I have a DC collector calling me now. They are offering a settlement of 50%, but will NOT give it to me in writing. I told them too bad, you get NOTHING until I see it in writing!

Dodder what is the mathematical formula for getting the amount on the dollar ?Ex. 10 cents on the dollar or like 20cents on the dollar.

Dodder ok you have answered some ok my question but did you divide $1000 by 10% to get your answer? Like if an account is $29,000 and you pay 5cent on the dollar how do you get the answer?

I was once in debt past my eyeballs. The collectors were as relentless as it was humanly possible to be. I certainly understood that I owed the money and that was why they were calling. But, what I didn't get was why they would turn around and call back 5 minutes later. If I didn't have the money at 7:00 PM, then I still was not going to have it at 7:05 PM. When they would start up with their screaming, I would scream back at them "NOTHING HAS CHANGED IN FIVE FREAKING MINUTES!!". I did eventually get settled up with them. So glad that those dark days are dead and buried.

The magic words for a settlement in writing are "Settled in full without further recourse." Also, plan for a 1099-C coming in the mail from the creditor the following January because cancelled debt is taxable income.

I got hurt at work and the ambulance was $2200. my case worker said don’t pay it. So a collector started calling me and I kept telling him it happened at work. After about 20 calls I started answering the phone by saying the case workers name and phone number and hanging up.

Here is a tip, and it's law: Tell the agency that the only way they can contact you is by postal mail.

THIS! I wish Dave wouldn't advise his listeners to engage debt collectors over the phone. It's what they do for a living. Send them a registered letter telling them you will only negotiate by mail and they are never to call you. The FDCPA allows you that right!

I was 3 months late in payments with a card for $10,000.00. They never notified me by mail or phone call. However the first phone call I did receive was from a collations telling me they were suing me. I pleaded with the card company telling them that I was expecting some money and that I would give them 5000 and continue with the payments, they said it was out of their hands. From 10,000 down to 3,000 in about a year, I think that’s pretty good. On my way out of debt.

They will sue on ANY amount. My husband had a credit card that he maxed out when we struggled with health issues and paying rent. It was $2000 and they sued. Now we have auto payments being taken out weekly per court order. So stupid. Communication people!

This is dependent on the cc company. Many cc companies will not pursue on a low amount, however, some will such as capital one.

People if you ever receive a summons or get served make "SURE YOU GO TO COURT"! You do not want a default judgement enter they are very expensive and hard to get overturned if you can? Most city's offer low cost or free legal help please avail yourself of this if needed.

It doesn't matter if you go to court or not the judge will still enter a judgment against you. Going to court is wasting time & extra money unless you can prove you don't owe it!

This is crazy. my wife got sued by an attorney representing Capital One. The original debt with all the Nicki fees and interest charges was 4000. It was a 4 year old debt they sued her six months before the statute of limitations. there was a court date. one week before the court date they offered 3000, we countered for 2,000 cash. they accepted it in writing. we went to court and the person representing the plaintiff in court said that they were not authorized to take our certified check and the judge did a motion for an osc dismissal Hearing in 90 days. this is nuts, she threatened to dismiss the case but didn't. Now we're going to try to get an appeal and get a motion to dismiss. Hopefully we'll win.

Once I bought a very expensive bicycle crankset. For a pro bike. It cost hundreds of dollars. It didn’t feel right when I pedaled kinda like it was crooked. So I called the guy who sold it to me and heated words were exchanged He finally told me to stick it up my behind. I said ok, but it will still be crooked. Called the cc company and they gave me my money back.

Read the legislature per your state for debt. My state has a 3 year deadline for credit and 5 for medical. The collectors have no grounds for old debt. They are forced to end the calls and remove the black spot on the record per RSA.

My wife had a $387 bill in collections. I showed her this video and they settle for $300. Plus we got it in writing. Thanks Dave! About to start working in her other two $900 bills now. Thinking they might settle for $700.

+JasonfromMinnesota LOL I`ve done that. A debt collector tried to trick me into contract so I said " Do you know what a failed attempt at gaining consent sounds like ? " - then I hung up. The stories on this channel rely on people not being aware of contractual issues and assumes the contract goes one way. I don't use this system. It is corrupt and uses the Fraction Reserve Banking system to fabricate funds by fraud - most are not aware of this system used by ALL banks. This uses fraud to manufacture alleged funds by using a permission slip called a Promissory Note to create an account then assign a figure to that account as listed on the promissory note ( The amount you requested ). No money is transferred for your use but people seem to have a hard time grasping this when they can use that account for goods and services. One tactic they use to gain consent by phone - they will ask " Are you ____ ____ ? " and if you say yes you have contracted with them by not knowing that the person they are referring to is in all capitals and that is not you. Another concept people find hard to grasp. I`m debt free mate and never paid a cent by knowing what they were doing. A cop started teaching me this in 2008 after he quit the force for a number of reasons that were unconstitutional.

