In this video we speak with an attorney with extensive brain injury experience Jordan Powell who is a partner in the law firm Passen & Powell.
In this video we’re talking about concussions. There’s a lot of misunderstanding about concussions and what they are and the value of them after a car accident. So let’s start with the first question:
1. What is a concussion: concussions are a brain injury and they typically happen if there is a bump or jolt to the head. But you don’t have to hit your head. It could involve just a severe shaking of the head. You can suffer a concussion from a whiplash.
2. Is it common: concussions are very common and there are about 3,000,000 concussions per year. But they vary in degrees and symptoms
3. What are Concussion grades: there are 3 grades of concussions grades 1, 2 and 3. Grade 1 being the least severe and grade 3 being the most severe. The difference typically has to do with whether you lost consciousness or not. Lost consciousness is normally a grade 2 or 3 concussion and that results in more lasting and severe effects.
4. What are the Symptoms of a concussion: symptoms will vary by the victim.
They might include Headaches, dizziness, a light fog, nausea, vomiting, visual disturbances, memory loss is very common. Some of the less common symptoms include tinnitus such as ringing in the ears that doesn’t go away.
5. How long do symptoms last: it applies differently to every person. Sometimes they last only days and they subside. Other times they may last a long time. Sometimes the effects last forever and that is called post concussive syndrome. Also, symptoms often come on hours or days after an accident occurs. Why? The cause of the concussion is swelling of the brain cells and that can take time to manifest itself.
6. Treatment: it’s very important to have a record trail of what you’re doing for treatment. If you have symptoms, go to the ER or your physician. You may also need to see a doctor continually or you may see a brain specialist called a neurologist, or possibly a psychologist or neuropsychologist who can evaluate if there was a permanent brain injury.
7. How do you maximize compensation for a concussion? Get treatment you need and continually follow up and seek out the experts you need. Also, get corroborating evidence such as statements or sworn testimony from independent witnesses such as friends or co-workers who can explain the difference in your behavior before and after an accident.
8. How much can they be worth and what are the factors that determine the value? It varies by every case. But a range that Jordan has settled from $20k to over $2M. There are a lot of variables that play into the case.
