Nothing for him to learn. I see why he went off on the defendant because he had the same condescending attitude throughout. I always find it amusing when y'all try to lay blame on an innocent man. I wonder why..

That definitely entitled him to yell at the guy for being a jerk. Defendant was a condescending A hole even in court and on TV.

As a customer, you can be in the right, and the business or their employee be in the wrong, but they will be reluctant or refuse to rectify the situation if you're nasty to them

I agree but I also absolutely understand how things can go sideways when a customer calls for help..... And a company starts with the Blame the Customer B.S. rather than just coming out to fix it. Even his brother, the owner said it was NOT because of what the customer chose. IMO that statement and stance of BLAMING the client is what set him off and probably would set me off as well. The employee brother's lazy flippant attitude was also Exposed with the so-called missed appointment 🙄 where he supposedly waited until he was 7 miles away to text If he was trying to work, he would have sent the text while there vs that B.S. about getting 7 miles away (before using the phone in his hand)......he had just communicated with the man via that text/phone. Only a moron would "believe" someone banged on a door for 10 whole minutes but never called or texted the exact same phone he just contacted the guy on AND contacted him on "7 miles" away In a general sense, I absolutely agree with you.....more 🐝 with 🍯......but some of these ppl absolutely do not wanna fix sh*t, address problems and play Stupid when it's time to stand by their work. Had the guy simply agreed to come out immediately when the client complained rather than tey to make him feel Stupid, saying it was basically "his fault" because of what he chose IMO 🔥 the situation

Eric, I agree wholeheartedly. The lazy arrogant employee was pissed off so he wasn’t planning on putting forth any effort either way. I’d even argue that he would have likely responded that same way even if the customer had been calm and jovial. The employee just seems like an asshole. Also- the brother who is the owner needs to not be a punk, and deal with his brother as if he is indeed an employee not a co-owner.

So the defendant could text "am on my way" but could not call or text when nobody answered the door? That is what I would have done. Text again. Call two or three times. Only then you can turn around and go back to your business. Besides, who sells a rough countertop? That is difficult to clean, and a kitchen should be cleaned easily.

I don’t think he has any real intention of meeting with the plaintiff. I think he went there, took the pic, and got back into his car. Yet another good reason to have a doorbell cam.

The defendant shouldn't be in customer service in any capacity seeing as how he doesn't know how to talk to people. He had a very rude and condescending attitude in court as well as the interview afterwards. If he was professional at all, he would have immediately offered a solution rather than saying "that's what you bought" which made the plaintiff upset because he felt like he was getting blown off, understandably, and that's why he got yelled at.

They were dismissive AFTER he was "no angel". No one deserves to be demeaned. Plaintiff takes no responsibility, only excuses for every step, and still couldn't leave with any humility. Employees do not deserve verbal abuse.

There is a rough version of granite. It is called leathered. It's very pretty but hard to write on paper on it. As my grandma would say, "You get more flies with honey than vinegar"

Human beings are imperfect. Nobody who walls the earth surface is perfect. Even a screaming customer. They make mistakes and want grace, so that has to be given to others. He called their establishment screaming and cursing at them and they were reluctant to fix the problem. The plaintiff works at Home Depot. He should know this better than anyone.

If you are trained in customer service, then you are trained to know that if a customer is phoning you it's because they are upset or angry about something, therefore the first thing to do is reassure the angry customer that you are listening to them, that you understand and that you will do everything to solve their problem. This defendant obviously just made an angry customer even angrier and even at the end still thinks he wouldn't do it differently, they won't stay in business long with that attitude...

I've been in customer service for years. Even the judge told the plaintiff said he was "nasty as hell". You can't control a customer's behavior. Sometimes they are just nasty and keep being nasty no matter how nice you are. I've had it happen many times and had other customers watching commend me for dealing with it. It's draining AF.

Plaintiff wants a full refund AFTER he discovers the countertop HE selected is too rough?? Really? So either wants the materials & labor for FREE, OR he doesn’t realize they would have to rip those “rough” countertops out leaving him with ‘nothing”! Annoys the heck out of me, people that decide AFTER THEY select something they made a mistake & now want a refund!! So glad the Judge (mostly) makes the correct ruling & refuses most of these people’s crazy requests!!

