What do you need when you have won your Appeal for PUA and they have not Paid! The referee had to r/s my hearing after I appealed the Board of review and I won but I still have an existing UI claim. I am questioning if I can have both. I was initially denied UI and subsequently denied PUA. With the PUA, the moment I won three flags came up! Three back date and then I am on hold for that and PUA income documentation! Does anyone have any suggestions on how to resolve this! Also, my other appeal, I rescheduled. I had a very unprofessional referee and she knew the employer had hired counsel with a phony witness. If this person is a witness, then where was her or his statement when I was facing Constructive circumstances. No shred of evidence in over a year but know they have a witness. When I appealed this to HR, where was the documents. I need help to defeat them so I can get benefits and keep a roof over our head.

I was denied because I had to update my security license but I’m trying to explain this came right around COVID 19 I had my license for 7 years I would never , I like to work for mines !! So I have emails and text to my boss asking around April for extra hours and pay because we was working during the pandemic and it was hard to get other employment , I was buying extra products to stay safe my rent was getting backed up and I got sick around that time it wasn’t COVID but it was a flu type cause I throw up at work until I was throwing up green stuff , so this all had to with spending extra money and the stress of the pandemic. Do you think I will win with my explanation??

I have been receiving help from my assembly members staff. First I received a Notice of Determination of Invalid Claim Section 1277. My AM office had EDD call me. Erica with EDD advised I not file the appeal form. Erica said there are only a couple of weeks left, she's personally handling my case. A couple of days later I received a Notice of Potential Overpayment! Erica again suggested I not file an appeal form. She said if it makes me more comfortable to go ahead and file the appeal! We are lucky to have you Ginny as the EDD is one dysfunctional state department 🙃

I just got my appeal date with the judge! It’s June 10th at 9:45 in the morning. I filed my appeal late January just for everyone’s information. Crossing my fingers everything goes good!!! Pray for me haha

Hello! I wanted to share that I contacted my state representative and they were amazing. They had an entire team of staffers who's sole job is to help with EDD issues. Within a few days EDD called me, said they were calling as I was on a "Congressional action list " and that they had no idea why I had been in pending for a month 🤣 they also said it was probably due to a computer system that "wasn't very smart ". I was paid within 15 minutes!Contact your state representatives people! They are rockstars!

Hello ive been having trouble with my EDD since last year of September. Ive been on an appeal since and I actually won my Appeal in March this year but i still havent gotten any calls or anything in the mail. I’ve talked to lawyers at the place this person is promoting. They legitimately wanted $1500 to prep me on questions and maybe speak to the judge for the appeal. Total rip off, people don’t have this kind of money if they’re fighting for EDD

Sorry you feel this way. We represent many thousands who value our help very much. The initial consultations are always free, and most of the cases are on a ‘don’t-pay-till-you-win’ basis, but some cases where we fix a debt to the EDD, for example, have to but on a flat-fee basis.

Can someone please answer my question I had an appeal hearing with a judge like 10 days ago for identity verification the judge simply identified me and I got a letter today saying that it’s in my favor now when I log onto edd online it says disqualified again before it used to say appealed. System sounds designed for people to give up because spending all your energy trying to get money for unemployment when you really need a job feels futile. Can't call in. Didn't receive mail. I am adult with special needs but not special enough to get disability nor do I want it. I want work but I need to pay for basic needs. Cannot even do my laundry or buy essentials right now. Tried calling the the lawfirm for help but they need 800 to help. And won't accept payment after. I have tried calling for help from so many different sources just help me appeal but I am starting to feel hopeless. Can't find work Can't get unemployment that I have paid too many taxes for. Trying to be a productive member of society but it doesn't seem to matter.

Hello sorry I have a question I hope youre able to help me out... I have been getting benefits ( pua) since may 2020. Last 10 weeks I been in pending becausr of a address verification.. now they did not aprove it and I got on all my payments saying disqualified ... does this mean I have to pay back everything the edd has given me since may 2020??? so i applied for the pandemic assistance for my photography business but the edd auto pulled in my part time job somehow. basically i was getting paid based off a $900 a month part time job instead of my business. i emailed edd countless times and didn't even get a response for nearly 6 months to which they said the issue had been resolved. they're now saying my claim was wrong because i claimed 0 income for my business but it was going against my part time job to which they received a w2 from. what can i do?

