The plaintiff says his son was hit by a car while riding his bicycle. The defendant, who drove the car, is ignoring the plaintiff’s requests to pay for the medical bills, so now he’s suing the driver for the costs. The defendant says the plaintiff’s son went through a stop sign without stopping and wasn’t even wearing a helmet. Bottom line, she says she did nothing wrong.

Like my dad taught me when I first started driving. “Don’t drive for yourself drive for others” it’s true cuz u have to look out for other drivers or motorists while driving

I like the defendant. She was very calm, caring, and didn’t have a reason to lie about anything. Even the young man owned up to his mistake. Just a young kid that made a mistake and hopefully learns from it.

she was very condescending and no way a cop saw it from so far away he asked her what happened and wrote it down she wasn't to sure about the cameras thats why she called her brother he assumed that she was giving him leeway when he looked at her but she probably was not paying attention he was at fault but u always have to pay attention to people and kids and be ready to stop

"Owned up to his mistake" is an odd way of saying he completely lied about the entire situation. Enough to have his mom call the defendant up and make crazy threats and for this to eventually make its way to COURT. Kid didnt own up to anything - he was forced to tell the truth when undisputable visual evidence was produced to the judge and he was confronted with it.

They didn't make a mistake, he was a wreckless driver and not only caused damage to the woman's vehicle without apology, but even dragged the woman to court.

Sounds like kid has been lying to parents the entire time and the parents went overboard and exaggerated his lies. He got nervous being in court and getting interrogated by the judge so he finally fessed up. His face says it all that he knows he’s in HUGE trouble when he gets home!

I'm so glad the father accepted that his son was in the wrong and didn't go along with the initial version his son had told him. ALWAYS look both ways, as sometime the police or ambulances or someone lost, might be coming down a one-way street the wrong way...

The defendant compassion and concern, even after the verdict, was so admirable. 🥰🥰🥰 I loved how complimentary she was towards the boys, regarding their demeanor at the scene of the accident. Kudos to her🙌🏾🙌🏾🙌🏾

Sorry Harv, have to disagree. I *ALWAYS* look both ways. You never know if there's someone from out of town, or just an idiot, who might be going the wrong way down a one-way street. I've had it happen. 🚗

Yes, I would agree but he was talking in context of "negligence". It wasn't on the onus of the driver to be on the lookout for someone going the wrong way... Glad you're vigilent. :) Stay safe.

@fractode I have as well. I have seen plenty of drivers drive the wrong way on one way streets. Also, in DC, some of the primary streets, change direction during rush hours. People drive in the wrong lanes all the time.

I went the wrong way down a one way street while on vacation just a month ago. It is not hard to do if you are new to an area. I blamed the GPS but it was probably my fault.

@@jonguyton1 Did the same thing in a new area with no clear signs. Thankfully it was a residential area which kept my speed low and the guy I eventually met coming the other way told me kindly that it was a one-way and not to feel bad about it because it happened regularly with out-of-towners. Still felt bad about it though.

You need to teach your kids honesty and the fact that this man did not want to admit his kid was lying to his face is his fault. Parents need to teach children to have respect for society!

Parents also don’t want to believe that their children will lie to get out of trouble. Instead of researching and investigating the issue, they just believe in a very biased and one sided story. Parents will fight tooth and nail in support of their child, but when all is said and done, and the child is caught lying, a parent will offer a simple apology. The problem is, the parent spent months, if not years trying to make the other party look bad, and discredit everything they said, but will only take a few seconds to apologize, and be done with everything. Parents need to “Parent” and discipline more, while gathering all of the non biased facts, instead of being one sided. Teach your kids responsibility, instead of always defending their bad actions. We were all teenagers at some point, and we’ve all told white lies, if not more. We know that when the story gets going, it can quickly spiral out of control, and involve innocent parties. Parents need to have discipline for their children, along with love and moral support. The youth would be in a much better place today, and feel far less entitled to everything, if parents had better parenting skills at home. Get to the truth of a situation, not just the words coming out of your kids mouth. Yes, it’s hard, but it needs to be done.

@@Trich-nf2zf the kid confirmed that the police report was accurate. The defendant never said her brother was a cop in the same town. There’s no reason to assume the cop pulled anything shady here.

As soon as kid opened his mouth, I knew he was lying. He couldn't even give the Judge a straight answer about where his bike was.

