I was pulled over by officer Rodriguez and officer Sexton of the DeLand, Fl Police Department after i was filming the 2 cops in this video. they tried to tell me to stop. I kept filming and then got in my car and was immediately pulled over and given bogus tickets. the cop tells me i have the option of not signing. then gives me a ticket for not signing. he never did allow me to sign the other 3 so they are void. and the one i signed was under duress because i was threatened with imprisonment and there were 2 officers there with there hands on their guns. there isnt even a statute or ordinance number on the "refusal to sign ticket". please send this video to every one you know and favorite it. thank you

I don't know if you're referring to the driver or the cop...but if you are referring to the cop then he is stupid. If it's required for the driver to sign then why tf is he giving him the option. It's obviously not a requirement to sign then. That's like someone telling me that I'm required to share my breakfast sandwich with my girlfriend. I'm not required which means I don't have to. It's my choice if I want to share it or not and she can always get her own sandwich anyway.

***** No clue what codes you are looking at, look up "Emergency Services Response codes" "CODE 1: Non-emergency response. No lights or siren, following the flow of traffic. CODE 2: Non-life-threatening emergency response. No use of emergency lights or siren. Must follow all traffic laws. CODE 3: Life-threat response. Emergency traffic, or simultaneous use of lights and siren required in order to achieve a rapid response.. CODE 4: All clear or I am okay. Also used to tell another unit they can disregard."

No it's not. He accepted that instrument (citation), so he agreed to what he was being charged. He then became "holder in due course". Now he accepted the charges regardless if he signed or not. Sadly, majority of people don't re-cognize what is going on. It's a commercial interaction where silence and acceptance is agreement (a binding contract). He didn't have to sign it or accept it. Had they attempted to take him to jail for not signing nor accepting it, he can then write a writ of Habeas Corpus or a friend and give it to his captor (The person that jailed him) and demand to immediately see a judge for them to provide proof that they have grounds to hold him. There is a lot going on in those little interactions that many aren't aware of. People also need to be familiar with their state Constitution as all 50 Republic lands have one and they are in harmony with the united States Constitution while State Statutes are not. Holder in due course. In commercial law, a holder of an instrument who took it for value, in good faith and without notice of any claim or defense against it, U.C.C. § 3-302(1), and who can enforce the instrument free from all claims and personal defenses. U.C.C. § 3-305.

No ya yokels. This just gives the person notice and sanction to sign the citation or the consequences go up. the next step would have been formal arrest and transport to jail. Enter at your own risk.

No, the cop just made him aware of the consequence for not signing, you still have a option because he doesn't break the law until the makes his choice. If you say to a cop you're gonna run a red light you don't get a fine opfront you have to commit your "crime" first

brandon gomez It is not a cops job to educate someone about law, his job is to make the people breaking the law face the consequences. As a citizen it's is your job to know the law and the cops job to punish if you decide to break it which doesn't not take away the freedom you have to commit any crime you want.

You don't have to know every law, you will learn by collecting tickets just like this guy in the video. If the frase "I dind't know i was breaking a law" prevented you from being punished for it there wouldn't be things like deathrow of even prisons

In lieu of the somewhat recent Jordan v City of New London, CT court case ruling that the New London PD were justified in turning away intellectually “overqualified”, AKA; above average intelligence candidates, I hope you’d agree it’s difficult to ascertain if he was in fact slow OR was baiting driver to write more infractions. What’s MOST important, IMO, is that NEITHER scenario conveys evidence the police department OR the officer (I.e. PUBLIC SERVANT) has an interest in effectively “protecting and serving” the community...

I've been pulled over twice now in the past year, both times I was technically speeding one 15 over and one 13 over (regardless of traffic flow), and one time I didn't have my tags up to date due to pending repairs for smog. Neither time was I cited by either officer..... I wonder why? Maybe it's because I did everything this tool didn't do. I was polite, from the beginning, I didn't play these little half way window games, I had my documents in order and I provided them as requested. Then the officers simply ran my DL#, it cleared, Then they said "Do me a favor, watch your speed and have a nice day." Each traffic stop took maybe 5 mins.

Michael Dennis Personally, I am all for teaching cops the law, and I have done it many times. But... heres the deal. If I get pulled over for some petty traffic violations i just act polite, give them my documents and thank them when I pull away, whether I got a ticket or not. This guy is just acting like an irritable 3 year old that thinks hes cool cause he saw some youtube videos and wants to be "just like Matt pleading the 5th!". and he wasnt even good at it. Ill give you and the driver in the video a tip. If you are going to stand up to johnny law, make sure its for a god damned good reason in which your freedoms and basic rights are being infringed on. The driver is lame, this video is lame... all the driver is doing is whining like a little bitch thinking he is all tough for standing up to the cops over some petty traffic shit. get a life.

Nope, Trent. It doesn't work that way. Cops back up one another. It is why they're more than happy to show up in traffic court to fight you if you want to fight your ticket. At that point, the judge doesn't give a flying fuck about what the cop knew or didn't know. You have to show him why your ticket should be dismissed. Any lying is only wrong if done under oath.

You can obviously tell that he is using his police status and obviously making him do things wrong. He was intentionally trying to screw up keable. He lied and made up false statements to try get you to do things. These officers are trained to fuck with people, they are trained with how they talk to get you to do things they want, they're not getting straight to the point. Oh. My. God. This officer. Rodriguez.. Sexually assaulted me when I was 19 years old when I lived in New Smryna Beach Florida. I will never forget it. And it was the first time I was arrested. For buying beer with a fake ID. He dismissed all other officers including the female and proceeded to search me when the female officer had already done so. He said some sexual things and touched me in places he shouldn't have. I remember him. Never will forget him.

