In 2007, two boys attempted to rob another boy of his valuable RuneScape items. The two boys had grown extremely jealous of his RuneScape wealth and wanted it for themselves. Today we discuss what happened to everyone involved in this story, and how RuneScape changed Dutch law forever.

if youre having a case for armed robbery, both parts matter. The armed part was already proven, but the robbery part was still being debated.

Well yeah, but you'd at least hope trespassing and assault was a slam dunk there. They were hopefully pushing the armed robbery but failing that would go for the trespass and armed robbery.

@@TPKPatchy if they are being sentenced for violent actions you can not be sentenced for armed robbery anymore. That would being sentenced for the same thing twice which is illegal. Therefor they wanna slam dunk the worst offensive crime

Yeah, I just commented this above in the same vein Why does this all center around defining theft? It doesn't matter; if you forget RuneScape entirely, this was still a brutal assault. I'd still think that would be several months in juvi for kids or a felony count of 1-5yrs for an adult. The theft just makes it worse, that's not even the main crime. Community service??? I'm not saying try them as adults but come on, no time served is insane for an adult or child

I’m still amazed that the assault on the poor kid and the threatening at knifepoint wasn’t the main issue here. Screw the theft…when someone threatens you with a knife, that’s messed up.

While I'm not sure how dutch law works, I know that In the us there is a difference between federal and civil cases and how they are tried. I imagine there could possibly be a similar situation here, where the assault and battery was charged in a federal equivalent court whereas the theft was tried at the civil level.

No it was one of the two issues. The police wanted to prosecute the assailants for hurting someone AND for theft. The hurting part was pretty obvious and was solved really fast, that's why Collonello doesn't talk about that. The 'theft' part was unclear then

The assault was pretty open and shut. Let's not imply that they cared more about the theft than the assault because we're trying to be clever on the internet.

To clarify: the undecided part of the legal analysis was the theft. That these boys were in a lot of trouble for assaulting someone was clear. The issue is whether or not it was assault to further another crime, namely theft, which leads to an increased penalty as it is what is called a qualified crime. Much like rape has qualifications: rape without violence, with violence, or involving murder. The worse the qualification gets the higher the maximum penalty under the law. When people study high court cases or learn about them, they should realise that the High Courts will only consider the part of the case that is relevant to the appeal. No one was ever for a second under the illussion that assault isn't a serious crime.

Their parents appealed the verdict even though their kids beat up another kid and stole their digital goods. Clearly shows that the kids beating up others was not something natural but instead something they learned from their parents. No shame.

L take, parents are going to love their kids inherently and be more likely to believe x didn't happen or wasn't as bad etc and immediately going to "this proves they're ontologically evil or did something bad" is very cringe. it's not like, IDEAL, i agree that it's not a good thing and shouldn't like, lead to lighter sentencing or them not being punished etc

Having literally every single party admit to the fact that your child threatened another child with a knife, and instead of trying to make your child take accountability, appealing the case multiple times is shit parenting. Not teaching your child to own up and grow from mistakes is absolutely bad parenting.

It's similar in other countries but if the crime is severe enough they'll still be tried. In Britain the legal age is 13 but younger children have still been imprisoned due to the nature of their crime.

I can't confirm if its true, but I came across a comment that explained why while I was researching: "“Because the charge was theft accompanied by assault and threats. If you can't prove the theft you can't prove the charge, since plain assault or plain threatening weren't charged separately. Meaning no conviction. You can't (easily) change a charge during the trial. Also, the original charge would have netted a higher punishment.”"

I asked my girlfriend (who has a masters degree in law); she said the assualt part was probably handled by the lower court, and that the digital robbery part (since it involves a "new" situation not yet contained within Dutch law) is handled by the supreme court

@@yukimizuno4046 In the Netherlands, the Maximum sentence for murder is a life sentence, which does not have a possibility of parole, which is actually *more* strict than most other countries in Europe. So I am curious where your statement is coming from.

I hard disagree that the point about jagex owning the items is good argument. If someone rents a car and i walk up with a gun, beat them up and steal it its equally bad. it doesnt make it okay just because its rented. And the same point you brought up about the library is also applicable here.

The knives are certainly why the case went as far as it did. If it was a simple act of bullying the kid into trading his stuff over then it definitely wouldn't have even went past the initial police stage. Seems their defence was just trying to cling onto the technicality that it may not actually be theft to try to get the entire charge dropped (hence the focus on the stealing of pixels).

This was very fun to learn about during my law studies in the Netherlands. In addition to this case, there's just been a new ruling regarding a gold seller that now has to pay taxes over their money gained with the gold-selling; further cementing the viewpoint that Runescape gold represents real world value after all.

