But they were also right you can’t film in their store. That is illegal so if they pushed the issue on the store the store could very easily push the issue on them. Also saying “no” isn’t stopping you. He never physically put his hand on them. What was the store manager going to do if they kept walking? Nothing probably. They didn’t try to actually get out. That lawsuit isn’t going to go anywhere.

@@astros7242it’s actually not illegal to film inside a store. The law states, an individual or group may not film in any place where someone expects reasonable privacy, such as a camera filming inside your bedroom from outside, a bathroom camera, a hotel camera, etc. It’s company policy in most commercial settings due to privacy concerns of its products, customers, and employees as well as preventative measures for theft. If it was illegal, then the store itself, as the private property who enacted the rule, wouldn’t be able to give permission, you’d have to file a permit with the city or something. Also, the store cannot legally assume everybody knows this since it is the privately owned business’s choice to enact such a rule, so they have to give at least notice to the person of the rule and the consequences for breaking said rule, and the only thing a cop would enforce is a trespassing notice to the person filming for refusing to follow rules or refusing to leave. Then if they came back, they could be cited with a trespassing charge regardless of if they were filming or not. If they left before the police got there, the police would just file a report and say something like “call us if they come back, and we’ll let them know they’re no longer welcome here.” However, it is most definitely illegal to hold someone against their will in any circumstance besides when a violent crime has been committed and then you can initiate a citizen’s arrest until the police arrive. If you ask someone to leave, then tell them they cannot leave while you call the cops on them for not leaving, that’s an easy lawsuit. If the police got there before the group left, they’d probably just tell the group not to film and leave. If they left then got contacted by the police, then they could make the claim that they felt threatened and left to avoid further issues with the manager. If the police heard this and didn’t go back and arrest the manager, that’s when you could file a lawsuit as false imprisonment is a criminal charge. And you can make a criminal charge civil, just look at the OJ murder case. He wasn’t criminally convicted, but he was found to be guilty civilly and had to pay emotional damages to the family. All the guys would have to do is produce the footage of them attempting to leave after being asked to leave, pair that with the manager telling them now they can’t leave, and with the police report of the incident and make a claim that the reason they stayed was because they felt afraid of the manager and didn’t feel like they were given any chance to “fix” what they had done wrong (leave the store or stop filming) and you got yourself a lawsuit for false imprisonment. Would a jury of their peers find the guy to have falsely imprisoned them and make him pay out for emotional distress? Doubtful. But it would inconvenience the manager personally with a court date for personal lawsuit rather than the company he works for since he was the only one in the company “imprisoning” the group. So if you wanna be petty in America, you can sue for just about anything and roll the dice on how things would pan out, just gotta pay to file the lawsuit.

@@MDelay180 A private business can kick you out for recording, but it's not illegal as long as you aren't filming private areas like the bathroom. If you are asked to leave and don't it can become trespassing though. The store owner is not allowed to detain you though that's ridiculous. Also 911 isn't supposed to be used for non-emergencies like that.
