I’ll never understand why it’s specifically legal for cops to “make mistakes”, be ignorant of the law, etc but not citizens. Why are citizens held to a higher standard than those who enforce the law?

If a civilian is scared in the interaction, they must calmly comply. If an officer is scared in the interaction, they can discharge their weapon because they fear for their safety. An early constitutional role of police was to capture and return escaped slaves. [US Constitution, Art IV, Sec 2, Cl 3]

Because with that standard, the average cop would have to have a significantly higher IQ, which would necessitate a significantly higher salary, which wouldn't work economically. It's on citizens to understand that cops aren't the sharpest knives in the drawer and to adjust their behavior and interactions accordingly

They cleared him as a suspect and they still charged him. Think about that. He was there eating his lunch and minding his own business and wondering what he was going to do the rest of the day when all of a sudden, he was thrown in jail. And why? With body cams being more common now, I’d go so far as to say ANY accusations/statements or threats made by a cop that the video clearly shows the opposite (like this one), results in immediate termination. No questions asked after that. “You’re a law enforcement officer, your body cam SHOWS a situation where your words CLEARLY lie… you can’t be trusted to ever tell the truth and therefore MUST be fired”. Or some similar statement like that. Written into policy, non negotiable and unions CANNOT file a grievance to. Period. Plus it should automatically strip qualified immunity! Cops like this are disgusting and our society has NO place for them, they’re nothing more than lying criminals themselves. A badge doesn’t change that… SHOULDN’T change that!!

thats stupid. Dude was resisting, thats on him. He may not have been "aggressive" but he certainly was resisting. You should have ZERO "fear for you life" if you dont act stupid and just comply with the officer's commands as you are legally required to, even if you dont think theyre entirely justified. Everyone knows you dont fight this shit on the side of the road, you fight it in court, and resisting is just going to make everything harder on yourself, and make your court case far weaker. If he had just stepped out of the car when requested this never wouldve gotten violent in the first place. Ive had multiple interactions with cops on the side of the road that Im not proud of but never once did I resist, I followed their orders and everything went smoothly, I even got let off with warnings when the violations were minor. I never for a millisecond was afraid in any way, definitely not for my life, thats insane. Show me a single arrest video where the arrestee was completely calm and followed all orders and yet still for some reason the cops were super violent to the point where the person shouldve rightly feared for their lives. Youre gonna be looking for a looooonnnngggg time, good luck with that. (edit: that being said, Im not supporting the cops either, they were definitely in the wrong here, but like AtA said at 17:50 "his interests wouldve been served if he had immediately complied". Instead of getting a small settlement out of that court case he probably wouldve straight won it if he hadnt put up the resistance he did.)

In the old days when citizens would Witness a person's rights being violated in every way imaginable before cameras were readily available all witnesses to a particular incident would just be explained away as they are civilians and not trained professionals and did not see what they saw or what the officers saw. So their witness testimony would be worth absolutely nothing. I don't know if anybody has noticed but they no longer yell out stop resisting stop resisting! That practice was stopped because of all the cameras that would show there was no resisting. Usually they would if they had the backup and bodies to cover up the individual so visual sight of the subject was not seen or obscured then the stop resisting yells would start. And then the brutality would commence.

@@matthenry3569 I would have stopped my investigation pretty much immediately after seeing the reading materials. Burglars don't steal books and are not in general as well read as this person was. Unfortunately all I saw was skin color arms and legs and immediately started to plan their attack.

@@rogusmith2630 i don't think that would be the reason. a cop's job is pretty hard as it is. if you add removal of qualified immunity nobody would want o be a cop. they have so many interactions with all kinds of people, mistakes are bound to happen. i'm not saying there are not genuinely bad cops, i'm saying, that good cops can make mistakes given the number of interactions they make in a career and nobody would want the risk. i'm saying this as a guy that has an ACAB tattoo, but we have to be fair

Tri Hoang who investigated the complaint about this gentleman's treatment by the low IQ thugs in uniform, and came to the conclusion that they did nothing wrong must be demoted back to patrol officer as it is obvious that he doesn't have an 'F' ing clue as evidenced by the police paying out knowing full well they had did lots of things wrong.

Cause we are living in a modern police state full of corruption. The internet is just bringing it all to light now, this has been ongoing for decades. The public is finally holding them accountable because we have the video proof to show it. Before body cams this shit was more than likely running rampant in every city but no one could back it up. It's mind blowing that an organization with potential legal liability is the only one allowed to investigate if something wrong happened. Of course they'll always find nothing wrong. If the internal investigation admitted to any wrongdoing, they'd basically be admitting fault in future lawsuits. It's absolutely bonkers that this system is allowed to continue but here we are.