We had kids threatening each other for rs stuff back in 2005 at my school. But the worst thing that happened to me was when I went to my friends house to help me with dragon slayer. He had played the game much longer than I had at that point and I wasn’t too good at English, so he helped me with the quest. He told me to bring my best gear and as the fight with Elvarg started he just closed the browser. He didn’t even steal my stuff, he just wanted me to lose it. I lost a rune legs, adamant plate, rune full helm, which isn’t much, but imagine that back in those days, how much time I spent, what little information and especially what little information I was able to actually take part of. It took me a lot of time to even get to this point

if this happened to you in the US you’re fucked. Imagine being like 13 and telling the police somebody robbed you for runescape items. They would laugh in your face. At best they’d pretend to write things down. But no way would they ever question the other two kids or more importantly force them to log onto runescape to give the items back

this case is used a lot in law schools in the Netherlands. Mostly because this type of crime was something new and huge for modern law. tl;dr, if you put in real time/money to obtain an item, it has real-world value. Thus, stealing online is no different from stealing IRL. So... you explained the Dutch law perfectly (I JUST finished an IT-Law module which used this case)

I'm hearing... assault, attempted murder, assault with the intent to murder, premeditated assault with the intent to commit murder and identity theft. (1. Discussed 'taking' the 'items' in question, and following through with it. 2. Kicking the boy, punching him. 3. Pulling the chair he was using to play on his password locked account out from under him and using his private account, linked with his private EMail, which most likely had his private information on it (Ie. Passwords, recovery information, payment information, address, shipping information etc.) without his written, and or verbal consent. Its the slammer for the kids, and a thorough investigation into the parent's conduct which led to this point, with potential CPS involvement.

Very bizarre that the case was about theft. The thing in the center should be the assault, threats on Lucas's life, and what is essentially robbery. Feels like the legal system failed big time.

As a dutch, i can give some insight why there is little info on the younger boy. Under a certain age we try to keep information to minimum, when he turns 18 he shouldn't have a criminal record.

God forbid their murderous child have to do 168h of community service as punishment for assaulting someone with a knife. The fact that they were going through such lengths to prevent a very light punishment is sickening.

i feel like the issues around conspiracy, coercion, death threats, assault and battery, brandishing deadly weapons, kidnapping should have came first but idk yea lets focus on the items under any other lens than motive first cool.

Ngl we had the same as kids a kid from internet cafe stole my mates items cleaned his acc so I took the boys from the cafe found out were he lived and went straight round there and his mum made him trade it all back there and then and gave us a lift back to the cafe lol 😂😂

I don't even think the tangiblity of the items matters. Those kids took a kid forcefully to their house, and violently assaulted him. They threatened to end him. That's insane and definitely worth more than community service

I had something i guess similar to this as a kid, some kid was bragging about his items and gave me the pw to his account, so i logged on and took all of his good stuff. While i was doing it he was msging me on msn and asking me to log out really quick and then log back in, i had already taken his stuff and knew he wanted to change the pw so i just logged out. He was msging me begging for the stuff back and i said no, so his parents showed up at my house yelling at me at the age of 8 to give him his stuff back, i explained it to my parents and they laughed and said no. According to my parents his parents contacted the police and included the part that he gave me his pw and nothing was ever done about it. Found out at school that his parents actually bought him gold for his birthday and thats why they were so upset.

it was definitely a halloween mask, when you died, rare items almost always were lost because the alch value was so much lower than other gear

@@PureNationalism13 items kept on death used to be based on alch value, and when rares were released they had alch values of 1gp meaning you would keep your other gear instead of your rares when you died

Back in like 2003 I had a kid show up at my house, I didnt know him but I knew he was a friend of a friend. When I opened the door he asked me for his P hat back. After some confusion I finally understood what he was talking about. That mutual friend stole his party hat and told him it was me. pretty sure the kid whos party hat was stolen is in jail for violent crimes.

Always something happening in our dear MMO lol. I wonder if any similar incidents happened irl to other games and MMOs, past in game and the forums. Don't think I've heard of any in WoW or Everquest. Also, are those screensavers on Wallpaper Engine? Love that silly Garfield btw, need to get one myself.

To clarify: the undecided part of the legal analysis was the theft. That these boys were in a lot of trouble for assaulting someone was clear. The issue is whether or not it was assault to further another crime, namely theft, which leads to an increased penalty as it is what is called a qualified crime. Much like rape has qualifications: rape without violence, with violence, or involving murder. The worse the qualification gets the higher the maximum penalty under the law. When people study high court cases or learn about them, they should realise that the High Courts will only consider the part of the case that is relevant to the appeal. No one was ever for a second under the illussion that assault isn't a serious crime.

The real question is, who’s funding these appeals?? To take a case to a Supreme Court takes a lot of time, money, and effort. Why is it being appealed to the highest court over 160 hours of community service?

Im surprised that the kidnapping and assault was not argued as they are 100% much more serious crimes. However, i assume they couldnt prove either of those things happened outside of the original statement.