Hi Enrique. Out of the blue I started getting calls around 3 weeks ago from someone that wont identify himself yet expects me to give him my berthing date and other details. I answered with my name but there are 4 people I am aware of with my name here in the surrounding suburbs - found this out by accident. This " person " has called 4 of my neighbours already and this morning I received a call from someone imitating my neighbours Asian ex-wife on a number I KNOW is out of state while she is asking for him to call her. As it turned out she was at that very moment ( on my security camera ) parked in his driveway picking up the children. The call was bait trying to get me to phone them back over something I know nothing about and the last case involving financial matters ended early 2010 and we have a 6 years statute of limitations here regarding financial matters. So it may be someone trying to claim on an alleged debt while never providing my request for information to verify it was my debt in the first place. Even then the 6 years has now expired.

ha ha I did that. owed 1100.00 they were going to sue me. I called I said I got 600.00 thats it. Im going on SSI soon, you be smart to take it. They didnt. Sued me, of course they won by default, Im on disability now, they lost out on 50 cents on the dollar. Garnished my wages but they ran into a problem, there is no wages to garnish. I should call em back and remind them they should have taken my 600 when I offered it. noew jokes on them

While I have no love for debt collectors and I know that people can get into difficulties and also your credit card industry does work differently than ours does in Australia I do worry that too many people rack up debt and then just walk away from their responsibilities. I have had difficulties in the past but I believe that if I incur a debt it’s my responsibility to pay it back so I have always done that no matter what it takes. Years ago I made the decision to get my life on track and while not following Dave Ramsey program but a similar approach I am now debt free and own my home. I still have a credit card but if I use it I pay it off in full before the end of the month. My husband and I have never been on Hugh take home pays but I have become super organised about money and now we are on pensions it is even more important. I am also happy to report I was able to pass on what I learnt about money management to my kids and they remain debt free other than there mortgages

I had a $2000. Ambulance bill that Workmen’s comp was responsible for. The ambulance people kept calling and calling and I started answering the phone By repeating the workman’s comp lady’s phone number over and over again. After about 10 calls they stopped

I have a major mess I have several hundred dollars in tolls done with a car I left behind on a property I had rented. I did the right thing contacting the DMV when I left the vehicle wasn't running. They didn't mark the vehicle in my dmv record. I bought a proud after .So whomever fixed it had been driving it around late at night early morning under my registration! I have hundreds of these from Illinois texas etc! Please provide me with a direction to go to find out what to do with all these tolls! It wasn't even me or anyone I know. I'm scared to lose my driver's license over these tickets! They are everywhere all these tolls and I can not get any help

If you have a debt being handled by Ralph Sturm (think that's the correct spelling) they will file a lawsuit against you for as little as a couple thousand. I had this experience and took Dave's advice just like this call and they denied my offer of $1000 on a $2100 debt. Next thing I knew I had a server at my door.

So? That changes nothing. Send them a letter saying you have other debts, are considering bankruptcy, and $1000 is the best you can do.

Collector here: Credit cards are sometimes hard to work with but your regular personal loans are normally able to pull a lot of strings to figure out a solution. But when you completely ignore them for months normally they’re less likely to attempt to help you and more likely to sue you. I’ve rarely had to sue someone that stayed in contact with us regularly (once every week or two)

There's a reason people pay higher APR than others. That s because they are at high risk of defaulting. So when they default, the credit card makes a very good profit over several years. Sometimes more than the actual debt or amount charged. Why should these high interest, high risk, borrowers pay the full amount if they are label and charged high risk borrowers?? It's a form of price discrimination to pay more than other people with "good" credit.

When I was dealing with a debt collection company, they kept calling two or three times a week. I decided to drive them bonkers and called them up and told them as soon as they proved I owed the debt, I would pay them. The woman I was speaking to was so irate and I was just sitting there laughing as she lost her composure

I just watched a video from an attorney in Alabama who talked about. He said if they sue you show up to court and make them prove you owe them the debt. They usually can't because they won't bring the correct witnesses to court.

