The cars are seized as evidence to the commission of a crime, No different than if you're accused of robbing a liquor store with a firearm and the firearm is seized as evidence for your upcoming trial. It will be returned if you are found not guilty and the firearm isn't stolen. If you are found guilty thee judge can order the firearm seized and to be disposed of. An object is just an object.

The same thing happened a lot in the late 90s and early 2000s with massive street racing busts, the police lost out big there too, and ended up having to return a lot of cars when they would seize many like this. People that were not actively participating in the sideshow or in the street race were determined to not be anything other than innocent bystanders. You cannot arrest somebody for simply being present at a location, they must be actively participating in set crime. A good lawyer will have all of these charges dropped and all of these vehicles return within 2 weeks. You cannot deprive somebody of their rights just because they happen to be at a location where a bunch of morons are doing things.

They are blocking the road and enabling the more dangerous actions to take place, akin to being the getaway driver for a robbery. They didn't taken anything but they were key to the crime occurring.

@@The_Brozilla your comparison is wrong, instead of comparing the people that are simply there to the getaway driver, you compare them to the person who is parked in front of the getaway driver. This would be like the police arresting everybody around the getaway driver because they claimed they were participating in the robbery without some specific proof they were participating, the Supreme Court has held that just existing in a location is not enough to be considered part of the crime, you must have actively participated in some way.

They don’t care if the break the law while enforcing other laws as they have immunity. This is why qualified immunity needs to go away. Throw the book at the jagoffs doing the side show but let the bystanders go.

I say if you're going to be a moron with your vehicle and / or surround yourself with others who treat their vehicles like matchbox toys, then the privilege of having a car in general should be taken away as a lesson. - I think the sheriff has the right idea, and maybe those people will learn that the side show scene isn't worth going to.

At worst you'd only be liable for costs from when they took the car to when you tried to get it back. Once they said you can't have it the government can pick up the bill for the impound.

Rob I know about a young 4 year old girl that was being rushed to the Hospitol and they could not get through because of a side show in california and the little girl lost her life because she could not get to the Hospitol in time. I also saw at my job a guy get into a accident he was uncouncious and they ran over and robbed him and stole what ever they could from his car it was terrible. It is about time they cracked down on this hard because people are getting hurt badly and shot beat up and jumped at these side shows.

I'm born and raised in far Northern California California I'm 37 I live north of Sacramento side shows originated in Oakland and the Bay Area as a little party on the way to the party and it's just gotten worse from there I definitely do not support them I think they are the dumbest thing ever luckily I live in a smaller town where we don't have that type of thing going on but it needs to stop

impounding ALL cars within a given area because a crime occurred involving cars seems a bit illegal. I bet they'll get sued and forced to release them. It's almost impossible to think they have a case against all the owners of the cars they've impounded. Simply being near the event isn't a criminal act.

back in my day "weston and steeles" in Toronto at night. Vacant industrial area and even the cops brought their cars up there to race. Literally no one around, no residential, no one. Then it got built up and they shut it down. EVERYONE knew about it and it was done responsibly and safely.

The DA can also move to seize the cars after the criminal case is over. Even if they lose, the cars will be in custody for a few years and worthless in the end. The only saving grace is if there is a loan on the car it gets difficult to seize it. It still takes time and money (lawyer) to get the cars back.

I was 15 when Fast and Furious came out and me and my buddy built a Honda Civic got into the street racing scene where we live and there's a lot of Back Country Roads where nobody ever goes so we were able to do it pretty safely without endangering anybody other than the drivers we would never race through the middle of town or in danger anybody just for the hell of it

Brought up by a mechanic who collects cars a did a lot of auto cross events etc, so my weekends as a child were spent at tracks around race cars . many out there, who’s car is just a car. You're going home in your little Toyota. Suddenly the traffic stops and you're pinned in. You can't see what's going on. Typical big city rush hour traffic. The cops come and you think whatever it is they're going to get traffic moving again. Boy are you surprised when the cops ask you to get out of the car, arrest you, impound your car and send you to jail. You ask why and the cops say you are encouraging these side shows by being an attendee. You lose both your car and your job even though all because you were stuck in traffic. Its already happened in Detroit.

In any other crime after the evidence has been taken from a vehicle and pictures taken it is released back to the owner. Furthermore a car parked on the side of the road belonging to a bystander is not evidence of a crime. Only the vehicles participating in the sideshow would be evidence. Also in some places speeding is a criminal offense and they only impound the car if you are arrested just like a DUI which is criminal and in both those cases you can get your car back before trial.

we used to do impromptu car meets in empty parking lots. some people revving, doing burnouts while leaving, nothing major - mostly people standing around talking about cars. these things are completely different. ours got shut down for a few idiots so we shamed and shunned people who acted stupid. Unfortunately, the law is on their side and the state cannot hold their vehicles. Unless the da can prove some kind of crime, these people are entitled to a speedy trial. I suspect a good lawyer will get nearly all of the charges thrown out on everybody that was arrested and there that was not participating actively. The same shit happened back in the day for Street racing, and cities lost out big time because they would seize hundreds of cars, and have to give them all right back within days because a lawyer took the case for all of them.

The one thing that concerns me is, what if you're just driving along and a side-show happens at an intersection where you were waiting for the light to turn green. Do you get swept up in this "task force" too? Do you have to somehow prove your innocence? Do you get your car taken away for months until the court case happens? What happens if you *can't* prove your innocence? (Why do you not have a dashcam, you moron?!) Do they then just take your car away from you forever because you couldn't prove that you weren't a spectator? I'm not saying these side-shows shouldn't be shut down, but damn, it seems like it's just *far* too easy for innocent motorists to get caught up in this.

The issue is the truly innocent bystanders that were just caught up in the traffic. If you're just trying to go to the movies in your hell cat and they jump on the scene you will automatically be assumed to be a part of the side show. I have no issue holding the offending cars as evidence but it could be taken out of hand.