Get it Girl !! Another great video. All I can say is Fight for your rights! I fought my case and won my Over Payment case a couple of years ago when the EDD worker accused me of being a liar when EDD over paid me, i sent them the money back the next day and send 5 emails a day advising them of the error. When I went to court I over 50 emails printed out that handed to the judge along withe money order receipt and the money order being cashed proof. The judge apologize for the issues that I had with EDD and stated he would do his best to get the EDD person that treated me so badly spoken to, the judge also revised the decision in my favor so that i would not be penalized by not being able to file for unemployment for 5 years, that was the penalty with over payment, not sure what is now. People just know you can represent yourself, just take all the evidence and proof with you and you will win.

Hey Ginny! So my balance just hit $0 this past weekend and I'm still within my benefit year, I'm assuming PEUC is what follows. At first it said "Maximum Benefits Paid" but now it says to check back on the 9th for the next available weeks...is that a sign that I'm now under PEUC? I reached a rep @ 909-383-4661 EDD office. You will bypass the recording and wait. But... it’s worth it. I got 4 weeks released. It was a Blessing

Many people are reporting including myself) on Reddit and in comments that in the last 24 hrs they’ve received a notice in the mail from EDD “as a security measure” stating their PIN was changed, and “if you did not establish or change your pin to call edd immediately.” My notice says I changed it on April 25th. I did not make this change. Wtf is going on with edd? I feel like they’re intentionally delaying payments and causing hurdles to excuse themselves from they’re disastrous handling in operating the department.

Yes I agree! There should be something we can do! Government don’t care if we starve and shiver in the cold. You get through one process and they flag you on something else! The Governor nor other elected officials are not trying to resolve this problem.

I was supposed to have a phone interview on June 4th, between 8am - 10am, but did not receive any call. I called to see what happend and they said that did call twice, I was up an hour early to be ready for the call. And I know for sure there wasn't a single call. It took me two months to get a phone interview. Of course they didn't call, they could lie and just say they called so they don't have to deal with me. What BS!

HI- I went thru appeal, and it was helpful to await for the Appeal Office the discovery of the file-- the only one with any authority is the Administrative EDD Judge(though do act like they are full judges) the people on the line at the appeals office are some really good folks and they were helpful I think as I phoned into them 30days after I sent the Appeal. THen it gets calendared, the decision arrives in the mail. *specific to identification verification not **ID.ME*

@@adventures_emily8596 it was one in West Sac via the location in SoCal, which divides the Appeals to their addressees in NorCal. From when they received my Appeal, I waited one month after I sent it, and it was to be calendared- not yet. ( this was because EDD would not accept my certified birth certificate, or it was lost.) Last October- I filed July 15th. Appeals office then instructed it was not necessary for me to appear. If they need more in the file- they will send a letter. In two more weeks I called and learned I won. I began to certify 48 hrs. That is about it. Believe, we are tired , so are the offices. Be especially patient and considerate- it matters. 😊

Yup, my friends appeal took a total of 15 weeks but that was earlier in the pandemic, now I hear it’s closer to 6 months and I see one of your subscribers said it’s taken them 8 months. I don’t suppose the question came up if you could take back an appeal if you sent it in but didn’t mean to. I know a lot of people didn’t understand the invalid claim determination letter 1277 notice and turned in an appeal when they shouldn’t have and I’m worried they might not get paid for 8+ months while the appeal takes place.

This is exactly what happened to my daughters account. It said she was disqualified and all her payment history went to disqualified. I could not find any info or videos on it and the calls were hard to get through so I appealed ASAP and here I am since February. Thank you for all this.

Hi Shelly, I sometimes watch your channel as well because of all the issues I've gone through with EDD, i.e. refiling, couldn't get through phone lines, I'd.me, etc. Now, when I finally refiled, I accidentally put No, not looking for work, cause I didn't check my EDD email first, it said to check Yes. So now I have an Appeal letter along with a Notice of Invalid Claim, Section 1277. Should I do a claim? I'm about to contact my assembly person Again.

