As a retired police officer with 20 years of service all in patrol, I can say I NEVER let anyone back into their car once I got them out. At the beginning of my career, my training officer beat it in to my head that things go wrong when ppl go back into car. An open container and slurred speech is probably cause so cuffing him for safety, at a minimum, isn’t an issue. Well at least with my old department. I do not know the laws and rules for this city and department.

I believe that he is on private property. And not driving the car. That’s why they can’t arrest him for DUI. So they couldn’t handcuff him.

Drunk and angry. If you're drunk and angry, you should be in cuffs, searched and in the back seat of the cop's car. The cops didn't have the training necessary to respond to this call. Small town highschool graduates can be a fireman, a mail carrier, go in the military or BE A COP.

First of all, never let the suspect back in the vehicle. I’ve seen too many police shootings that could have been prevented. “Oh I need to grab my phone” “oh I need to grab this and that” no no no. I’ll grab it for you. Tell me where it’s at. If he’s intoxicated he should either be doing sobriety tests or in cuffs.

Being a former LEO, now retired, I've never seen so many piss-poor actions & procedures from officers. Mainly, they stupidly allowed him back in the car, as they all sat back a distance away. These officers created their own final situation themselves. Not only that, but from the get-go when the driver exited the car, they did no pat down, yet allowed him to reach into his pockets numerous times. smh The officer on the far right that fired the most, was at such an angle that he had no way of seeing that gun, yet in his report he wrote that he did. They didn't even check him for vitals, nor even get near him after they shot, to see if there were any signs of life. They all looked like clueless school children afterward.

Sadly, these officers couldn't even qualify for babysitter, especially by not even patting him down from the get-go, yet allowing him to repeatedly put his hands in his pockets and it wasn't until 8 minutes later that he pulled a loaded magazine out of his pocket and handed it to the officer, unrequested. No one 'forced' these officers to be so piss-poor in their SOP, unwarranted/immature attitude, and negligent actions. They also allowed him (still unfrisked) to go into his car as they laxly stood a distance away. These officers also acted like immature school children by bickering back & forth forever on who was more disrespectful. Yet you're defending their piss-poor actions?? Apparently you've never seen a skilled competent officer, who can be firm & professional without the bickering, and one who takes the correct actions so no one would have been shot. Pulled a gun? I know what a 'genuine' pull of a gun is. I wouldn't call this "pulling a gun" unless I saw the exact action & position, which you didn't see either. Yes it was stupid of him to even put his hand on it (assuming he did), but it would have never happened had I, or any skilled/competent officer, handled that call, as it was THEM that allowed him access to it in the first place. No one 'forced them' to be so inept.

They had so many opportunities to prevent what happened and I’ve never seen a cop know there’s a weapon in a car and not securing it first and foremost. I never would, but regardless, it's still 100% on the suspect for pulling the gun. He said it was in the trunk, too. Everybody wants to always find blame on the police. But if this dumbass didn't pull a gun, he'd be perfectly fine. They were even going to let him make a call and get a ride home.... MAYBE you NEED to watch the video a few MORE times. The cops AREN'T hired to let citizens run the narrative. They're supposed to CONTROL the situation at hand, find out what's going on AND determine IF any laws were broken and IF anyone NEEDS to be cited or hauled in to jail. If there's one thing I learned when dealing with drunk people is to never argue with them. Trust me, you'll never win. It's hard enough convincing a sober person of a wrong, much less a drunk person. Another thing, never give suspects a chance to do wrong. Keeping them in check and in place is the safest bet.

I don't understand how during their interview after this incident; *_"all three officers said they saw Thomas produce the gun and start to point it toward them, prompting them to shoot him and stop his actions,"_* when you can clearly see that he still had his head turned to the right like he was still looking for his phone. I watched it several times in slow motion and did not see him shift his position or move his head at all the entire 30 seconds he was in the car. The whole situation was handled badly and the attitude of the one officer was especially mishandled. Pride gets in the way of some officer's ability to handle their job in a professional way, thus getting angry when they are challenged or spoken to disrespectfully by someone, and that same pride makes for a very dangerous and hot tempered cop!

One of those cops that claimed to see him point the gun (Kenneth Skeens) was proven to have lied and NOT seen anything. He was also fired and charged for ANOTHER incident where he unlawfully arrested someone. Police union is on his side and representing him against the charges and termination.

I left an earlier comment pretty much saying the same thing. You are 100% correct. The kid never turned back and pointed any weapon at any time. Beside that, they should've never allowed him back into the car. Some cops escalate situations when their job is to deescalate. Potential cops should have to undergo rigorous psych evaluations before ever being considered for the job of law enforcement. Alot more citizens would still be alive if they would require that one simple test.

