Clearly the psychotherapist needs a psychotherapist. What licensed practitioner moves a patient into her home? If nothing else her license should be called up in front of the board, questioned and reprimanded. This is a murder trial that could effect the outcome. What an idiot.

I am a psychotherapist and it is unethical to have a friendship let alone live with a client. It is a big no-no and it is considered a dual relationship. It’s 101 basic that we learned when we first started grad school.

Why was the therapist living with her client? Once the client moved in with her it became a non professional relationship. I don't think anything discussed in the house is privileged. If this therapist is so concerned with ethics she should reevaluate living with her clients and I certainly do not appreciate her uptight attitude on the stand. She's unethical and needs to be brought down a couple notches.

Clinical social worker can be a psychotherapist. Difference is the clinical social worker has higher educational and experience requirements and is the only masters degree that Medicare will pay for services.

A licensed clinical social worker is a therapist that can change people’s insurance for therapy visits. Look it up. LCSW that’s what her license is called and that’s what her degree is. It doesn’t mean she is a “social worker” They can even diagnose in some states. Not all. They cannot prescribe medication. They are very much qualified to provide therapy. This woman has gone past her limits. What she is doing is not only unprofessional but unethical as well.

Ask any therapist, psychologist, psychiatrist or licensed marriage family therapist…. There’s no way you would move a client into your home and it would be ethical.. this is a slippery slope. I just hope that Mr. Benefield’s older daughter gets justice. She lost both parents how very sad….

@@snicole042 I studied drama for years & our dept was attached to the Ballet & dance school. Dancers are amazingly disciplined & lovely - but boy were they immature, naive, & lacking in common sense! Their discipline is about the body & movement - so high mental uses are not needed. As actors we had a lot of focus on intent, human psychology...& our bodies were no where near as gorgeous as the dancers.

But I had thought that Ashley has been living with her mom raising Emerson … why did she live with this Barbara person? I’d never heard of this before seeing your post mentioning the same name, but I didn’t realize that it would be so significant that we’d be hearing in court from or about Barbara…. Did Emerson stay back with her grandmom Alicia during the time that Ashley was living with this “therapist.”

Imo I do not believe this was self-defense at all! It sounds to me should did everything she could to keep him away from their child. Doug's other daughter from a previous marriage is so brokenhearted and a lot of people knew Benefield wanted her way or no way from the start. I look forward to watching this trial! I do believe testimony will prove she is guilty of second degree murder.

I find it a huge CONFLICT of interest that her therapist had have gone beyond the scope of ethical principles. As a counselor this is a violation of ethical conduct to take clients in and live with them. I’d be interested in knowing if she lost her license to practice or had law suits filed in any other state due to similar circumstances of becoming personally involved with her clients.

Citing the duty of her ethics code is so ironic given she let her client live in her private, personal home like they're besties. It's so, so strange. Under Florida Law 491, a psychotherapist cannot have a intimate/s*xual relationship with a patient (unethical!) This has now opened up a possible lawsuit against the psychotherapist for breach of conduct. I sure hope someone can report her and have her license revoked immediately! How many previous/current patients has she had a intimate relationship with over the years???

This sounds like Ashley's attorney realizes that they are going to lose this trial and he is setting up for a mistrial by asking a paralegal to sit at the defense table. I am sure that they have researched this and there is some obscure precedent that they will pull out at the last minute!! It sounds very fishy! Also, being a high school drop out, do you really think that Ashley really understands what is going on - wait - maybe that is what they will claim that she did not understand!!

@FollowingTheTrial. Yes! All of a sudden her attorney claims he is 72 years old and has poor eyesight! I do remember at the hearing last week that Ashley likes to say, "I believe" alot. The judge asked her to read a paragraph and asks her if she understands what she read. She replies, I believe your honor. She knows EXACTLY what she's doing! More manipulative techniques. She can later state she didn't understand, what she read as she only "believed" she understood. She will use "I have Dyslexia" as an excuse. I also hope Prosecutors force the PSYCHOtherapist (female) to be on the stand to inform what UNETHICAL "relationship" (cough cough) was between her and Ashley. The jurors need to hear how Ashley is a lesbian that pretended to love a wealthy man for his $$$ then murdering him!

Benefield moving in with Russell might be ethically problematic, but it doesn't nullify the privilege. The only thing about living together that would nullify the privilege would be if Benefield was NEVER a patient. Even if the 'therapist' has used bad judgment it can't be used against the patient.

Not bizarre. I'm a Florida paralegal and we are trained to do almost everything a lawyer can do ... however, we can't issue a subpoena or sign off on court documents. I'm not NALA certified like the above poster (congrats! Huuuyuge accomplishment!), but the legal stuidies coursework was the most rigorous 2 years of my life after college. I don't think the average person understands that paralegals do a majority of the legal research work and draft memorandums ... but lawyers get to bill all the hours, lol.