Hi Ginny, I didn't get this attorney's web site, I need to contact him. I left my job of my years, because the Corporation was filing bankrupcy, now after 3 months edd disqualified me because ex employer denied me benefits because I retired, which is not true, I was forced to separate from company due to bankrupcy. If I would of stayed I would of lost my benefits. Thank you.

Hey I won my appeal on January 1st, I received all the paperwork from the appeals office saying they reversed EDD's decision, but now 1 month on I've STILL NOT RECEIVED ANY PAPERWORK FROM EDD. They owe me 25 weeks at $650 a week. So do the math I should have a VERY NICE payday coming. If you could keep me updated with what happens to you and I'll do the same.

If you are stuck in pending, they may have waived the requirement for an interview - if your pending goes to paid then you would be ok. Otherwise you will need a phone interview date.

I got a denial letter due to ID verification. I believe these are highly successful in being won. My question is that should I send my documents via certified mail? Would someone at EDD sign for it? Also I certify tomorrow and I am hoping my PEUCy claim balance reloads and at least goes to "Pending" and not disqualified! If it says disqualified, should I call EDD? I plan on mailing my Appeal on Monday.

I would like to know, when EDD states "you will receive a response to your question in 5-7 days", but then never respond or take 8 months to respond, what kind of liability are they held to by consciously choosing to use the word "will", as in they "will do something". They dont need to say that, but they do, and then fail. Do i get that kind of freedom? No, so why should they?

@@ginnysilver I have the same situation except THEY EDD put me on a extension then said they have to reverse and put me on new UI claim this was December not a computer but a personal problem. $511.00 since December 27th. I Have spoken with my State Assemblymans office MANY TIMES and still can not get anything done. WHATAREWETODO???? To have to listen to that 3 minute recording Everytime is crazy to be told busy. Just give us a busy signal. EDD needs to QUIT Wasting our time. It's going to take a class action for them to take care of this!!!!!!!

My hearing is tomorrow and I have been waiting for this to appeal since March. I hope the judge hears me out and be on my side because I am running out of resources to pay my bills. I am also a returning student in fall so I wont even be able to work full time. I'll let this comment section know if i get approved to receive benefits or not and how long it takes for me to get back pay.

I had a claim that started 3/15/20 and ended 3/15/21 and I filed a new claim. I’m on FedEd ext. I got a notice of determination of invalid claim but I also a new award letter and can still certify. I’m so confused. Can anyone help? I still have two weeks left on my old claim to be paid. Will a new claim start? Or do I need to appeal?

@@ginnysilver should I be worried since my benefit year ended and I filed a new claim that got denied due to lack of wages since I was under unemployment all of 2020, but haven’t received anything in the mail about my denial of a new claim. I called in March and they told me my claim was denied but the kept my old claim open and were processing me for the PEUX extension. They said it would take 3 weeks from March to implement the extension but that didn’t happen and I have a $0 balance on top of that. I called customer service on Monday a week ago and they said my extension would be done in 2-3 business days but it didn’t. I contacted and filed a contact form to my Assembly member as well as filled out my personal info and my situation with Edd to the form the assembly member email attached through their email and sent the completed form back to them. I still haven’t heard from my assembly member or the EDD. Should I be worried about not getting my denial of the new claim I filed for to appeal and would appealing help me in my case?

So I’m a moron. Simple as that. I applied March 2020 when I lost my self employment as an officer assistant due to the company cutting costs due to covid. I’m also high risk, asthmatic, etc so even if it was my choice to come back or not I couldn’t have due to the fear of covid killing me. Half my claims are disqualified and I got this dreadful notice.. I don’t understand why. Nothing changed for me december 2020- sept 2021 with me. Still unemployed still high risk. My appeal is due in 11 days and Idk what to do. Idk what I did wrong. If I had known id be disqualified in December I would’ve opted out but I was told by everyone “re-apply for the extension!” And I did! And now I’m screwed. Any help would be appreciated . I’m losing my mind

@@ginnysilver I dont remember being asked recently, my last self employment paycheck was in March 2020. Then I was cut. I sent my tax form showing that a month or so before getting the disqualification notice. I have filed an appeal and just waiting now. I just saw your reply- KZfaq doesn’t notify me for some reason. I might have to owe thousands of dollars due to EDD changing their minds of denying every single dollar i have already received. This is not fair. Why even give me the money that you already agreed that i was eligible for!?! I barely have enough to support myself right now. I am scared and stressed that i am going to have to pay back something i cannot afford to pay back (Let alone afford a lawyer to represent me). I will only be living to pay back EDD for years. I should have never asked for help, thank you edd :( I hope everyone here is having better luck than i am having.

