For positions where image isnt a factor I do believe your correct, however under some instances it is legal hire based on race/sex/appearance. I believe this mainly for actors. ie: if your making a movie where you want a specific race or gender its considered fine to "discriminate". I've heard of loans and awards available for doing this stuff as a company, but tbh I don't see how that would be worth it with the reputation damage and the amount of losses.