Always get them to validate the debt first. Credit card companies can hardly ever do that, no matter what they amount is. Plus do not ever say the debt is yours, its an allege debt. I have 4 cases i am in now. People need help, they just want the weak victims, challenge them, make them prove the debt. I have cases of laws and documents. The 1st DC, its 20, the 2nd its 23, and the last its 7, If anyone needs help doing an Commercial process just ask...

THIS! Send a Debt Validation letter. Make them prove the debt is valid, that you agreed to it, they have to show you how they arrived at the number they say you owe, are they licensed to collect in your state, has the statue of limitations expired (they don't actually have to show you that one, but it's fun to ask), If they can't provide that information, tell them to pound sand. If they provide it, then offer 25% paid out over time. If that doesn't work, inform them that you have other debts and are considering bankruptcy.....

i dont really get Daves attitude on this stuff. If people enter into a loan agreement and agree to terms, interest, payment schedule etc then ethically shouldn't they pay what they owe? I'm a recovering gambling addict, ive gotten dozens of payday loans over the years and other stupid high interest loans but ive always paid back what I owed. Does that make me a sucker?

Yes. There are laws governing this industry and consumers have rights, just like lenders. If you decide not to use the rights granted to you in the law then that's a bit foolish. You have the right to negotiate a settlement.

@HONESTO UNO If they have a team of skip tracers and private investigators they may ascertain a new bank and info but would have to go before that bank with a court order to get that money. If it is a matter of direct deposit,one can have it directed to pre paid debit cards. The greater the debt,the more they will go after you.

Check, money order, prepaid debit card... Just never grant them access to any accounts which you normally use.

I am manking minimum payments, i cannot make more than the minimum. I am up to date with my payments but my interest rates are high so the balance is very slowly declining. Can I call the credit card companies and make settlement offer? or Should I stop making payments completely and wait for their calls?

A Rey Call & ask for a lower interest rate. some credit card companies will give you a lower rate if you ask, others you have to threaten to cancel in order to get a lower interest rate

I have a question to Mr Ramsey I am debt collector I have seen people who have money but no intentions to pay just bcs we don't do credit reporting they don't pay to doctors who help them when they required , major portion coverd by insurance & the bal is $200 to $300 many times it's less than $100

It depends how desperate you are for a credit score. You probably wouldn't be sued ever. If you don't need the score buy want it gone offer them 300 and don't budge and make them wait. If you want it off now offer more or pay in full.

Id say let them give you a number that they will settle for. My wife did that. She said ive had a debt with you guys for 5 years. What will you settle for so we can take care of this? The bill was only 387(sad i know). They knocked 87 bucks off.

All of you saying persons should pay their debts. They have no problem playing the system for their benefit and, so why shouldn't the general public also not play the system. F.Y.I. the debt as already been paid off by insurance, which was priced into the the initial interest rate of every customer who have paid off their loan or not. These companies who are now trying to be vulture capitalist are seeking to have a come up off a debt that is already paid off. Your outrage should be directed at that. Such a thing should never have been allowed to be legal in first place.

Angelica Simpson They can also either email or fax the document. They either fax it, or email it to you (whatever method you agree to). Then, you sign it, scan it, and email (or fax) it back to them.

Along with copying the actual CC for personal records and the copy of the Settlement Letter personal records. The mail is always the best route.

I don’t get why Dave advocates for these people to try and settle these debts for less as if they’re victims. I get that the collectors are scumbags but they are calling because this lady irresponsibly racked up $25k plus on a credit card with apparently no plan or means to pay it back. That’s not much different than stealing. How about some accountability? You spent the money, you pay it ALL back or suffer the consequences. I wonder how she would feel if her employer kept offering to “settle” for paying her 20% of her paycheck.

Most debt is actually interest, late charges, etc....not the actual principle.

I understand the stress people are under to make ends meet, but isn’t it your responsibility to pay back money you borrow? Dave markets himself as a Christian , is it a Christian thing to do to walk away from your debts without paying? Nobody forces anyone to open a line of credit. it goes without saying if you borrow money from the wrong people and don’t pay it back you can disappear like jimmy hoffa.

Thanks for the great advice. I called the debt collector today. It seems over the phone payment and requirement of my entire credit/debit account is the ONLY WAY for me to pay off my debt, even though there is an option on their website saying I can pay it off online.

girzwald3 Yes, after calling them, I told them, " No, i was not going to be giving them my information " I also told them to send me a letter of the debt, So I know how much I owe. They said they couldn't do that either. There was no way I would give someone my bank routing number. That was the first time in my life I had ever come across something where they required me to actually give them my Bank Routing Number..

