It's fun watching, er, rewatching this video a year and a half after the fact. Your summation at the 24, 25 minute mark is perfect. The more you set yourself up for the split sleeper provision the better. You don't have* to take it, but it's great when it's available. A nuance that you didn't explicitly state: a reminder that the "short" split has to be not just off Duty OR Sleeper, it can be "or any combination thereof." [395.1(1)(ii)(A)(2)] PC counts as part of this, since it is Off Duty

I've always found the split sleeper provision helpful. But not having the shorter break count against the 14 has been a game-changer. I'm also happy to say my ELD provider got it right from the start. We get an audible warning that we are about to run out of time on our original 14. For example, if I start at 5 am, take a 2-hour break from 9-11 am, at 6pm my tablet warns me I've got 60 minutes remaining. But my digital display shows I still have 3 hours. The difference, I know, is that those last two hours are dependent on me pairing with a sleeper break of at least 8 hours. I can ignore the audible warnings as long as I log sleeper at the end of the shift. You did a great job explaining it. Thanks for the good work.

Mike, just a tiny FYI for others on your excellent comment:. My ELD (Keep Trucking [now Motive] for Android) allows you to change the warning setting to one hour, 30 min, 15 min or OFF, also toggle the sound off if you wish.

Do you have citation that yard move can be used at a truck stop? I’ve been seeing it’s only allowed on property not granted to the public. Like a warehouse or company yard. Truck stop is accessible to the public.

The FM CSA does not officially say what constitutes a yard. And yes the public has access to truckstops but they are designated to go to separate areas cars are only allowed in the front section trucks are allowed in the back section there may or may not be signs saying so but because there are two separate areas for the two different types of vehicles in my opinion that means you can use a yard move at a truckstop and like I said FM CSA does not officially designate what a yard is

Hey. Love your videos. Question regarding yard move. In your video u said a yard move can be made in a truck stop because it is a private parking lot. I've been doing this for two days now but my company changed it all to drive. He said I can not use yard move in a truck stop. Only a customer. Please help me fight this.

Here’s what’s I found. “FMCSA does not yet have a formal definition for a yard. CVSA, on December 4, 2019, requested that FMCSA provide a definition of a yard to reduce compliance confusion. In the absence of and until there is a formal definition from FMCSA, you likely need to have guidance that helps you avoid compliance problems.” Therefore, if someone is telling you it only applies to your company yard or a distribution center. Then they’re wrong. The FMCSA does not specify. So, in my opinion, any private, non-public highway can be considered a “yard.” Hope that helps

There's no fighting it. As long as your company's policy is not less restrictive than FMCSA, they can set rules on where you can use YM and PC.

Can you please tell me what is allowed as far as HOS go once you restart a clock after more than two hours and return to the home terminal when yard moves, post trip and possible PC to go to park and go to sleeper or off duty. Our ELD provider is violating me even though I had several hours left On Duty. Can I take a 10 hour break instead of sleeper Berth time if I am at my residence off duty? Thanks

Unfortunately many ELD providers don’t have everything right. Yep hours off duty should always stop your 14. As long as it’s paired with at least 8 hours on sleeper later. And after leaving terminal you can use pc to go park somewhere. Also you can always do 10 off to get a reset of your 14 and 11

Does my clock only stop if I also take the remaining hours to make up the 10 later to comply with split sleeper berth rules?

Yes and no. If you take at least two hours off or in the sleeper berth it does stop your 14 hour clock however the assumption is you will be pairing that with at least eight hours or seven hours which ever you need to total 10 hours for a total of two breaks total 10 hours. The good part is you can take a 2 to 3 hour break or even more and then later on take at least seven or whatever to qualify for your 10 but if you wanted to do a full 10 for the second break then you’d have a full reset after that and you were able to stop your clock earlier in the day to help you out

Still learning to master the split breaking method. Question, you had the longer 7 plus hour break in sleeper and took the shorter 2 plus hour break which stopped the 14. Then before you took another 7 plus in sleeper you took a 2nd break of 2 plus hours which to my understanding ...stopped the 14 hour clock again. That's my question .. Can you stop the 14 hour clock more than once?

I had a similar day were I drove 45 min to pickup a load, got 4.45 hours on the sleeper berth than drove another 2.55 hours to another location and take 2.15 hours on the sleeper berth than drive 1 more hours, toke 30 min off than drove another 1.15 hours toke 15 min off and drove for 2.42 hours before taking 10 hours off. For some reason the elog says that I'm in violation of the 14 hours ? Any thoughts about this?