Omg this is happening to me too. It's so frustrating. I was approved back in June 2020 and now they're telling me I'm disqualified. I'm going to appeal but I'm thinking they're going to make me payback. Why did they approve me then deny it 2 years later

@@d.l.1 That is exactly what they are doing to my son. He was approved back in March 2020. Then he received a letter in July 2022 saying he's DISQUALIFIED for benefits he received in April 2020. And that they want him to pay back 10 weeks worth of benefits that he was qualified to receive. Benefits that they paid him. How is this even possible? I don't understand how they can get away with doing this to people. It's wrong on so many levels. He sent in his letter for an appeal just the other day. So now we get to go through the waiting and not knowing what's going to happen until THEY DECIDE. I think this is their way of trying to make up for all the money they lost through all those fraudulent claims they paid out. Going after innocent people is not the answer.

They keep pushing everyone to appeal but not doing their job to double check applicant's background. Reason gave that there's no enough identity and etc. Why they keep giving help those are not paying in the system and therefore lack of resources and identity. Unfair treatment giving by the system. Enough asking help assistance for paying into the system.

No, they will call you. Remember it's redialing for you and will take a while to get a callback. They text you a confirmation- make sure you entered your phone number correctly. If no text came through email support@claimyr.com

Appealing an EDD claim is simple. I am not an attorney and I prepared someone’s appeal and they got their money within a few weeks...you read the EDD letter thoroughly and provide the EDD exactly what they are asking for...it’s easy

I can't see how they can make you wait after winning an appeal. What are they going to do disqualify you for a different reason? Then what? Appeal that too? I won an appeal six weeks ago and still disqualified for an unknown reason. My assembly member is looking into it for me after writing him and sending a form. (Thanks Ginny). Okay. Super-Duper! But I have only one remaining question (possibly 2) for the Lawyer.... Attorney Man, you referenced a defendant of yours who has yet to collect a penny of his/her claim. A claim which dates all the way back to MARCH 2020! Can you please elaborate on this? What flavor of problem(s) exist in that scenario? In your experience why are legit claims getting stuck along the way with zero explanation from EDD "Customer Service" ... further resulting in the claimant having to force an unnecessary appeal. When someone doesn't qualify for regular unemployment or fed-ed or PEUC, etc. can they also be denied PUA as well? Under what circumstance(s) would someone not qualify for ANY of the current programs (not even PUA) ? What if you're a freelancer/mixed earner who hasn't worked since 2017 for whatever reason? Aside from being fired, are there past employment requirements to collect on the base $167 PUA payments?

I'm not sure if this helps but I too have not received a single penny and my claim goes back to APRIL 2020. I was asked by EDD to verify my identity back then and I did and they sent me a letter with a generic response saying that I failed to verify my identity- I did this 3 times before being advised by EDD themselves to file for an appeal because the EDD representative that I spoke to said that what I was sending was clearly sufficient documents to verify my ID. So I filed an appeal in DEC 2020 and got my court date for JULY 2021- Called on the morning of my hearing and didn't even get put through the judge because the woman told me, 'good news! Your appeal has been dismissed! You will begin receiving benefits within 48 hrs.' That was at the end of July and we are now at the end of Sept and nothing has changed on my account and I have tried contacting EDD through ClaimYr waited each time for 5 hrs and the call dropped every time. I have sent them a letter every week for the past month and STILL NOTHING HAS CHANGED and I have not been contacted. They have robbed probably thousands of people this way.

First; He spent four minutes on, " file your appeal on time ". Second; from filing an appeal you are looking at six (6) months to be heard at a scheduled hearing. Yes, that's right, I said S I X months. Put some money away, so you can survive while you wait to fight for your rights. Thirdly; (dry as all hell like most lame lawyers), no NO: there is not a second process. If you win your appeal then you will get UI benefits. You will be required to certify your search for employment as you did while you waited for your hearing. Best of luck.