+shaochia vang What you have done is unknowingly asked them for something that can be used against them in court for a legitimate claim of fraud against your " Person " - Your name in all capitals. If your change your wording and demand to be sent the original unaltered promissory note you actually back them into a corner and change the game more in your favor. If they phone and ask for you by your name DO NOT say yes that is me or even yes. They are fooling you into creating joinder to gain a contract that they are an unauthorized 3rd party to and in which YOU do not have a contract with. I have used a " Conditional Acceptance of Debt Verification Notice " and listed 10 of my own demands and then added - any further correspondence sent to this address in ALL CAPITALS will be sent back to sender unopened. They also phoned both my neighbors and this was an invasion of their privacy. I issued them with my own notice stating that if they wish to persist in making claims to alleged debt without verifying you claim I shall initiate the process of 3 Contraventions of Privacy. They then sent out a bailiff with what looked like a summons but wasn't even a legal document. I took that into the courts and demanded to have a copy of any and all paperwork in reference to this matter. There was no court documents because they never lodged a claim lawfully through the courts but instead tried to use them as a debt collector by " Intimidation and Fraud " - another offence Any documentation was sent express mail back to the sender at their expense. They put a black mark on my credit file which I subsequently personally had removed by providing copies of my own documentation as proof that their claim of alleged debt was unfounded and unproven and also unlawful. Don't be fooled by their assumption of authority. They rely on people not knowing the system and use a Notice as a tool of intimidation. It is NOT a demand for payment. They just make you think it is. If you have not asked a company for any Goods or Services you DO NOT have a contract with them. Don't be fooled into compliance by their tactics. There are a number of ways to overcome this corrupt activity. I could go on but I`ll just add that I am debt free and never paid a cent except for registered mail - an essential part so they cannot deny receiving my correspondence. Google " Conditional Acceptance of Debt Verification Notice " and you may start to see where I am coming from. CHEERS

See this guy is a joke...quit making this dude rich while he tells you to eat bread and water and save your money.....and this dude never tells the people the truth......HE IS A JOKE.......dont pay debt collectors....debt validation letter.....and do research golly and he just told her...."save yur money" or tellin her to PAY this or that or a deal.....DONT PAY DEBT COLLECTORS

I don't understand why credit companies are willing to settle, and why Dave so highly encourages settling for less than what the debt is. These people borrowed the money, why should they not owe the whole amount? He encourages them to basically steal from the bank.

Dantastic I completely agree. She's essentially getting $30k of stuff for $9K. I am paying every cent of my debts because I spent the money and I have to take responsibility for that.

Dantastic My knowledge of it is that as time goes on they are spending more and more money to pay agents to call, send letters, and research your whereabouts. they will eventually take a loss on the full amount if you pay nothing.They have a hard enough time finding people let alone getting them to stay on the line. It is a mutually beneficial outcome for them to settle.

"I don't understand why credit companies are willing to settle" Because typically the debt has been sold off for pennies on the dollar and company that bought the debt probably paid $3000 for that $30,000 debt.. a $9000 settlement means they profited $6000 And the original credit company the collector bought the debt from already wrote it off as a tax deduction and basically lost nothing.

He does teach that. It's the ideal course for one to take. But it's not always the best option for people. If you're getting crushed by debt (especially predatory debt like credit card and pay day advance debt) then you'll never get paid up and out, your creditors make sure of it. So priority 1 is you, settle up your debt as soon as you can so it will stop hurting you. He teaches a list of priorities You are number 1, your needs. Food, water, shelter, health, transportation, and necessary utilities gets paid first. Anything else can sod off if paying it means not paying priority 1. From there you get into responsibilities and ethical financial practice. And then you get into wants and charity if you still have money. An example of responsibilities and ethical financial practice would be learning from your recent fuster cluck,, not getting in that situation again because what you did was still wrong and irresponsible, and getting yourself financially stable.

@@duddude321 in this scenario the caller says she has 9k in the bank but isnt even willing to pay that much back and Dave seems cool with that attitude. If everyone acted like her (not paying bills that they have the ability to pay) then the economy would collapse and the cost of borrowing would become far more expensive. In an ideal world this person shouldnt be able to borrow anything again until she pays what she owes
