I'm note sure that case law matter to the extent that the police rely on it. Read the law and ask, if they violate their policies or training do they lose QI?

There first has to be a complainant before anything can be done at all. The police cannot be the complainant. They have to be given a warning first, that means no ticket or arrest. This wouldn't have even been an arrest or a citation even if the cops knew the law, it would have never even gone to court. How would a court find them in violation of the noise ordinance?

@@breathofdifferentair1950 Not quite my point. They police say they can commit any violation if there is no case law. 13:23 in to the video It's the bit at 13:25. A right is clearly established when it is "sufficiently clear that every reasonable official would have understood that what he is doing violates that right" So if the policy policy is clear, and the officer has signed to say he has read that policy, then does something different that violates someone's right, my take is a reasonable official would understand they are violating rights. That extends it beyond precedent.

I agree She wasn't able to maintain her composure or keep her fear in check yeah she definitely needs a desk job she's not qualified for the field. This is a little known statistic but most female officers end up at the desk job after a year in the field

Most cops do. I once called 911 for a buddy with a broken leg. I was talking with dispatch when an unrequested officer showed up to assist put his gun on me for having a suspicious cell phone..... The phone I was talking to dispatch with cause rural NH gps wasn't a thing yet.

@@TheRizzlyBear21 Any reasonable person would read the room and see these two, were not scared, acting as if they weren't committing any crime more like the acted if felt legally justified in what they were doing, and reasonably complying with orders though they didn't say yes master so I guess how an un reasonable person would still be a bit scared after reading the room at that point.

ABOLISHING QUALIFIED IMMUNITY WOULD MAKE COPS PAY ATTENTION TO WHAT IS LAW AND WHAT IS NOT. AS LONG AS THEY KNOW THEY'RE COVERED NO MATTER WHAT THEY DO...THEY WILL KEEP ON BREAKING THE LAW.

There once was a farmer & a merchant who had stalls across from each other. He was a cabbage farmer, the merchant an apple salesman. The merchant had a giant tub of good apples, & the farmer would come buy 1 everyday. But 1 day, he saw a bad apple on top. 'That's nothing, easily ignorable.' He thought as he got his apple & went on his way. Business was good for both. But the next day, the farmer saw 5 more bad apples on top. 'Oh, this is fine, just bad luck.'. One less person came to the merchant that day. The very next, there was 11 more bad ones. 'Surely Merchant is just having bad luck.' So farmer told him about the bad apples on top. Merchant, appalled at the thought that he could have bad apples, exclaimed "These are good apples! I will keep them & defend them!". But less people came that day. Over the next few days, more and more bad apples were piled on top, making it harder & harder to see any of the good ones. Try as he might, Farmer could not get Merchant to see reason. "These are good apples! I will keep & defend them!" This went on until 1 day... no one came by except Farmer. The tub of good apples now looked like sludge that stank & no one wanted to see. Customers were starting to want to kick him out of the market. Confused, Merchant asked Farmer, "What is wrong with my apples? They are good? You just have to dig through the other ones?" Farmer, shaking his head sadly, replied, "Merchant, you cannot keep the bad ones, they will drive people away..." but Merchant replied, "These are my apples, I will keep & defend them!". Unable to see reason, Farmer took him over to his cabbage stall. None of them were bad, sure, some were oddly shaped, some were small, but none were rotten. Business was good for Farmer. Confused, Merchant asked, "How do you keep them so good?" To which Farmer chuckled: "I take the bad ones & make them into fertilizer, so new, good cabbages can grow! If you keep the bad ones, it makes the rest look horrible, & no one will like them." Now if only police departments could be more like Farmer, instead of keeping & defending the bad cops, make the bad cops examples of what not to be. There'd be less bad ones, & people would be more trusting of them.

I loved seeing these two young men know the law. That cop was surprised when that young man busted out with "Oh so this is a stop and ID state?" They probably thought that they didn't know the law and they could just tell them whatever they wanted to and not get in trouble for it. I'm glad these young men stuck it to them in the most respectable and upstanding way possible! I hope everything went well for them!

You give person a gun, two extra magazines, a taser, a night stick, pepper spray, and handcuffs, and you send them out to enforce laws they don’t understand. That is extremely dangerous to the public and grossly irresponsible.

