All marriages solemnized outside the Philippines, in accordance with the laws in force in the country where they were solemnized, and valid there as such, shall also be valid in this country, except those prohibited under Articles 35 (1), (4), (5) and (6), 3637 and 38. (17a) Where a marriage between a Filipino citizen and a foreigner is validly celebrated and a divorce is thereafter validly obtained abroad by the alien spouse capacitating him or her to remarry, the Filipino spouse shall have capacity to remarry under Philippine law. (As amended by Executive Order 227)”

I’m planning to get marry in the Philippines, one of the requirements for Marriage License is Certificate of Legal Capacity to Contract Marriage since I’m considered foreigner. My question is am I still qualified to get a CENOMAR in the PsA and use that instead of the Certificate of Leagal Capacity to get Married? Thank you po. Looking forward po for your advice.

Atty. Thank you for sharing this information po. ❤️ Ask ko lang po how about pwd po ba dalawang kasal po? Magpakasal kami dito sa Pilipinas at magpakasal din kami sa abroad which is US. My parents or family can't go in the US because of the long process po even tourist and may possibility na ma deny pa po at saka dpende sa US EM. If e approved nila kaya nag decision nlang kami na dalawa nlang ang gaganaping kasal. Pwd po ba yon atty.? If both became Canadian citizens, can the last will of either of the ex couple whoever die first, not to give any inheritance of a property in the Philippines (which was purchased when they were already separated) to the one who is still alive, be challenged by the ex wife/husband even though they have separated for many years aside from being both non Filipino citizens? Hi Atty., sana po mabigyan nyo po ako ng sagot, Norwegian citizen ako nung nghiwalay kami ng Norwegian husband ko at nbuntis ako 4 months before na-approved yung divorced nmin. Magandang araw po atty.. Sana po masagot nyo ang aking katanungan.. Ako pa nagpakasal dati sa hapon pra magka visa lng po sa bansang japan hindi po kmi nag sama bilang mag asawa..bago po ako umuwi sa pilipinas ay nagdivorced n po kmi.. Meron nrin po akong copy ng divorced paper nmin... Ngunit ng akoy kumuha ng aking cenomar ako po married.. Hi Atty. how about po pag ganito ang senaryo: ang Pinay is kasal sa pinas with Japanese guy then they got divorced in Japan. If magpakasal po uli for example sa US yung pinay, pwede po makasal diba? Since US law will recognize yung validity ng divorce. Sa pinas lang bale hindi pwede makasal kasi di pa recognize yung divorce sa pinas? Tama po ba? And if iparegister sa embassy yung kasal sa US, ppwede po ba yun? Or irereject ng embassy yung kasal? Thank you po in advance sa advise:)

Atty. Please help. Kinasal po kami sa pilipinas jan 19 2033 this year, kaso po nung agency na nag aasikaso ng papers po namin nilagay po feb 6 2023 tapos po nakalipad na po ako nyan palabas po ng country po. Gagamitin po sana namin for getting a spouse visa yung marriage certificate kaso conflict po yung details na i proprovide namin sa immigration kung lumipad na po ako nung jan 31 2023 tapos feb 6 po date ng marriage. Sabi kasi nung agency and local city registrar na di pwede yung correction at thru annulment lang po daw yung the only way to correct the date of the marriage Is it possible na pwede kami mag pakasal ng wife ko dito sa Japan for a new date in order for the details to be submitted in the immigration are correct?

What if Attorney one party is already citizen in the other country and grant a petition for divorce. Does he/her still have obligation in the Philippines?

He/she who had filed a divorce abroad will still need to file the Certificate of Foreign divorce Decree Absolute to the Regional Trial Court of the Philippines in the province where he/she was born. Having acquired and naturalised foreign citizen does not solve the marital status of a Filipino born. Unless your weeded husband/wife died in the Philippines or abroad then that completely cut your marriage. Your next problem is to file extra Judicial Intestate of estates to the court to transfer assets into the name of surviving spouse. But things needed to be settled first like BIR unpaid taxes/Ameliar so before 23 June 2023 the deadline. Next is to Register everything in your sole name whatever is there in the Intestate. Tama ba ako atty? Matrabaho talaga sa Pinas- sa Ibang bansa ipakita mo Lang yong death certificate maayos mona lahat. At sa Ibang bansa hindi compulsory na palitan mo name mo as a wife burahin mo ang aplidomo at need I palit family name ng husband mo. So your maiden family name goes to the storage until you divorce or your husband dies.