I have to bob tail 6 hours to pickup a trailer if after I hook up the trailer could I take 2or3 hours in sleeper berth and then drive another 6 hours back using the spilt sleeper berth?

No. Because you would be over your 11 hours of driving. You could do 2 to 3 hours after picking up trailer. But would be limited to only 5 hours back before you need to do at least 7 in sleeper to get more hours. Hope that helps

Adverse conditions gives u two extra hours of driving, and two extra hours on your 14. So you’re limited to how far you can drive in those two extra hours

Yes. The only thing that does not count against your 70 is your off-duty or sleeper berth time all on duty and driving time counts ‘gainst your 70 hour week

Don't forget you can always WORK after your 70 is up, just not DRIVE. I.E. you work at a warehouse and sometimes fill in driving. You could forklift for 12 hrs a day for five days, drive 10 hours the next day. That's 70 hours in six days. The seventh day you can't drive, but you could still forklift, work in the shop, paperwork, whatever, just not operate a CMV on the road.

What the ELD providers need to do is simple.. Allow the short break, if taken first, to extend your 14. If at the end of the day, when you sign and verify your logs, you do not have a corresponding long break to equal 10 hrs the ELD flags the violation. It seems like n easy software update. I just did your day as presented on the Big Road app and it put me in violation at original end of your day, not extending the 14 to allow for the short break. Its a problem across the board for ELD providers. Demand a refund!

CT...You are correct if there is a fence, gate, or sign (this does not inclde no trespassing signs) not allowing 4-wheelers. Otherwise, the area is deemed open to public travel...including campers/motor homes.

That's my understanding as well. It may be a gray area with FMCSA but my company (Werner) will only allow yard move at shipper, consignee, terminal or drop yard. And you have to indicate which you are at when you activate it. If they caught me using it at a truck stop it would activate a violation from the company even if it weren't one per FMCSA. That said, you are right, there's no excuse for doing a 30 at the fuel island anymore (there never was). Usually, I have to wait for a pump 10 minutes, 10 minutes fueling, then pull up and 10 minutes inside using the bathroom, getting food etc. As long as I keep the truck under 5 mph when I'm pulling up, I'm not thrown on line 3, and that whole 30 counts.

@@Gary-ld6ht Having said that I think FMCSA *should allow yard move at a truck stop. If you go on line 4 to scale, you shouldn't have go back to line 3 to pull off the scale, slide your tandems, and go back and reweigh. You should be able to stay on line 4 the whole time, but that's not how it is. I just stay on line 3 to scale, it's not worth the hassle. As long as you don't scale on lines 1 or 2 should be fine.

I just usually show sleeper berth as opposed to off duty. There is no limit or restrictions on how long you can be in sleeper. If you’re using it as the bigger of two breaks for a split, it must be at least 7 hours

I started a new trip and did 6 hrs of driving then took 7 hours in the sleeper. Then I drove another 5 hours and took 3 hours off duty. Was that legal ???

I'm liking your videos with great info, but do see one difference. Yard moves cannot be used at a truckstop. It is only to be used on private property where the general public is not allowed, such as shippers and receivers with a gate.

The FMCSA. Has never stated what a “yard” is. The quote u mentioned is the CSA’s interpretation. It’s not really clear. I say cars aren’t really allowed in the sections of truck stops where the trucks are. Just like we can’t park our trucks in the car section. Until the FMCSA clearly defines what a yard is, I say it’s up to interpretation.

I was going to opine on this thought too. My boss told me to use YM only at shippers and receivers because he is probably going off this same guidance. However, I use YM all the time at our home base (small company, twenty trucks, office, full shop, fuel tank, drop trailers, etc) because quite literally we all refer to the place as ....... the yard. 🤣 Clutch, in the future you might address the fact that carriers can, and sometimes do, disable the YM and/or PC function on their ELD system to drivers. To me that's insane, should be completely disallowed, and probably contributes to unnecessary violations,low scores, driver turnover, etc. SMH!

Driving truck is not a mechanical but biological process thus HOS can not dictate when I have to be tired and when I have to drive. The HOS as is now it's a wrong approach to the safety of the roads. The statistic of the fatalities on the roads is proof of it.
