रेग्यूलेशन 122. ओपनकास्ट खान में सीमा के नजदीक आयतन चलाना (Working near mine boundaries in opencast mines)-
(1) प्रत्येक ओपनकास्ट माइन का मालिक, एजेंट या मैनेजर माइन की सीमाएं निश्चित (fixed) रखेगा। सब-रेग्यूलेशन (2) में किसी बात के होते हुए भी, चीफ इंस्पेक्टर की लिखित अनुमति के बिना (जिस पर उसमें वर्णित शर्तें लागू होंगी) ये सीमाएं बदली नहीं जाएंगी।
परंतु यदि किसी माइन में दो या दो से अधिक पृथक उत्खनन (separate excavations) हैं तथा चीफ इंस्पेक्टर की राय में वे एक दूसरे के इतने करीब नहीं हैं कि एक ही मैनेजर द्वारा दैनिक व्यक्तिगत सुपरवीजन किया जा सके, तो चीफ इंस्पेक्टर लिखित आदेश द्वारा उस माइन को दो पृथक माइंस में बांटने की अपेक्षा कर सकेगा।
(2) माइन की सीमा के 7.5m के भीतर कोई भी खनन स्थल नहीं चलाया जाएमा । यदि माइन की सीमा के बारे में कोई विवाद हो, तो बगल की माइन के मालिक द्वारा दावाकृत (सही मानी जाने वाली) सीमा के 7.5m के भीतर कोई खनन स्थल तब तक नहीं चलाया जाएगा जब तक कि सीमा के बारे में कोई बाध्यकारी समझौता (binding agreement) न हो जाए या वह विवाद किसी न्यायालय द्वारा अंतिम रूप से तय न कर लिया जाए।
परंतु, जहां किसी माइन के खनन स्थल का विस्तार किसी भी कारणवश सीमा से उपरोक्त दूरी के अंदर बढ़ गया हो या बढ़ा दिया गया हो, वहां चीफ इंस्पेक्टर मालिक को यह आदेश दे सकेगा कि उसके द्वारा बताए गए संरक्षात्मक कार्य अमुक समय के भीतर कर लिए जाएं।
(3) सब-रेग्यूलेशन (2) में किसी बात के होते हुए भी, चीफ इंस्पेक्टर लिखित आदेश द्वारा, उसमें दी शर्तों पर, किसी माइन या उसके भाग में खनन स्थल को बताई गई दूरी से भिन्न दूरी तक बढ़ाने की अनुमति दे सकेगा, अथवा उसे सीमित रखने की अपेक्षा कर सकेगा।
Regulation 122. Working near mine boundaries in opencast mines.
(1) The owner, agent or manager of every opencast mine shall keep the boundaries of the mine fixed. Notwithstanding anything contained in sub-regulation (2), these limits shall not be altered except with the permission in writing of the Chief Inspector (subject to the conditions mentioned therein).
Provided that if in any mine there are two or more separate excavations and in the opinion of the Chief Inspector they are not so close to each other as to permit daily personal supervision by the same manager, the Chief Inspector may, by order in writing, May expect to split the mine into two separate mines.
(2) No mining site shall be operated within 7.5m of the boundary of the mine. If there is a dispute as to the boundary of a mine, no mining site shall be conducted within 7.5m of the boundary claimed (perceived to be true) by the owner of an adjacent mine unless there is a binding agreement as to the boundary ( binding agreement) or the dispute is not finally decided by a court.
Provided that where the extent of the mining site of any mine has for any reason increased or increased within the aforesaid distance from the limit, the Chief Inspector may order the owner to carry out within such time as may be prescribed such protective works as may be prescribed by him. Go.
(3) Notwithstanding anything contained in sub-regulation (2), the Chief Inspector may, by order in writing, subject to the conditions specified therein, permit the extension of the mining site of any mine or part thereof to a distance other than that specified, Or can expect to keep it limited.