Internal Investigators USED to be more than they are now. They did used to be a force that Policed the Police. However, within the past decade, they've defended cops. Corruption begets corruption, and honestly, I think of Cops as Nazis. Because like the Nazis, the same laws the REST of us have to abide by, Cops can get away with ignoring. Cops are allowed to commit murder the same way Nazis were. There was no justifications and they were protected by Hitler. The same way Cops are protected by Judges and the Justice System. So, what exactly is there, to differentiate a cop from a Nazi? There is none I can think of. Nazis tortured their victims, the same ways Cops torture their victims. The US is BROKEN.

An innocent Jamaal is arrested and charged with usual BS charges…and then officers responsible are considered to have done a great job even though Jamaal was found not to be the suspect they wanted. They still detain him, then charge him for resisting, obstructing and disorderly conduct when they find he’s innocent party???? I agree. An employer won't know the circumstances of an arrest and pending charges. They just have to take your word, but that's hard to do since you now have an arrest record and your reputation is in the toilet.

@@Bl00dMalice..lots stays on your record for at least as long as they keep the BS charges alive in their system (part of their “lesson” given to the pesky Citizen). And most jurisdictions do NOT automatically expunge every single arrest. I have read many stories about pro who had to pay a lawyer to help them compel the LEO Dept to expunge their record.

*"Resisting" claims should automatically turn in to a charge for the officers when they're clearly visible on camera pulling a stationary person in opposite directions at the same time. If they haven't even decided yet where they're trying to move the stationary person to yet then the only excuse to be touching them at all is if they're visibly trying to reach a weapon or an object that can't be seen and therefore could possibly be a gun.*

It's a fair question. In so many of these stops, there seems to be a tipping point, beyond which the LE officers clearly have STOPPED thinking. It happens again and again. They proceed with force, regardless of what is happening, of what new information is discovered/said, or even whether there is a genuine threat. And in this particular case, the officers invaded the person's personal space without cause. Maybe this is training? I don't pretend to know, but I've definitely noticed it.

16:11 He did NOT resist the officers physically. Both officers were pulling him from opposite directions. They manufactured a situation where no matter which officer he tried to comply with he would be opposing the other officer. This was a sick and wicked way to be able to accuse him of resisting arrest. It appears they've done this before. They did not hesitate, but knew exactly the moves they were making right from the start. That's why that second officer opened the passenger door.

Solving the police problem - A Work In Progress 1) Prohibit military veterans from any role in police departments. 2) Police should be draftees from the civilian population - no exceptions, everyone must serve unless they are military veterans. 3) Paid minimally as it is a public service with NO pension or other benefits that extend beyond their tour of service with the exception of compensation for on the job injuries or death. 4) Serve a maximum of 2 years a) No extension -- no more “lifetime professionals” b) First 6 months spent in classroom learning Constitutional rights to protect both themselves and the public. c) Must pass exams given by a civilian review board composed of members of the community where they will serve or time spent becomes “bad time” to be served without pay. 5) Must be deployed within 1 mile radius of their residence 6) Residency to be published and well known - with a 24/7/365 lighted minimum 2’x3’ sign prominently visible to even the most casual observer posted on the exterior of their residence facing the nearest public street. 7) NOT armed for their first year 8) Armed in second year ONLY if they pass emotional stability; legal understanding of Constitutional Rights; and arms proficiency tests 9) Provided with defense; but NOT indemnity if charged with misconduct. 10) Any police officer whose video camera is NOT turned on or "fails" for any reason must serve a minimum of 30 days without pay for the first occurrence; a minimum of 60 days without pay for the second occurrence; a minimum of 90 days without pay for all other occurrences. 11) Any police officer, prosecutor, judge, etc. filing a false report and/or committing perjury must serve a minimum of 10 years at hard labor; suffer confiscation of all property; be denied any and all compensation, pensions , retirement, healthcare, and any and all other benefits and be permanently barred from any future participation in the legal system in any capacity. 12) Any police officer, prosecutor, judge, etc. aiding other police officers or other officers of the court in the filing of false reports and/or the commission of perjury must serve a minimum of 5 years hard labor and be denied any and all be denied any and all compensation, pensions, retirement, healthcare, and any and all other benefits and be permanently barred from any future participation in the legal system in any capacity. 13) Any police officer, prosecutor, judge, etc. who fails to exercise due diligence and/or whose negligence results in the filing of a false report and/or commission of perjury must serve a minimum of 1 years hard labor and be denied any and all be denied any and all compensation, pensions, retirement, healthcare, and any and all other benefits and be permanently barred from any future participation in the legal system in any capacity. 14) Any police officer, prosecutor, judge, etc. who "loses" video evidence must serve a minimum of 1 year's hard labor and automatic exoneration of any suspects. 15) Any police officer, prosecutor, judge, etc. whose actions, omissions, negligence results in judgment against their department, municipality, or any other tax funded agency shall be held personally financially responsible to reimburse any tax monies expended for defense and any and all incurred liabilities with no option to avail themselves of bankruptcy. 16) Any police officer, prosecutor, judge, etc. accused of violating civil rights to be tried publicly by civilians from the locale of their deployment with any and all members of the police or legal profession specifically excluded from trial participation except as defense counsel. 17) Any police officer, prosecutor, judge, etc. found to have violated civil rights MUST serve hard time and be personally responsible for all costs and penalties; denied any and all compensation. 18) Any police officer, prosecutor, judge, etc. found to have violated civil rights that results in death MUST be publicly hanged in the locale of their violation with their body publicly displayed on the gallows of their execution for a minimum of 5 days and be denied any and all compensation, pensions, survivor’s benefits, etc. 19) Any police officer calling for assistance assumes full legal and financial responsibility for the actions of other officers that come to their aid as they are acting as their agents. 20) Any police officer that discharges his weapon loses the right to carry a weapon in the future regardless of the merits of the reason AKA the “one shot free” rule. 21) Upon honorable completion of an officer’s service, civilians from the locale of their deployment MAY, at their discretion, vote by simple majority to grant any officer they feel deserving the equivalent of one year’s pay as a bonus for meritorious service to be paid in monthly installments beginning 5 years AFTER the date of their completion to guard against chicanery and bribery. This is a work in progress. Nearly all these bullet points and their refinement have come from reader’s suggestions and criticisms. I had situation 6 years ago that’s likely out of stature of limitations. I got a panic phone call from a friend crying and saying she’s being arrested I asked where she was and went there. I get to school her son goes to and she’s standing in front with a guy . She’s in handcuffs behind her back! I ask him who are you and what’s going on , he says he’s a cop and he arrested her for wreckless driving! I called 911 I asked him for ID. Name snd badge number . I asked him if he was working plain clothes or off duty . He mumbled. Off duty and mumbled. But couldn’t make out whaf he said . Two officers in patrol car pull up and we talk and I say I think you should arrest him ! He handcuffed and arrested a woman for a traffic infraction that no one saw ! My friend is an attractive woman snd I noticed this guy was feeling her up ! She was cuffed ! I told cops to take cuffs off , they did ! They spoke to the guy and the police were puzzled . They told him we don’t arrest people for traffic infractions ! The police took his information but they didn’t arrest him as they should have . I think to late to file lawsuit