Robert Aylor... Sue for what?? The cop did nothing wrong except not initially inform driver that refusing to sign the traffic citation is a misdemeanor. He told him the truth. If you don't want to sign it, don't. Pigs in Orlando would have just hauled him off to jail and dared him to even ask why more than once so they can use force and give him another charge of resisting arrest. Citizens are required to know the law. This cop did nothing wrong.

It makes soo much more practical sense to treat cops like your best friend or brother. I've gotten out of several tickets this way. Pissing them off is the worst thing you could possibly do, especially before they decide to write a citation. As soon as the energy turns negative, they're going to make you pay.

eduardoig17 that is not the point, that is why the cops are the way they are. people want it to be easy and go on their way with a simple ticket or nothing if they are lucky but a lost hour of their time because of harrasment. cops make everbodies life difficult but i have never seen 1 protect a citizen they claim to serve! i know people who have been robbed, stabbed, harrassed, assulted, etc... and not one of the people have justice served unless it is a cake walk for the cop or makes them a profit. they bust teenagers with drugs, smugglers, traffic violations, anything that will be a fine (disorderly conduct, open container, etc...). when has a cop ever helped you? have you ever gotten your identity stolen locally? if not take a guess what they say, "it is too much to try and find the person, it is your loss and you will have to solve this through a private investigator". so basically, you can pay somebody to do it and we will arrest them, but we cant help you in any other way as it is not profitable though they have committed fraud and have not crossed federal or even county lines. what a shame.

The only thing that he did that was difficult was the window thing... but the window was down far enough and if he didn't want to roll it all the way down because it sticks sometimes then he shouldn't have to... the cop was being more difficult than he was. Everything else that most people are saying he was being difficult about was actually him making sure that he wasn't signing anything that was going to incriminate himself further than need be.. the cop was an asshole and this guy was right for being cautious.

the cop was being an asshole because the guy was being an asshole first. like when he said he didnt want to sign it without even reading it and the cop tried explaining it to him but he did not let the cop finish. if he would have read or let the cop talk he would have seen that the ticket says that you signing it is not admitting guilt you are just signing that the cope gave you the ticket. i have gotten 3 tickets so i know it says that about not admitting guilt, two for speeding and one for running a red light. i have been stopped a total of 4 times in a little over 3 years. if you are nice and respectful the cops will help you out (when they can). one let me go with a warning doing like 10 over, the one with the red light i actually ran a stop sign, the red light, and was speeding but i was nice and he only gave me the red light. the other 2 was speeding in a school zone which i didn't know was a school zone so i did deserve that one because i could have ran over a kid, and the other one was doing 25 or 30 over so that one he couldn't really do anything but he dropped the speed so i could still go to defensive driving. none of those tickets are on my record :)

The cop wants the window rolled down just in case the dude was drunk or high. The cop called the backup because the dude was acting suspicious like he has something to hide. WTF. not necessarily. I have no tickets in 5 years of driving legally. no juvenile tickets for driving either. but i have been pulled over various times. More times than not I was removed from driver seat onto the curb or backseat of the patrol car. Before i'm even completely stopped, I see the squad cars both front doors swing open at the same time and two officers jump out at me. Reading their body language I said oh shit wtf did i do. They rush both windows ask where im going. take me out the car and search it. after they find nothing, they let me go without saying why they pulled me over lol They're pretty ruthless. If you are involved in gang activity, they're ready to pull a trigger. Inglewood/Lennox CA It's better to let them just search your car if you know you don't have anything illegal than to try to fight with them. Illegal house searches have been done before. they went in through a 2nd story window with a ladder lol! They even work besides criminals to get a little word on the streets update. If criminal doesn't cooperate...he just might have a cop patrolling his whereabouts just to bust him by planting.

"i didn't hear you honestly" lol i have a front door camera, as soon as he was stepping up the stairs i was wondering wtf? they got to the top and immediately took down my camera, then tried to come in. didnt even knock or announce who he was. just turned the knob a couple times. knocked 4 times hard......got no answer and he went back down. for 1 hr they kept trying to pick the lock lol they couldnt get in. so they got a 25ft ladder LOLL

Watching this again, that guy was so disrespectful and such a smart aleck. With the struggles the country is having over police relations, we all need to work harder at getting along! We need to do that even without the issues of the times. What this tape really is useful for is showing a police officer of color being very respectful and professional to a grown white man acting like a child and just asking for trouble. Race aside, this is just a ridiculous way for a grown man to act when being pulled over. Every time a police officers walk up to car, they are potentially putting their life at risk. There was no need for this "man"to behave so belligerently. Yes, Mr. Cable, when you received your driver's license you "entered into a contract" to follow the laws of driving, such as wearing a seat belt, stopping at stop signs, and providing documentation when asked. I hope you have grown up since this was filmed!

Maybe some US citizen should get more law education at the high school. Apparently they become self-appointed warrior attorneys w/out knowledge of the law, which is very dangerous. Ever heard of the "Ferguson Effect"? Seven states (Arizona, Florida, Indiana, Louisiana, New Mexico, Ohio, and Vermont) explicitly impose a criminal penalty for noncompliance with the obligation to identify oneself.

The profession also attracts and fosters people with an aggressive attitude with many being as bad as the people they should be serving and encounter daily. Police are not all powerful. They were no wrongdoing, and he was just provoking them on their own private property and went on just across that same property. There are enough other cases on KZfaq with really violating the 4th amendment by cops. But not this particular case. He is just exploiting cops for his own financial benefits. Clickbaith. Mostly the 1st red flag of abusing the '4th amendment rights' is when the poster is publishing names, badge#, license plate numbers. Then that 'supposed to be a pro 4th amendment fighter' is violating himself ther people's 4th amendment rights. I have no respect for those kind of people.
