You're welcome, that's great to hear. I don't know when they will get around to fixing their issue. You aren't the first person to have this problem. You should see your rebate back in like 2-3 months.

Lol you're welcome I'm glad it was helpful! Did you claim your delayed occupancy compensation? Many units here are eligible for this as well. I just got my money as well which was just a bit over $7000.

Hi, thanks for uploading this video, it’s very helpful. I had most of this figured out but getting stuck in 2 places. 1. Mine was an assignment purchase - so do use the assignment agreement date or the date agreement was signed by original purchaser in date of purchase? 2. Again, being an assignment sale, the actual purchase price for me was different that what’s stated in the statement of adjustment (because the assignor sold it at a higher price), which one should I use in the rebate calculation form? Thanks in advance!

1. Use the original purchase date. The assignment has nothing to do with the rebate. 2. Use the price in the statement of adjustments which should be the original purchase price NOT the assignment price.

Hi Tim, thanks for the video! I find it very helpful. I purchased a Condo last year, I'm not sure on how to get the legal description of property from the deed as I have it showing more than 1 units. How do I go about that?

You're welcome. I personally don't think that your legal description is that critical. However, you can usually find your legal description at the top of your Statement of Adjustments from your lawyer. If you can't see this on there you can always contact your Realtor or your lawyer to ask them directly for this information. They should know where to find this.

Here is my situation - First and far most thanks for making this video. I am a first time home buyer, I purchased a condo in DT Toronto with an intention of investment. Now, my 1st question is: Will I get land transfer tax rebate? which is around $9K ? 2nd question is, Builder has added 24000 HST on the price. however when advertised price was 510K now its showing as 561K in SOA. Does this happens normally? Question 3: if i will buy any other property in Ontario with an intention to live as owner occupied will I be able to claim land transfer tax? please shed some light on my these 3 questions and suggest best possible solution. ?

You're welcome appreciate the comment. 1. You can only claim as a owner occupier. If you rent the property out you will not be eligible for the $8,475 rebate. Refer to www.toronto.ca/services-payments/property-taxes-utilities/municipal-land-transfer-tax-mltt/municipal-land-transfer-tax-mltt-rebate-opportunities/ 2. Yes this does happen a lot. You must have had a clause in your agreement that you were allowed to rent during interim occupancy. If this is the case the developer will claw back the rebate from you. You can claim this money back using the video you just watched. Also you must not have been aware of the additional development charges. If you watch my Investment tutorial I break down some of these costs for you. Many first time buyers are not aware that the actual purchase price is a lot higher than the sticker price. 3. No, you can ONLY claim the 1st time buyer land transfer tax on your 1st property purchase in your entire life in the the entire world. You MUST use this rebate on this property only or you will never be able to use this again. Although this is not recommended and illegal some people in your situation will move into the property on paper. Meaning that they'll change their driver's license & health card over into the new property. In addition, have their government mail like income taxes registered to the new property. Basically change all government issued mail to go to the new property. Then they will have an amazon package transferred to the property to prove that they live there. Also change all utilities and internet to be issued in the new property. Then they will privately find a tenant to move into the property and rent the property with the utilities and internet included for the 1st few months or until they get final closing. Then they will claim the 1st time buyer rebate get all their taxes back. Don't recommend that you do this as this is illegal. The other way to do this, is because the important thing is "intent" of your purchase. You move into the property for a few months, claim all your taxes back after final closing then you rent it out like 3 months after. You can give any number of reasons why you moved out but you need to be in there for a reasonable amount of time which is around 3-4 months according to a tax lawyer I spoke to before. The above information is what I've heard people doing so in order to ensure you're complying with the legal and tax code I recommend you speaking to a lawyer or tax accountant for your specific situation.

Hi Tim, Tim here too.. How exactly do you break down the 13% HST if the breakdown is not provided to me? Is it going to be 8% provincial and 5% fed just like the ones on your SOA?

You have the best name! Yes it's 8% for the Provincial and 5% for the Federal. For the Provincial rebate it's 75% of the Provincial portion up to a max of $24,000 and for the Federal rebate its 36% up to a max of $6,300 at $350,000 then it goes down on a straight line depreciation to $450,000 where it will be $0. So if your purchase price is above $450,000 then your rebate maxes out at $24,000. This is the NET purchase price not the actual purchase price as that includes the HST portion.

Hi Tim. I am applying for a condo purchased by my investment corporation. When I login to MyBusinessAccount I do not have the option to file the rebate form in the 'other service' sections. Where can i find it to file electronically? Thanks

I'll get back to you on this as I haven't done this with a corporation online before. You can do it manual but that's a bit more tedious.