Qualified immunity is a carte Blanche pass for police officers to act outside the constitution and behave as if there are no consequences for their unprofessionalism or poor investigative skills. There’s been so many instances of false accusations, illegal detentions and malicious prosecutions just because police know full well they have almost blanket immunity from being held to account for their illegal and unconstitutional actions. If however QI was ended, police would be forced to act within the law at all times, producing more professionalism, proper consideration to any situation and a much fairer application of law enforcement. Why this crucial aspect of policing isn’t being demanded by the public is one of the biggest travesty’s of justice in society these days, as it would benefit everyone apart from crooked, tyrannical police officers, OUTRAGEOUS!

I'm Just answering the question - not saying I agree with the behavior. In their minds they could have been trying to arrest a criminal. I don't know if the burglary was via armed or not. So, THEORETICALLY they could have been acting with the belive that he was violent. Don't get mad at me. I'm just saying what it COULD be. I'm not...AM NOT saying they were correct.

LOCK YOUR DOORS! Many cars automatically unlock the doors when you put it in Park. You can usually change that setting. Look at your owners manual or on the web.

Imagine the stress of having potentially 1 year in jail and $10k fine hanging over your head for a year. 9:01 the most telling and confirmation of the readiness of these LEO's is when asked a question the Citizen invokes his Right to silence and a Deputy responds " okay that makes it easier ". His Internal Affairs department needs him to explain that declaration because to this violated Citizen and me it sounds like invoking your rights means you open yourself up to further abuses of power. The cops were chasing a burglary suspect who apparently escaped on foot, yet this innocent man is sitting in his *car* ? That alone wards off any suspicion what so ever! And watching that female cop hog tying the guys legs together was completely unjustified! Searching his car without just cause is inexcusable. Not being able to differentiate that the guy they trespassed on did not have the same clothing nor physical description as the person they were looking for? Sheer incompetence! He sued? Good for him! Under all of the circumstances of what the cops did? That should disqualify their immunity status, and charges should be pressed against these tyrants! Pathetic!

We legally can't though. Police are effectively untouchable since they widely help elect judges, mayors, politicans, and can use the state for their legal battles. And even if we did gain momentum legally guess who's gonna declare there's a "riot" going on and go in guns blazing again? What we need is to completely dissolve our current policing system entirely and use that funding to create specialized departments seperate from each other to actually help serve the public. Like ones who specialize in mental health crisis situations, departments that specialize in hostile situations involving active shooters, etc. All we have is a legalized gang who can lie, steal, and harm for any reason and face absolutely no punishment

He follows the description of a suspect because he is black first crime is racism opening the doors of the car second crime forcing him out of the car third crime these criminals in uniform with deadly weapons should be arrested immediately and spend at least 10 years in jail.
