In this case the boater was obviously making a show of continuously getting close to the whales and disturbing them.

Then you may end up hurt or dead. Do you think that tiny boat can get away from those Orcas? Do you think keeping the boat running is going to scare them? It is going to make them more nervous and defensive and more likely could attack you. Listen to Marine Biologists. They know.