I kept getting "This service is not available at this time. Please try again later." error message when submitting the form. Turns out it is because I use comma (Unit 123, 150 Logan Ave) instead of Hyphen (Unit 123 - 150 Logan Ave)

If you read the clients you can see that many people have faced the same issues. I don't know what is going on with the CRA but they obviously haven't figured out this issue. You just need to keep trying until it goes through. I've had other people have success by trying different computers and/or networks. Maybe it has something to do with your internet security? Are you using a VPN?

@@realestategame No I am not using VPN. I tried my work computer/network and personal computer and home network issue persist. I called the number in description they said they cannot assist with My account they are train only for Business account.

Yes it's for business accounts but that's what the HST rebate falls under. You need to speak to the HST department.

Hello Tim, thanks for this useful video. I purchased a condo townhome last year on assignment. Upon closing in August, my lawyer informs me that I need to pay $24,000 to the builder as part of the HST/GST rebate process and directs me to the CRA rental application. I'm the primary resident of this property so I found it strange that I was being of told to fill out the rental application (lawyer even shared your rental GST video with me as a guide for the application). Sure enough, CRA disallows my rebate and is now asking me to file a new one (Form GST 190) which pertains to primary residents. I just hope I can reclaim my $24,000 despite the delay. Appreciate your video in this tough time. Quick question: the APS for my property is between the builder and the original assignment owner. Should I still use their purchase sign date for the "Date Purchase Agreement was signed by both you and the builder" question? Thanks.

Th reason why you had to pay the $24,000 HST rebate to the developer was because it was an assignment. Developers these days will automatically claw back the HST if the property was sold on assignment. Your application was rejected because you probably used the wrong application because if you followed my HST rebate guide for investors, you'll need to show evidence that you rented the property out. If you follow this guide I made specific for owner occupiers you should be able to get your HST rebate back. In regards to your question, I would say yes you should use the same date as this is still the original date of the purchase of the property. You should also send in your assignment consent to show that the developer has consented to you becoming the new owner of the property. I've bought assignments before that I had to file this HST rebate for and I didn't send in my assignment agreement so I won't send this to them unless they specifically ask for it. I think you should be ok with the assignment consent only. Would be interested to see how it goes. I hope you can get your HST back quickly. I actually made this for one of my clients a few months ago and he told me he already got his HST rebate back. His HST was clawed back even though he was an owner occupier but he had a rental clause in his agreement so they automatically clawed back the HST from him.

You don't need to put this in unless you have an business number. Even if you do, just put no and if you do have one they'll just apply it automatically to there.

Yes you can but did you pay the HST as an owner occupier? If you did then you can claim it back if you didn't then I would still file the HST rebate only if you weren't a first time buyer. This gets a little more complicated if you were. Talk to a tax accountant that understands this stuff for further advice.

Hi Tim, I submitted my house HST rebate claim online successfully on Dec15, 2023 after watching your video and got the file confirmation number in the end. Today, Dec 27, I called CRA for status update and they don't even see my application submitted online. They were neither able to pull my application with the confirmation# nor with house address. They suggested mailing the application now. It is very strange that CRA doesn't see my file submitted online. Have you heard of this situation before?

No I've personally never had this happen to me before. Are you sure you called the right department? Did they give you a timeline usually on how long it takes for the application to show up on their system? Typically it takes about 2-3 months to get your rebate back so I'm assuming it's in the system but they just don't see it yet. Maybe give them another call and see if they have it before doing it manually. If I were you I'd just submit it online again. Did you call 1-800-959-5525 and speak to the HST department?

I just talked to CRA and she said that it could take up to 4-6 weeks to process. So they won't see it on their end.

@realestategame thank you. I called CRA again, and they advised me to wait another 2 weeks as there is no defined time to when the application will show up on the system. I find it strange as I submitted the application online, and it should reflect right away. Anyway, hopefully, in another 2 weeks, the application will show up at their end, and the processing time I understand is 4 to 6 weeks. Fingers Crossed 🤞

@@amansaini5725 Yes I asked them about this and they told me that's just the way it is. It should be going through the system so I'm sure it will show up if you received the confirmation so I wouldn't be too concerned about it. It takes about 2-3 months to get the money in your account.

No you don't. This form is a part of the online application. It will ask you near the end when they as you for the Ontario Rebate Calculation the Provincial Part of the HST.

Unfortunately, there's still no way to do this, even in 2024, despite the CRA having substantial funding from our tax dollars. My advice is to call CRA first thing in the morning like before 8AM to talk to them on the status of your application.

Hi Tim again! I tried to submit but the same comment popped up "this service is not available at this time, try again later." I tried with different devices yet with different networks but I have been failing to submit it. I have a question. Under the supporting document section, I can see requesting comment which is that complet GST190 Ontario Rebate Schedule. Do I have to do it. if so, I need a help to fill it up.

Yes they do. They get land transfer rebate up to $8950. Also this rebate is for everyone who is eligible.