Not sure if you're familiar with the term "sundown town," but this whole interaction definitely harkens back to an ugly part of American history that directly relates with your comment. Sundown Towns were places that explicitly excluded non-whites after sunset, and even beyond those towns, countless innocent black folks were historically arrested for doing any sort of otherwise normal business "after dark," whether that was purchasing or selling goods, walking outdoors, talking "loudly", etc. It became so bad that any criminal charges labeled "[mundane activity] after dark" was understood to actually mean "[mundane activity] while Black." @@darrene.vonbraun4421

They don't identify you to know who you are. They put your information in a database so that when there is an actual offense committed they have a possible suspect. That way they don't have to "figure out what's going on."

The VERY FIRST mistake by the police...."keep getting smart and you'll go to jail". That cop should be FIRED. You can't arrest someone for "being smart". The cop can't control her feelings and if you can't do that, you shouldn't be doing the job.

It's amazing how many of these cops don't understand the difference between the ability to ask and the authority to compel. It's something so easy to understand and explain that there's no reason for it But as long as PD's don't train well enough there'll be 6-7-8 figure settlements

One of the arrested men vaguely remembered the lack of a stop and ID law in the state and asked about it. Turns out that was a higher level of knowledge on the local laws then the police had......absolutely shameful

Agreed. At a certain point, I stop trying to communicate when it becomes clear that the other party is purposefully not engaging in good faith. I do it to my boss, my coworkers, even my husband and my mom might get a monotone series of "okay"s, "understood"s, and "that's fine"s when I quit on a conversation, so why would some random cop be special?

@@dermagnus8482 - If "Quota hires" is in response to the female officer in particular, the SCOTUS declared affirmative action quotas illegal in the 1980's. Any legal affirmative action program can only consider things like sex, race, ethnicity, etc. when considering candidates who are already in the qualified applicant pool. Those traits can't be used to put candidates in the qualified applicant pool, let alone to give unqualified applicants a position. And again, quotas are illegal. Also, there were two male officers who also misrepresented the law in that jurisdiction.

Not only do we need to end qualified immunity, we need to start doubling the penalties for crimes committed by law enforcement while on duty, in uniform, driving squad cars, or otherwise representing themselves as law enforcement

People dont understand how that works tho. If you get rid of QI every cop in every city and state would immediatley have lawsuits pending over the most frivilous stuff, traffic tickets, actual legal stops and citations. Not every cop does their job poorly, but getting rid of QI would make every cop a target. The courthouses would be clogged up within days from the lawsuits. Not to mention it would mean their personal info gets out, and people could even show up to their homes. You wanna stop this kind of police behavior we need to 100% no exceptions REQUIRE bodycams. From the time they clock in till they clock out, and if they break this rule prosecute them. I fuckin guarentee this shit would clear up quick if that were the case.

The judge gets an F- for invoking qualified immunity and ruling that the case was merit less. The judge should be disbarred and imprisoned.

I think it would have been the officers lawyers who brought up qualified immunity, and legally speaking quite effectively because it basically assured his clients success. That said the idea of qualified immunity is gross, and I’m disappointed the Supreme Court made that ruling, yet I’m not surprised. But to my point it wouldn’t be the judge who makes that decision, especially a lower court judge, he simply has to apply the existing case law.

There needs to be some repercussions for judges who side against the law on rulings. Especially when their ruling gets over turned in a higher court.

@@killingmonkey11 Agreed, there needs to be a far more legitimate process to review judges decisions by someone that isn’t part of the process or accountable to these judges. We need something like a peer review process, but without having their buddies in the ranks.

How did that work out for doctors? Badly, right? Very, very badly. Instead of the doctor getting fired, for causing a huge lawsuit against the hospital, now they just file a claim with the insurance and nothing happens to the doctor to correct their behavior. Ending QI will also end the ability to find the police department liable. The police department can't file bankruptcy on the judgment but the cop can, and immediately will.

Reality is, doctors are in high demand, and the list of former doctors who still want to be doctors, has about a dozen names on it. The judge ruled out the 4th amendment charged on the grounds he didn't say it was unlawful? He literally said this is not a stop and identify state multiple times when the officers claimed it was. They've said his claims of the breach of peace charge being a pretext was dismissed despite the fact the officer said they would go to jail for shooting a gun in the air, being smart, not identifying themselves and having no common sense before breach of peace was even uttered once. How on earth does it make sense to not rule on a case because there is no previous case reports of relevant to the situation. Is that not saying because what your are doing isn't prohibited but police can arrest you and put you in a cell overnight because it wasn't directly stated to be a protected activity? And if they keep ruling cases dismissed because they haven't bothered to address it whenever it comes up won't this happen again and again?