The first cops on scene did a very poor job of de escalating the situation by going back-and-forth with him and cussing at him, I’m not taking up for either side but as a law enforcement officer you should try to do any and everything possible to not end up in a shooting or a altercation no matter how a suspect is talking to you or disrespecting you

One of the worst examples of policing I’ve seen!! First of all getting into a petty argument with the guy. Then, after the guy tells them at least THREE times he has a weapon in the vehicle, they let him get back in the vehicle alone. Final fail, no attempt whatsoever to check the guy for signs of life after they shot him!! Unbelievably unprofessional!!

The guy was drunk & passed out in his car at a fuel pump with an open container & an attitude. They should've handcuffed him immediately. Charged him with public drunk, & open container. Possibly DWI if the keys were within reach. The cops were nice in trying to get him to call someone to drive his car home. The perp should've never been allowed to get back in his car. The cops were not incompetent nor unprofessional! The sititation could've been handled more delicately. However, the perp broke the law, then brandished a gun. Had the perp accepted his fate for being drunk. He'd be here today.

I'm baffled at these officers' actions. No initial pat down, his hands were allowed in his pockets and he clearly stated he had a weapon in the vehicle. Somehow, that didn't raise red flags for them. They let him back into his car, which shouldn't have ever happened even if he didn't admit to having a weapon. Then they all shot him when I'd argue the other two officers couldn't even see the gun. Once he was shot, they did not pull him out, cuff him, pat him down, or render any aid at all. This man was doomed from the start. It could have been avoided had the officers had better training. What a shame.

Yes, that guy made a choice to pull the gun and he should have been shot for it, but the whole thing could have been prevented.

I never seen him turn towards the cops and bring the weapon up, plus he had already told them him had weapons in the vehicle. They should've never allowed him to return to it knowing that. There's a chance with him being intoxicated, that he didn't realize what he was doing while looking for his phone and pulling the gun out of the console, but we'll never know. He was drunk and not in his right frame of mind, and it cost him his life.

WTF!! How were these officers trained? That was one of the worst stops I've ever seen. This is like a college academy scenario that's meant to go wrong. First, letting him light up a cigarette at a gas pump then down hill from there. No body pat down for weapons when the subject said he had a weapon in the trunk. Allow him back into the passenger compartment after the subject tells you he has a weapon in the trunk. Assume a weapon can be anywhere in the vehicle. Geez, no officer safety

Officers need some SERIOUS interpersonal skills, training how to conduct and control a interaction. Let him light a cig by the gas pumps, interaction filled with unprofessional communication (f-bombs, etc)while knowing he is intoxicated and not in a good place emotionally, then ALLOWING him to enter into his vehicle while you both stood a good distant from him! Broke the #1 rule on that one. Both need to be off the streets and retrained...IMMEDIATELY! This could have been avoided! And too, NEVER hold a flashlight in your dominant hand officer!

This feels like a set up. He's drunk but he informs you of the weapon in his car but you let him back in his car. I don't believe he even pointed a gun at them.

9 days before this incident the first officer to fire his weapon arrested a disabled man at a Target who was attempting to buy a bicycle. Kenneth Skeens is his name. 6 months after the Target incident he was terminated from the department. 6 months after his termination he was criminally charged by the New Mexico Attorney General for the Target incident. Now the parents of the guy shot here opened a lawsuit against the department for unlawful death. The report states that there was a gun in the car but that it was never picked up.

I could not understand that myself. I would never let a suspect back into a vehicle after removing them from it. He was never pat down and I feel like that situation could have been controlled more due to him being intoxicated and obviously showing very little emotion. He was suspicious to say the least and I never would of been comfortable and if I’m not comfortable it’s a different dynamic. Unfortunate event, he could have gotten some help or something. Sorry for his families loss, someone loved him and someone will certainly be heartbroken when he does not return home.

Imagine putting him in cuffs, talking to him and saying, go to jail and we impound the car or make a call to have this picked up and you can go. No loss of life. No shots fired, easy desicison for all. Training needed. These officers should have made the choices clear for him by detaining him and forcing a good descision.

This is one those moments that the officer is what started this. There was more hostility than deescalation and more ego than care that made this happen.

This is common place with Albuquerque police sadly, they have very poor communication skills and typically just rely on the "Im a police officer, you are gonna do whatever I say and listen to whatever I have to say because Im a police officer." mentality. The level of unprofessionalism is insane, and the department overall lacks in quality. A good example is the 5410 sexual assault kits that went untested (in some cases for decades) and just sat in storage thanks to lack of effort from the department to investigate them. Albuquerque has one of the highest crime rates in the nation, and most people I have ever known to become police here were doing meth/heroin and stealing shit from people until like a month before they joined the academy. This place is fucked.