Glad the kid is ok. Cyclists have to follow the same traffic laws as automobiles do. The kid didn’t know How many stop signs were at the intersection. I hope this is a lesson learned….coulda been much worse.

it's disappointing that this wasn't explained. This father has no clue that his son on a bike is not a pedestrian. But a lot of parents be telling their kids to purposely ride against traffic, which clearly only works if you get off your bike and walk through intersections, but no kids gonna do that.

No they dont! Dont know where you get that nonsense from but a cyclist is not a vehicle and being that he was hit at a four way stop, he had the right of way as a pedestrian . Maybe you need to learn the laws. Now, I have seen this judge do some wild things because this isnt real court and is arbitration so she doesnt have to use the laws in deciding her case . She tries to use the laws as a crutch in some cases but this is not court. If the dad was smart, he would have found him the most useless lawyer on the planet and would have forced her insurance to pay for all his care with non deductible . I too was hit off a bike in a simlar situation and I know I got 20k out of it and my lawyer got 10k. Pedestrians always have the right of way at a four way stop and a cyclist is not bound by any stop sign or road code

Wondered if anyone else heard that! Maybe that's why the kid changed his story a bunch of times, trying not to get in trouble... I feel bad for the kid, he gets hit by a car and dragged into court by his dad and trying to answer all these questions. That's hard at 16.

I think the kid was "dead" for lying to his dad in the first place. The brother who was there is gonna get it, too, because he backed up the story. I don't see any nefarious ploy by the father. They were suing for $238.88 - that's hardly a "scheme" or money grab. I honestly think dad believed his son, and was teaching him to stand up for what's right by utilizing the legal system.

He was clearly losing the case. The son had lost almost all credibility because he was inconsistent with his testimony about which street he was going down. The father was desperate for anything to make the defendant look unreliable.

As someone who used to ride her bike everywhere, I was not aware that bicyclists had to follow the same rules of the road as motorists until later on in my life. I didn’t even know that cyclists weren’t allowed to ride on the sidewalk. It should be taught in schools from a young age the laws of cycling.

You’re always meant to look in all directions while driving- period. The son was confused and probably couldn’t remember the details. She still wasn’t at fault so that’s the end of it.

Play the system? For $200 something dollars? I highly doubt it. I think this case was bought to court on principle alone. The parents really thought it was the defendant’s fault based off the testimony that was given to them by their son. Yes, the son was wrong about his placement during the accident but they could only believe what they were told

The father should've visited the accident site with his son to go over what happened as well as checked the police report more thoroughly against what his son was saying. They still would've lost their case but wouldn't have looked confused doing so. Always come prepared to court with a clear understanding of what happened.

They sued for 200 odd bucks, hardly money grabbers. Money grabbers normally sue for the maximum or silly pain and suffering, which they didn't. They deserved to lose the case because it seemed the kid was at fault, they really should have gone over what really happened before suing.

I want to be friends with the defendant. Level-headed and said good things about the kids, despite having been inconvenienced in effort & time, including arranging care for her infant (take note: the dynamic of mother & infant is not the same as an employee missing work). I would be upset in her situation. I hope this teenager learns his lesson.

there isn't going to be a stop sign for the kid if he's traveling against traffic, so I don't see his Dad's argument making sense ever, even if there was a stop sign on the street the kid was on, that's why the kid didn't see a stop sign!

It may not be a four way stop sign though. In my state, sometimes there is a stop sign for one side but not the other.

I usually just listen to the audio of these episodes while I do other things like housework but I had to stop and watch it so I could understand! The plaintiffs were too confused about directions

I do the exact same thing! I love listening to PC on my trip to and from work each day.. but sometimes you just need to see the people's expressions/mannerisms to fully get the picture.

This case by far was the easiest to figure out. I knew that when the defendant had a chance to speak and explain the situation clearly, it made so much sense especially with the sufficient evidence she had. The police report and the diagram of the road from how she described it exactly beat everything in the case. I’m glad that this case is over and taught us a lesson to understand and remember: always be aware of your surroundings and stay alert.

I want this lady as my neighbor. Good hearted, logical, doesn't get too much into her petty emotions, looks out for people. She is a rock star. The dad needs to calm the fuck down. He is a karen.

Bikes are legally vehicles and thus are to follow traffic laws. His vehicle was going the wrong way down a one way street and failed to yield the right of way. He's in the wrong

I have a random question and comment if you have an answer but does anybody ever remember being taught that if you’re walking or riding a bicycle you should always go in the opposite direction of traffic?

That's true for walking, but NOT for riding a bike. Bicycles are vehicles so they should go WITH the traffic.