For citizens, it is not "know the law". The citizen equivalent of qualified immunity is "standard carelessness". For example, if a bartender spills a beer on a customer, the bar owner pays because this is standard carelessness, and a normal part of the job. On the other hand, if a bartender is annoyed with the customer and throws a beer on them, the bartender pays because of gross negligence.

federal law is different then state laws. i see state laws total 180° different then federal. like US code 18 chapter 2 (part 1) aircraft and motor vehicles, 31 (definitions) paragraph 6 (motor vehicle) and paragraph 10 ( used for commerical purposes). compare your local state law to the federal law.

1) Never announced herself as a law enforcement officer on private property while pointing a weapon at residents. 2) Made up a law that you "cannot shoot a firearm after dark." 3) Arrested instead of given a warning. 4) By law the men didn't have to ID. Glad they sued.

This shows that QI is being used to shield officers from everything down to negligence. QI in my opinion was for errors officers made when in high pressure situations and dealing with multiple problems in an active emergency. How can you use QI for blatantly breaking the law or in some cases causing bodily harm to an individual that was innocent.

Seriously sounds like Nazi Germany give me your papers. And the fact that a sergeant said that was the law when he was not even aware of what the law truly is blows my mind. yeah lets let innocent officers get lumped in with the baddies. some do exist, only following dept orders and training. its not QI that is the problem, but WHEN it is applicable and how it is applied. i.e. a gun is inanimate, does not kill people. people kill people. but lets ban guns, then no killing ever again, right? not logical. you have took at why officers need protection from hostile actions when the dept. is ultimately responsible, not Joe Cop. did you know K-9's actually have more rights than human cops? QI definitely protects these officers even tho they frequently make mistakes, but it is not their fault. they were trained from "hire" to do certain things. sometimes they goof, overreact, indicate wrong things, bite subjects excessively hard trying to detain a subject

Sometimes I think police officers become police officers because they felt powerless in their earlier life. The police woman sounded like a frightened child. I like it when healthy minded people become police officers to genuinely protect and serve, not to prove something or with some vendetta.

Sadly, the "healthy minded young people" don't STAY police officers. If you don't fit in with the "thin blue line" mindset, you either quit or are driven out of the police force. And intelligent people almost never stay cops for long, instead going on to become lawyers or other legal professionals like paralegals. But don't take my word for it, that was the entire reasoning behind New London's refusal to hire a man because he was "too smart" in _Jordan v. New London, Conn._

That's why it is they often go to the rather nebulous smoke screen tactic of, "suspicious activity". It says nebulous as trying to catch cigarette smoke floating in the air to prove somebody was smoking where they shouldn't be. And the other problem is they end up costing their department so much money because they are too busy chasing that smoke through the air and over the cliff. They don't realize that they're now falling until they have to pay that $50,000 fine from the department's budget. Which then means that the department has to cut the number of police that they put on the street. What you're looking at is the arbitrary and capricious actions of criminals who claim that they're following the law and enforcing the law. These are not peace officers, these are enforcers of arbitrary and capricious statutes. There's a difference between the law of the land and statute. The statute is submissive to the law. Period!

I was in a similar situation, but I’m white. The cop just came up and said something like “oh you’re just target shooting. Your neighbor called, but it’s totally legal till 10pm”, my friend and I both had long guns in our hands and handguns on our hips. All people deserve to be treated like this cop treated me.

Same, was shooting on property I thought was gamelands but was actually private property. Cop came up said “hey guys owner has asked y’all to leave” We promptly packed up and left with no issues. How it should be, guns involved but no escalation of the situation.

I love how when the gunshots were heard that the police person freaked out but the local people didn't even act like anything happened and didn't care. I would imagine the locals' reactions would be a fairly clear sign whether something bad is going on or not.

When you live out in county it is a daily thing to hear gunshots and not think anything of it. Actually it has desensitized me when I'm in a city or town and hear gunshots. Usually about a 3 count before I'm like "oh right, that's not normal/legal"