Goodam po nasa canada ex wife ko dati nung nasa dubai ako pinapadalhan nya ako ng divorce paper para po pirmahan ko.. Tapos nag pakasal po sya doon ngayon po gusto ko na din mag pakasal dahil lumalaki na ang anak namin ng kinakasama ko wala din po pala kaming anak ng ex wife ko. But I am not married to a Filipino and also not got married in the Philippines but in Denmark. And my ex husband has been married to someone else for more than 3 years now. But sadly he did not even send me our divorce decree and certificate . He totally ignored my request He didn't even like to provide the exact date of our divorce. I have been emailing the Denmark house of court to request my certificate but only got replied once but still nothing good happened so far. It is sad that while he is enjoying his new marriage he let me stock and get stranded being not able to make more steps to find and be with new lovelife and family of my own. Because here in our country it is not easy to make a lot of moves or do something if it's about this case if you are not rich and only have enough to survive your daily lives. It's easy for our country to recognize the marriage of a Filipino in other countries but once you get divorce you have to bring it to court with thick authenticity documents and need to hire an attorney for it and a huge amount of money. And possible you need to travel back to where you got married for more documents needed and sadly need the ex husband cooperation and his new address and information and how on earth I can do that if he can't even be contacted because he avoided me. 😢🥺🥺🥺 This is the only burden and sorrow in my life but not easy as a poor lady. It's been more than 7 years of abandonment but I can't reach out to him. He divorced me without my consent I do not know that it is easy to do that in Denmark, just a letter to the house of court from his other woman that they already slept together the House of court approved the divorce only found out Feb.2022 and he is already married back then for almost three years.

Yes. Physical separation and absence of communication do not severe the marital relationship. Neither does the change of citizenship.

Yes. Divorce is recognized under PD 1083 or the Code of Muslim Personal Laws of the Philippines. It provides that: “Article 54. Effects of irrevocable talaq or faskh. A talaq or faskh, as soon as it becomes irrevocable, shall have the following effects: (a) The marriage bond shall be severed and the spouses may contract another marriage in accordance with this Code;” “Article 55. Effects of other kinds of divorce. The provisions of the article immediately preceding shall apply to the dissolution, of marriage by ila, zihar, li'an and khul', subject to the effects of compliance with the requirements of the Islamic law relative to such divorces.”

What if, kasal ung babae dito sa pinas tapos pupunta Australia para magpakasal sa foreign man peru gamit ay apilido ng mister niya sa pinas dahil lahat ng papel at id pati passport ay naka changed na, pwede po ba un ? Saka what if ang habol lang ay citizenship sa Australia and after 2 yrs makipag divorce lang sa foreigner okay lang po ba un ? What if 2 couples are married in the Philippines then later on they become American citizens then get divorced and the other person get married to another person. Would that be valid in the Philippines since they are both American citizens when they get divorced?

At the time that they got divorced, their national law was the US Law. They were no longer governed by the Philippine law. Hence, the validity of the divorce and of the subsequent marriage shall be determined by the US Law.

Hi po, married po ako dito sa pinas sa ama ng anak ko at hindi ko pa ginagamit yung apelyedo ng asawa ko lahat ng documents ko po single pupunta po ako sa japan at immigrant na po ako dun yung visa ko long-term visa dahil isa po akong Japanese descendant pwede parin po ba ako maka file ng recognition og foreign divorce sa japan doon po mag divorce? Kahit single yung mga documents ko po?

Kung kasal na po sa US ang isang Philippine dual citizen, recognized po sa Pilipinas ang kasal. That means, kung nagpakasal sya sa iba sa Pilipinas, that is considered a bigamous marriage, and therefore, it can be challenged as null and void in a Philippine court. Ask ko lang po atty meron po ako pinay na girlfriend dito sa japan pero devorce po siya sa japanese nang 10 years pero hindi pa sya annul sa pinas ..plan po namen mag pakasal sa japan meron po kayang chance makasal kame sa japan ..same filipino po kame dalawa

Mapagpalang araw po ,hiwalay po kami ng asawa ko since 2011 po nasa Pilipinas po sya at ng ako po ay makarating dito sa US ng 2016 nag desisyon po kami na mag divorce at pumirma po sya at na grant po yun nung 2018,na grant din po ako ng nullity of marriage ng simbahan dito sa US. Ano po ang nakikita nyong problem po dun kung magpakasal po ako dito sa ibang bansa?nasa right age na po ang aming mga anak at Wala nmn po maghahabol sa amin parehas dahil we both agreed po.

Hi Atty., salamat sa inyong educational video regarding this Judicial Recognition of Foreign Divorce. Gusto ko lang din po magtanong.. Ako po ay isang Filipino residing Japan, I got divorced abroad way back July 2019 and based on Japan rule, after divorced I can remarry after 100-day mandatory waiting period, that is why I remarry on Dec 2019( with the help of a Japanese lawyer). Then 2022, I filed a Judicial Recognition of Foreign Divorced in the Philippines and granted the result on 2023. Is my second marriage with the foreigner, considered “bigamy”? Hello po, puwede po ba mag reacquire ng Philippine citizenship after renouncing? Gusto po namin mag divorce ng asawa ko kaso pareho kaming Filipino citizen. Dual citizen po ako so puwede ako mag renounce ng Filipino citizenship ko para mag divorce kami at fair sa aming dalawa ang pag hihiwalay namin. Kaso...ayaw ko naman po mawala ang aking pagiging Pilipino ko permanently.
