Ciarb's Roebuck Lecture, delivered by Dr Kabir Duggal C.Arb FCIArb, took place virtually and in-person, on 21 June 2023.
The topic was "International Arbitration Versus Human Rights, Armed Conflict, and the Environment: Why should I care?".
Safeguarding human rights, mitigating the impact of armed conflict, protecting the rule of law, and preserving our planet from climate change are among the most serious challenges facing the international legal community today. Against this backdrop, international arbitration, and investor-state arbitration in particular, has become our most prolific method of resolving international disputes. Consequentially, it represents our first, last, and sometimes only line of defence.
What role can international arbitration play in addressing these challenges? Does it help us to address the issues or does it actually make things worse? And, is international arbitration the only way or should we consider mediation and/or international adjudication? With the greatest challenges of the day requiring different legal principles and practices, are such complimentary dispute resolution mechanisms compatible?
The 2023 Roebuck Lecture explored how international arbitration can act as a good neighbour, supporting the aligned international law regimes in order to enable the international legal community to emerge stronger and promote a better legal regime for all.
