I think you will find that if they are VAT registered they must give you a receipt. You would need this to reclaim it if you had a business.

Hi Brett good job you got yourself paying on camera. The guy not giving you a receipt wouldn’t matter if you had payed by card because you’d have proof of payment, I don’t think stores are legally obligated to give you a receipt but if this ends up in court he will have to explain as to why he didn’t give you a receipt. All the best look forward to seeing the outcome of this.

My father who was disabled went to a local multi shop complex and parked at the end of a number of disabled bays but not in a bay. He had a blue badge, though the disabled bays were occupier by non-disabled cars. He sat in his car waiting for my mother, who was also disabled. The police turned up and gave him a parking notice, saying the complex had given them the right to do so. When they repeated this in court, the judge tore strips off them for harassment and wasting police and court time. Words like "who do you think you are" And "have you done this before" were barked at a stunned PC and then a prosecutor. My father received a letter of apology from the Crown Prosecutors office.

They wouldn't have seen one of those coins before as they are not in regular circulation ...But are LEGAL TENDER . They need to be informed of this ...they can be used in the uk as another form of payment.

The officer is wrong. My previous post refers. The Queens Highway is “extended” if the path you’re on (regardless of quality of road) starts and ends with a highway. So to the pumps is Highway, as you can drive off. Parking away from such a pathway (say, closed in by 3 walls) means you’re not on the Highway. 328 of the Highways Act 1980 says under the section ”Meaning of “Highway” that a “highway” means the whole or a part of a highway other than a ferry or waterway, and includes bridges and tunnels which the highway passes over/ through. Which actually doesn’t really answer the question! However it is the common law definition that says ‘A highway is a way over which there exists a public right of passage, that is to say a right for all Her Majesty’s subjects at all seasons of the year freely and at their will to pass and repass without let or hindrance. ‘ (Halsbury’s Laws 21[1]). A highway can be created by two methods - statute and common law doctrine and acceptance. There is a statutory presumption of dedication after 20 years’ uninterrupted use by the public under section 31(1) of the Highways Act 1980. However, dedication at common law does not require 20 years (or indeed any period) of uninterrupted use. This is backed up by case law. A highway can be a road or a footpath. It does not have to be a drivable route. Although colourful, that phrase says nothing about the necessary airspace above the surface," said Lord Briggs, giving the Supreme Court's judgment. "There is in my view no single meaning of highway at common law. The word is sometime used as a reference to its physical elements. Sometimes it is used as a label for the incorporeal rights of the public in relation to the locus in quo. Sometimes, as here, it is used as the label for a species of real property. When used within a statutory formula, as here, the word necessarily takes it meaning from the context in which it is used," he said. Consider In the common law of England and Wales, a highway occurs where there is a public right of passage over land at all times "without let or hindrance" that follows a particular route. Thus, an area of common land or a village green will not be a highway, although it may contain one.[1] There are three kinds:- A footpath is a highway over which there is a public right of passage for pedestrians. A bridleway is a highway that does not permit motor vehicles. Some bridleways also debar the driving of cattle. A carriageway allows vehicles, animals and pedestrians. Highways are vital for tenants and landowners because most property needs a means of access from the public highway. A property with no such means of access is called "landlocked", which has serious consequences for its value and use. The main statute governing highways is the Highways Act 1980. This gives responsibility for most highways to local councils, although trunk roads lie directly with the Secretary of State. A petrol station forecourt is not a carriageway as such, and is not maintained by the council. But through the pumps may be deemed a carriageway for motor vehicles as they pass in and out without hindrance. A parking spot isn’t.

... It becomes a Civil dispute, the second you start your contract off with the merchant... So in essence, the minute you get fuel in this case.... Until you pay for it,... You never refused payment.... So its classed as civil, regardless of any later argument regards method of payment.....

Unless it a private road a red road closed sign on a council road means you must not pass it so rather than make you identify under 163 of the road traffic act they will usually try pin a section 59 warning on you and your vehicle which would of required you to identify yourself. But I see what you were thinking there. Good one to note I was followed by police onto a private road (knew I was getting a pull) 2 bald tyres long story short because we were on private land when stopped us couldn't do us for the tyres even though followed us of a road

Silmilar happen to me, my car on private land. In my case it was moonlighting criminal coppers. Very long story. The police dropped charges when PSD got involved, but I found out the police are totally out of control. Presently sueing the police in the Civil Courts for unlawfulness and moonlighting, demanding money with menacies ( Fruad Act ). A UK police officer in England had a Eftpos machine and demanded money of us at the event. This is totally illigal. We never got a ticket or a incident or crime number or what the offence was. Police PSD also refuse to give us actual details other than the non disclosed charges have been dropped. We have the Eftpos reciept from the police officer and the case continues. What are British police doing with a Eftpos machine in their traffic car ?

I've been recently doing this as well but what im noticing is that if you pay with something that banks wont accept as a deposit they generally will say they wont accept them as if the bankers have some sovereign right to deem what is legal tender an what is not legal tender. i do not understand there reasoning for not accepting specie money but these businesses should not be allowed to operate if there not going to respect the law.

Brilliant, they took the money and I don't think they will contact you about it but having said that, the police are the only people who might and I think you have already taken care of them. Video receipts are as good as any till receipt. Time to get a body cam with a hidden camera in a pen :-)

Hi Mark. I think you are right about a body camera. I will look into it as I'm rubbish at filming the initial interaction as I dont want to provoke them with a camera. I rang 101 afterwards and told them I'd paid and be happy to arrange an interview with the police if they require it. They took the side of the retailer saying why can't I pay with other means that they accept? I told them its treason. The police swore an oath to the Queen who proclaimed the coins as fit for payment yet the police are discouraging the use of those coins in favour of the banks digital payment system.

