No, actually he doesn't. If he was subpoenaed to testify as a witness he must answer the questions that are being asked of him. If he doesn't remember anything from 2013 then all he has to say is"I don't remember". I'm honestly surprised the Judge didn't find him in contempt of court for talking nonsensically.