8:20 Judge is wrong here. She wasn't consistent across the board. I saw another case where a customer yelled at her hairdresser over the phone and the hairdresser hung up. The judge told the hairdresser she needed to know how to defuse situations like that and provide proper customer service. But I guess this isn't the same because he's a big guy (5:24)...

Love that JM always has the “lowdown” on anything having to do with construction! Lol! (Just cause she is the daughter of a contractor doesn’t make her an expert in that field! Lol! Funny cause she loves pointing that out every chance she gets!!). Far as the case, here’s yet another person that wants someone else to pay for their wrong choice! Why did he pay them if he was dissatisfied there wasn’t enough sealant on it (& it most definitely does matter the type of granite you choose! Even with a lot of sealant on it, some are still gonna be slightly rough!) unless plaintiff thought JM would order defendant to refund all his $ in which case he’d get a free countertop?SMH!!!!! 😮

I'm a remodeler and I see these guys come in with countertops all the time and I work around them when they're finished and I've never ever ever seen a rough feeling countertop they're always smooth they have a polisher at the factory that sits there and polishes that stone until it's smooth even the edges for the inside of the sink

Plaintiff working at Home Depot , used to give everybody good service at his job- Home Depot knows that it’s very important. The defendant was not like Home Depot, and the plaintiff got disgusted at their service. He started yelling , and the defendants just cut him off. Some smaller businesses give good service and are nice in anticipation of a sale and getting more revenue. In the case of returns they could care less - because there is no gain in revenue.

She got this one grossly wrong,the agent/company was very unprofessional,doing a shitty job the paying customer wasnt pleased with,then bullshitting the customer about the stone,who wouldnt be upset,i felt agrieved,with both the unprofessional attitude of the company and the judges ruling

It's amazing.... although his court demeanor is RESPECTFUL AND NEAR PERFECT, almost all the comments are so negative towards the plaintiff because he admitted to yelling at the defendants over the phone...I wonder if it has anything to do with him being a big black man...🤔

Installers hardly ever seal the granite or tile in general . A light colored stone like that could take a number of applications to seal it properly . The lighter the stone the more porous it is . Time = money

If I was the plaintiff in this case I'd be mad at the defendant too. When he called him up and told him that the countertop was rough the defendant lied to him and told him that's the way granted is. The defendant is the one that didn't want to repair or put another finish on the granite he's the one that started with the attitude by lying to the plaintiff. It should have been smooth

It's NOT tiles, it's one large piece of granite and it WAS what he ordered, but they forgot to put the sealant on it...

it was a slab of granite not tiles. its only 1 piece and there would be no way to know if the sealant was on until after they installed it.

I kind of understand the plaintiff frustration. He called to tell them that it was rough and they tried to flip it on him telling him it was the stone. Meaning he had to fork over more money to fix the problem. Now the defendant saying it was an easy fix. Wellll duhhh. So why not offer that solution

The judge never asked to see the order and receipt which would describe the product and finish a d install instructions.

Different granite compositions polish to different degrees. Some might not achieve a high, smooth polish. Sealant does not confer shine or smoothness, it soaks in and might make it feel rougher. Granite is a natural product and there will be variations. You can't expect industrial uniformity.

No, the sealer doesn't really make the stone smoother. It is the stone finish: polished vs. honed vs. flamed vs. natural.

That’s incorrect. The sealer goes over the stone. You put it on and can smooth it. It’s no different then putting epoxy on something and smoothing that to cover texture flaws

@@BeccasaurousRex270 Sealer can be applied to stone (quartz, etc.), but you don't, can't really, smooth it. Epoxy finishes on surfaces can be polished, but this is mostly done on wood surfaces.

It actually could be buffing issue not just sealer. If it need to be buffed-then 200$ would not solve the issue(at least my husband would not do it for 200$) 😬 plaintiff should of never yelled and let them fix it because sealer might not help

That’s why JM made the plaintiff touch the piece the owner brought to Court. The plaintiff said that what he felt was indeed the thing he experienced at his home. The owner explained that the only difference was the sealant, so that pretty much makes it clear that in this case the sealant was the problem.

What did the guy order? Why wasn't his order and receipt requested by the judge? What surface finish did he order? This case isn't rocket science; it's as basic as it gets, but the judge failed to ask the basic questions.

They were smart not to give their company name because I would never hire this company. The owner should seriously consider hiring someone else. Clearly thus guy is to thin skinned to deal with customers.
