sir, I am regular viewer of your channel, gained useful insight from your videos.keep uploading. There has been a horror incidence of honour killing in khati district -mujaffarpur ,Bihar. (It is case of somewhat different level where victim's body was cremated publicly in front of accused person house.) Going through the report I found out that In between the incidence , accused person after killing only son of the victim family, forced the victim father to sign something written on normal A4 sheet paper.. what kind of complications this sheet can bring in court of law?? or could you make videos on the nitty gritty related to honour killing and how to escape it legally, If possible!! I shall be highly obliged to you for this.

Actually argument rendered by late Ram Jethmalaani in Sanjay Chandra v. Central Bureau of Investigation - (2012) 1 SCC 40 is kept open by SC is genesis of whole issue. During arguments Ram Jethmalaani pointed out falllacy in 2004 judgement of Delhi High Court in Court on its Own Motion v. C.B.I, 2004 (72) DRJ 629 issuing guidelines of applying for regular bail in such matter.

In a case where an accused person hasn't been arrested and a chargesheet has been filed where subsequently magistrate is of the opinion the the case is exclusively triable by the CoS then u/s 209 the magistrate has the power to remand the accused to custody. This is however subject to provisions relating to bail. Another point here is that of S 309. As per that section the court taking cognizance may by a warrant remand the accused if th accused is in custody. Employability of this section pre supposes that the accused is in custody. So I think this is why the magistrate would order that the accused be taken into custody and then employ S 309 further. Another point which i would like yo add is that the accused when appearing for summons is in deemed custody of the court and therefore the court may order further custody.

If a person not found guilty during investigation also not arrested by police till now,chargesheet filled to court..Then magistrate order to judicial custody and a notice to his home...Then what should he do ,He is not guilty in chargesheet....

Well in some cases police takes bribe and do not arrest the accused but when magistrate applies his judicial mind and see Grevity of the allegtion order the arrest of the accused which is fair and good i thimk because a jude can better decide than police who should be free and who should be behind tha bars

Hii Sir ! Plz make a video on passport and its entire verification process until it's in our hand, why, bcz i believe most of us would agree with me that we've to give bribe to the police personnel who generally comes for verification despite of having all legitimate documents. Moreover, they try to intimidate us that if we won't give then they either would quash the application or put in limbo....? Does constitution or from anywhere else give them authority to go down at such extent ? How can we cope to this situation or what are the legal ways to refuse to them ?
