रेग्यूलेशन 251. दुर्घटना की जगह पर फेर-बदल की मनाही (Place of accident not to be disturbed)-
(1) जब भी खान में या उसके आसपास कोई दुर्घटना हो जाती है, जिससे कोई व्यक्ति मर जाता है या उसे गंभीर शारीरिक चोट (serious bodily injury) लगती है, तो दुर्घटना की जगह में चीफ इंस्पेक्टर या इंस्पेक्टर [जिसे दुर्घटना की सूचना ऐक्ट के सेक्शन 23(1) के अधीन दी जाती है] के आने से पूर्व या उसकी सहमति के बिना कोई फेर-बदल या परिवर्तन नहीं किया जाएगा। जब ऐसा फेर-बदल या परिवर्तन और अधिक (further) दुर्घटना रोकने के लिए या मृतकों के शवों को हटाने के लिए या किसी व्यक्ति को खतरे से बचाने (rescue) के लिए जरूरी
हो या जब दुर्घटना स्थल पर काम बंद कर दिए जाने के कारण खान चलाने में गंभीर रूप से अड़चन पड़ती हो, तब ऐसा आवश्यक फेर-बदल या परिवर्तन किया जा सकता है।
चरंतु, यदि चीफ इंस्पेक्टर या इंस्पेक्टर दुर्घटना के 72 घंटे के भीतर उस जगह की जांच या निरीक्षण न करे, तो दुर्घटना की जगह पर काम फिर शुरू किया जा सकेगा।
(2) यदि किसी कारणवश किसी घातक (fatal) या गंभीर दुर्घटना (serious accident) वाले स्थान में कोई फेर-बदल या परिवर्तन करना जरूरी हो जाए, तो वैसा करने के पूर्व दुर्घटना व सभी संबंधित ब्योरे को दिखाने वाला एक रेखाचित्र (sketch) दो प्रतियों में तैयार किया जाएगा। ऐसे रेखाचित्र पर मैनेजर या असिस्टेंट मैनेजर, सेफ्टी ऑफिसर, सर्वेयर और वर्कमेंस इंस्पेक्टर, या जहां कोई वर्कमेंस इंस्पेक्टर नहीं है, वहां दुर्घटना स्थल पर मौजूद किसी भी कामगार (workman) से हस्ताक्षर कराया जाएगा। उसके समर्थन (support) के लिए दुर्घटना-स्थल के फोटो (photographs) भी लिए जाएंगे।
परंतु, रेखाचित्र तैयार करने के पूर्व यदि स्थल को आगे और दुर्घटना (further accident)
रोकने के लिए या किसी व्यक्ति के रेसक्यू के लिए कोई फेर-बदल या परिवर्तन किया जाता है, तब ऐसा करने के तुरंत बाद दुर्घटना की जगह में फेर-बदल या परिवर्तन करने के पूर्व की स्थिति दिखाने वाला रेखाचित्र सभी वर्णन के साथ तैयार किया जाएगा।
(3) एक प्रमाणित (certified) रेखाचित्र संबंधित इंस्पेक्टर को दिया जाएगा या भेजा जाएगा।
Regulation 251. Prohibition of alteration at the place of accident (Place of accident not to be disturbed)-
(1) Whenever any accident occurs in or about a mine resulting in death or serious bodily injury to any person, at the place of the accident the Chief Inspector or Inspector [to whom notice of the accident is given under the Act Provided under section 23(1) of the Act] no alteration or alteration shall be made before or without the consent of the When such alteration or alteration is necessary to prevent further accident or to remove the bodies of the dead or to rescue any person from danger.
or when the operation of the mine is seriously hampered due to stoppage of work at the accident site, then such necessary alteration or change may be made.
Provided that, if the Chief Inspector or Inspector does not examine or inspect the site within 72 hours of the accident, work may be resumed at the site of the accident.
(2) If for any reason it becomes necessary to make any alteration or change at the scene of a fatal or serious accident, then before doing so, a sketch showing the accident and all related details. Will be prepared in duplicate. Such drawing shall be signed by the Manager or Assistant Manager, Safety Officer, Surveyor and Workmen's Inspector, or where there is no Workmen's Inspector, by any workman present at the site of the accident. Photographs of the accident site will also be taken to support the same.
However, if the site is subject to further accident before preparing the sketch,
Where any alteration or alteration is made for the purpose of stopping or for the rescue of any person, there shall be prepared immediately after doing so a drawing showing the condition of the place of accident before the alteration or alteration was made with all descriptions .
(3) A certified drawing shall be given or sent to the Inspector concerned.