Also, even if it's a one way you should always look both ways! Just because a car isn't supposed to come that way doesn't mean there isn't a bike, pedestrian, or animal that is!

No, it's not legally negligent to not do it....but it's a very good thing to do, for everyone's safety. Try to calm down, and raise your blood pressure. It's the easiest way to have a stroke. That's one thing I admire of the Defendant. She came in and explained her case in a very calm way. She didn't get worked up in any way. She knew that she had done the right thing. Blessings!!!

I think the young man was either confused about the details or in an attempt not to get in trouble changed the facts to look better on himself. The father and defendant both seemed like really good people. Glad no one was seriously injured and the damages were minimal.

@Jeffrey Berry I would have liked to have seen the father face the music sooner that his son was being dishonest. The dad for the longest was not trying to be objective, you could tell his mind was made up to believe his son’s story until after the verdict. It is okay to admit that your child is lying, acknowledge it & keep guiding them

Kid was definitely lying. When he first told the story he switched places with the defendant, putting himself on the road with the right of way and the defendant on the road with the stop.

Since he doesn't know if he saw stop signs or not' maybe he just wasn't paying attention like most young people who drive, and I look to make sure everyone is going the right way because people do go down one way streets the wrong way, I can't believe Harvey said that

It's good that you do look both ways, but it's not a legal requirement on a one-way street. You have a reasonable expectation that folks will obey the traffic laws and not be morons. Sadly, there's a lot of morons out there.

He's talking legally though. If there's an accident with someone going the wrong way, you wouldn't legally be a fault like you would if someone was going the right way. Likewise, any accident is legally the fault of people running the red light

He first said he was riding on the sidewalk. As it turns out he was riding the wrong way in the middle of the street. The judge got pissed when she realized they were lying.

Either the child was legitimately confused about where he was riding or it's like the defendant said and he didn't want to get in trouble with his mom if he told the truth. The defendant is pretty credible. The dad looked embarrassed in the end because I think he just took his son's word, but it happens.We assume our child wouldn't lie about something so major. Thankfully everyone is safe.

So odd how I had this same scenario happen to me - and same color dynamics. Kid lied to parents in the same way, they not having the true story came to my house and started screaming at me without even knowing if I was involved. So is this now how people handle their kid lying about being harmed by a white person? That's concerning.

Any parent would tell their kid to be more careful after an accident, so no, it doesn't mean they knew from the get go. However they should have known before going to court.

I always look both ways. I guess Harvey has never seen emergency vehicles coming the wrong way on a one way street. Or kids on bikes. Or people who are disoriented because they are unfamiliar with the area, or pedestrians, or a number of other reasons.

Yes, it's prudent to do so, but you are not obligated to do so by the law, and therefore not responsible for detecting wrong way traffic. I think that's what he's getting at.

I don't know about anyone else here, but I remember "not telling the whole truth" about something out of fear of getting in trouble. So too bad this good kid had to learn this lesson the hard way and in public. But we all had to learn that lesson. Fantastic that the situation was with a kind and reasonable woman who kindly let him learn his lesson without further embarrassment or blowing it up in another way. All's well that ends well. Lesson learned. (I hope)

The kid was in the wrong for going in the wrong direction on a one way street. Also, yes you should always look in all directions to make sure no one is traveling in the wrong direction. Never assume that people are always going to do what they're supposed to do.

Teenagers lying so they don't get in trouble with their parents. I remember those were the good old days. I'm in my early 40s now, and in the recent years I told both my parents about some of the things I lied about. I waited until I was much older cause they can't do anything about it now except shake their head, LOL.

Harvey, the street I live on is one-way. I only cross at the light, but believe me, you absolutely have to look, since people go the wrong way all the time!!

This is why in Oregon bicyclists have the right away at all times. They just recently put into effect that riders don’t even need to come to a complete stop. They are now allowed to slow down to a “safe speed”, check for oncoming traffic & continue to go without actually having to stop. I honestly HATE it bc it’s basically taking away the he said/she said, so if someone just rides through without actually paying attention & gets clipped, it’s the drivers fault bc the biker had the right away vs the car. Thanks a lot Kate Brown (Oregons BIGGEST mistake).

If I was going into court w my son, I would have definitely made sure I had my ducks in a row and even visited the accident site. Come on. Had the nerve to sue the person who wasn’t at fault? This is why you have to have video and everything on your side because these people will leave the location and change up the entire story on you. Never trust them.