The police should never have taken their side due to the fact they are supposed to be impartial! But you know as well as I do, you know there is something imminent when the things that where once good are now bad and what was deemed once bad, appear now to be accepted as good... At least with a hidden camera, it won't distract the cashier from the debate as they will not need to focus on the camera and they can then concentrate on the discussion. Hopefully the police will stay out of it as they have concluded it's a civil matter more than a criminal matter and as you identified, it should not even be a civil matter as legal tender is legal tender that has value to it's tender value otherwise it would be fraud by the royal mint or whoever created the coins and marketed them in the first place.

Coins such as these are advertised in newspapers and on tv.Collectors items that after a while no one will buy off you.Probably get a set cheap at a boot sale. The tv adds always say something about valid in Guernsey,Isle of Man or Gibraltar.All of these places have coins/notes with the queen's head.This doesn't always mean they are valid in England. The question for me is why not just use your debit card like everyone else?. If you want to offload it go into a bank,preferably where you have an account.Interesting to know if they will credit it to your account. I don't like the scenario of people who work for just above minimum wage having to put up with whatever it is you are trying to prove. I shall subscribe to see the response.

What puzzles me is why these cashiers care so much about rare coins. I would be amazed if I was working and received one. Even if rare coins were hated for some reason, imagine standing there working for minimum wage going to the effort of making a formal complaint and you don't receive any of the money anyway.

Somone I know used to work in Tesco petrol station many years ago. She says that it was boring and anything unusual would be a relief from the boring day of work. There was one guy I remember who really liked the coins and enjoyed seeing them. I used to give him a different one each time.

@@rickysmyth I did go to Tesco and put loads of coins I found metal detecting in their self service checkout. I'd almost paid enough and one particularly corroded coin jammed in the machine. I asked for assistance and they opened the machine only to discover all the filthy coins and commented that it looks like a roman had been in. They decided the best way to proceed was to give me a refund of what I'd paid so I could start again. I said that I dont want any of those filthy coins though... 😂

Interestingly of all your counter staff reactions this one in the circumstances may have been the more wiser and correct in that they took your money but doubted the authenticity of the cash?..the fact they took it was very sensible since it may have negated the need for court action..You should always avoid any court action whether you seek to prosecute or could be prosecuted yourself and that by the way is the law..They intended to call the police and they did not attempt to apprehend or detain you since they already had your identity detail..Now even though the gentleman was rude he acted correctly. .Take the disputed cash if you have ID details then let the customer go about his business inform him politely of course you will seek the advice of police as you doubt the authenticity of the cash don't give an receipt as it's taken as the evidence of an successfull transaction and finally let the law not you the counter staff decide if the money's good or not. .I mean just look what happened to George Floyd when someone called Cops on him believing non-payment or transaction failure amounts to theft when it doesnt necessarily does it?

There is no obligation on a business to give you a receipt. However, you should always ask for one. Receipts are an easy way to prove you bought something in a particular store. However, a receipt is not the only way to prove proof of purchase. A video of payment being taken or given should suffice.

No it doesn't. The information is deliberately obstructive. Even the police said they couldn't get straight answers out of them to explain if I had committed an offence or if the seller can do anything about it when presented with these coins when owed money. The reason being is because I am right about it but they don't want to admit it.

Can drive around the M5 pull up the Range Rover get out the 4x4 go to the horsebox saddle the horse. I would not trust what that copper told you about private roads technically he should not have been arresting you in the first place as I’m sure you’re aware as it was a civil dispute the other thing is if you were to bring your son or daughter to the car park of Tesco’s( in the empty bit of course) and you were to give them a driving lesson they could do absolutely the square root of fuck all as you are on private land Also the reason why he accepted that in the end was he most probably spoke to his head office who told him what a prat he was and to accept it.

Unfortunately people like yourself ho out of their way to cause a problem putting staff on low wages in difficult situation . Would you ho back and pay them if they lose their jobs which happens when employers make you pay what they say is lost even if technically legal tender.

If his employer wants to commit any other crimes against him do you think I should volunteer myself or my family for that as well? To steal money off him under these circumstances would be immoral and illegal. Why would you try and justify that?

It is just awkward for the employee not being giving right guidance. People just want to cause issues. Go to bank and cash them in then there is no issue or get bank to clarify these are acceptable.

@@terrystephens8603The Royal Mint wrote to the banks and told them specifically not to accept them from customers. The coins can be used as settlement as a debt however due to their legal tender status. The coins are rubbish anyway, I had a load of silver £20 coins bought from the Royal Mint and they have turned brown over the years. They can have them back.

Listen mate I kind of admire your crusade against big companies, but it seems like the people who really get it in the neck are the shop people. If they get told not to accept these coins, they are not gonna risk their jobs to accept them. These people are not normally gonna have law degrees, so I dunno just seems a bit exploitative to me, although I do see what you trying to do. Some of these people will actually have to make up any till discrepancy from their hard earned wages. That being said he was a bit snotty with you

Thanks for your comment. Its an assumption that they get into trouble or are penalised in some way for accepting them. If that's the case they would have a case against their employer. I try not to give the staff a hard time. My crusade isn't necessarily against big companies but about the lawful use of these coins. I think its ridiculous that these coins have the same legislation as all the other coins but I risk unlawful arrest if I use them.
