रेग्यूलेशन 121. भूमिगत खान में सीमाओं के नजदीक आयतन चलाना (Working mear mine boundaries in belowground mines)-
(1) प्रत्येक खान का मालिक, एजेंट या मैनेजर खान की सीमाएं (mine boundaries) निश्चित (fixed) रखेगा, और सब रेग्यूलेशन (2) में किसी बात के होते हुए भी, चीफ इंस्पेक्टर की स्पष्ट लिखित अनुमति (जिस पर उसमें वर्णित शर्तें लागू होंगी) के बिना ये सीमाएं बदली नहीं जाएंगी।
(2)विनियम 111 के उप-विनियम (4) के तहत तालिका के कॉलम (5) में निर्दिष्ट किसी भी खदान की सीमा की सीम की गहराई के अनुरूप आधी दूरी के बराबर दूरी के भीतर कोई कार्य नहीं किया जाएगा।
2) खान की सीमा के अंदर रेग्यूलेशन 111(4) की तालिका के कॉलम (5) में उस सीम की गहराई के अनुरूप (जिसमें कार्य किया जा रहा हो), दी गई दूरी के अंदर कोई खनन स्थल नहीं चलाया जाएगा। यदि खान की सीमा के बारे में विवाद (dispute) है, तो बगल की खान के
मालिक द्वारा दावाकृत सीमा (claimed boundary) से उपयुक्त दूरी के भीतर कोई खनन स्थल
तब तक नहीं चलाया जाएगा जब तक कि सीमा के बारे में कोई बाध्यकारी समझौता (binding
agreement) न हो जाए, या विवाद किसी न्यायालय द्वारा अंतिम रूप से तय न कर लिया जाए।
परंतु, जहां एक से अधिक सीमों में कार्य किया जाता है, वहां सीमा पर छोड़ा गया बैरियर, जहां तक व्यावहारिक हो, एक दूसरे के ऊपर और समान मोटाई का होगा।
परंतु यह और कि, जहां किसी सीम के आयतन किसी भी कारणवश सीमा से उपरोक्त दूरी के अंदर बढ़ गए हों या बढ़ा दिए गए हों, वहां चीफ इंस्पेक्टर खान के मालिक को लिखित आदेश दे सकेगा कि उसके द्वारा बताए गए संरक्षात्मक कार्य (protective works) अमुक समय के भीतर पूरे कर लिए जाएं।
(3) सब-रेग्यूलेशन (2) में किसी बात के होते हुए भी, चीफ इंस्पेक्टर लिखित आदेश द्वारा (उसमें लिखी शर्तों पर) किसी खान या उसके भाग में आयतनों को सब-रेग्यूलेशन (2) में बताई गई दूरी से भिन्न दूरी तक बढ़ाने की अनुमति दे सकेगा या उसे सीमित रखने की अपेक्षा कर सकेगा।
Regulation 121. Working near mine boundaries in belowground mines -
(1) The owner, agent or manager of every mine shall keep the boundaries of the mine fixed and, notwithstanding anything contained in sub-regulation (2), shall, subject to the express written permission of the Chief Inspector These limits will not be changed unless otherwise applicable).
(2)No working shall be made within a distance equal to half the distance as specified in column (5) of table under sub-regulation (4) of regulation 111, corresponding to the depth of the seam being worked, of the boundary of any mine
(2) Within the limits of the Ban, no mining site shall be operated within the distance given in column (5) of the Table of Regulation 111(4), corresponding to the depth of the mine (in which the work is being carried out). If there is a dispute as to the boundary of a mine, no mining site shall be carried on within a reasonable distance of the claimed boundary by the owner of an adjacent mine unless a binding agreement is reached as to the boundary. A binding agreement may not be reached, or the dispute may not be finally decided by a court.
Provided that, where work is carried out in more than one seam, the barrier left at the boundary shall, so far as practicable, be one above the other and of uniform thickness.
Provided further that where, for any reason, the volume of any seam exceeds the distance above the boundary
Where these limits have been exceeded or increased within a certain period, the Chief Inspector may issue a written order to the owner of the mine that the protective works specified by him should be completed within a certain time.
(3) Notwithstanding anything contained in sub-regulation (2), the Chief Inspector may, by order in writing (subject to such conditions as may be prescribed) limit the quantities in any mine or part thereof to a distance other than that specified in sub-regulation (2).
