They’re legally protected? Why have I seen multiple construction crews build houses right on top of them then?

Burrowing owls are protected by the Migratory Bird Treaty Act. In Texas it's illegal to kill or possess burrowing owls, or to destroy their eggs. Harming or killing an owl is a Class C misdemeanor, which can result in a fine of up to $500 and a civil penalty.
