As a firearms instructor for 48 years I can only tell you that the AVERAGE person would not know the difference between a live round and a blank round while looking at it. Certainly an actor, when being handed a firearm from either the Prop Master or Director or whoever on set, would not be even REMOTELY thinking that there would be a live round in the gun that has been used numerous times on set previous. Did he pull the trigger? Most likely. The gun was tested and proved functional with no problems. I don't think that would make him guilty of Involuntary Manslaughter. IMHO

I agree, mike is saying did he check the gun, that makes no sense..I'm sure he wasn't turning the gun around and looking at the actual bullets, he has no clue what the difference is between live and blanks by looking at them IN THE GUN..its all on the armorer

Just to also say, if Alec had opened the chamber on a cleared gun and looked at the ammo in any way, it would have taken the gun cold and the gun would have had to immediately be cleared again by the firearms expert because he handled it improperly. It was probably against his training to check the rounds, because that would have resulted in delays.

The case should never have been brought. They tried to make a name for themselves. A prop gun was discharged while filming a movie that someone put live rounds in. Prosecutor hid the fact that they destroyed the gun. Now why would the gun in a murder case be destroyed?

It wasnt a "prop" gun, it was a fully functional leathal weapon that was handled recklessly... however the prosecutor and police hid information and the case was properly dismissed. ​@@KNByam

I mean, it seems like there should be some sort of person who is an expert at this making sure only blanks are loaded in the prop gun. Let's call them an ammunition expert. Their defense is that Alec is an actor and his job is to remember lines, read lines, and act. It was the ballistics experts job to test ammo and firearms.... So if live ammo that matched the ammo used was hidden from the defense then... ya...

I’m thrilled the case was dismissed! I like Alec Baldwin. I don’t like his politics, but if I held that against Hollywood stars, I’d like none of them. I thought his stuff on SNL was legendary!

The prosecutor said the withheld evidence would have hurt Guitierrez. If that is true, anything that indicts his codefendant takes culpability off Baldwin. How does Mike not see that? I'm not a lawyer but that makes complete sense to me

As I said elsewhere- if the rounds and reports had not value/nothing to wreck your case there was no reason to withhold the information from the defense. If there was value there are far better ways to have handled this.

It was fascinating to watch mike react as the Baldwin case was unfolding on the recording. I am not sure I have seen him focus so intently as the prosecutor took the stand as a voluntary witness.

The state or county should be responsible to get these defendants into a courtroom and the defendants should be held responsible for their behavior - holding court on zoom is lazy. The mute button just reinforces bad behavior. This arraignment is a joke.

You really needed to see the other witnesses to understand what happened. The Chief Investigating cop admitted that she lied under oath. It was not 100% established that the live bullets looked one way and dummies another. Therefore, the bullets handed over should have been brought to the station and tested. Also the Chief Investigating cop admitted that she did not speak to witnesses, because they did not answer her phone calls, although phone records do not support that she tried to contact then. It was a badly handled case

I'm kinda surprised at Mike's reaction to the judge being aware of and prepared for a written motion, which is standard (pretty weird of Mike, but not really) on the Baldwin case. A lot of us from old-school LTMW remember Mike saying that mask mandates were "unconstitutional" on a Schrodinger's Cat (RIP) livestream. The 10th grants states the right to enact emergency powers, and the mandates fell under such declarations (in every state, and every state applied such measures at one point or another during the pandemic). Politics aside, he was wrong about that, too. It happens. In this case, the prosecutor should have been prepared (she knew it was coming) and looked like a sov-cit on the stand. That cross was embarrassing. Mike is occasionally wrong. I still love him.

Whether Alec Baldwin should check the gun should depend on what the normal industry practice is. There is a reason movie sets hire armorers, it's to make sure guns are properly safe. If the industry standard is that the actors rely on the armorer, then if he didn't check, that isn't negligence...because he isn't "not exercising ordinary care".

@@MBucky I'm not sure that is relevant to the actor's duty of care. There is someone there whose whole job is to ensure the safety of the firearm...and that person isn't the actor, nor the A.D., for that matter.

They have policy for the regulation of access to phones for prisoners in segregation. It isn't the jailer's decision. Somebody higher up the chain likely dropped the ball.

The problem with the Baldwin trial was that one of the main contentions was the handling of ammunition on the set, I think the defense was trying to go for something along the lines of the armorer was solely at fault for even having live ammunition on set, that Baldwin as an actor and producer was unaware there was live ammunition on set as there was only supposed to be blanks and/or dummy ammo. A can of ammo, even if unrelated to the set was handed over to prosecutor's and the defense could have agreed with them that it was not important or related, or they could have brought it in as some additional evidence of the armorer mishandling/storing ammo on other productions. Basically, that it is possible that evidence could have been used by the defense in some way.

Don't be too angry at the courts, Michigan's legislature has passed laws that make holding someone with unaffordable or no bonds very challenging. Their hands are often tied and have to issue bonds that are affordable to the specific defendant. See: MICHIGAN COMPILED LAWS ANNOTATED CHAPTERS 760 TO 776. CODE OF CRIMINAL PROCEDURE CHAPTER 765. CODE OF CRIMINAL PROCEDURE-BAIL CHAPTER V. BAIL. Sections 765.1 - 765.28.

@@undecidedmiddleground5633 Well Politicians are definitely a problem. So I believe there is a guy in MI who has 17 DWIs. One Lady has 97 court cases before a Judge finally put her in jail. That's not because of policies that Corrupt Worthless politicians set. It's because the Judges and Prosecutors let these Criminals keep going on and on. If you look at the penalties for DWIs they are actually crazy. Years in jail. Thousands in fines yet this guy has 17 DWIs. That's not because of the Politicians it's because of the courts not holding anyone accountable. ?????

One of our most demotivating aspects in law enforcement is seeing the revolving door of criminals being released or getting one sweetheart plea deal after another. I arrested far too many idiots with charge after charge and just being released because the courts don't consider driving while license S/R/C or DUI to be violent crimes. Ask the people I've seen peeled out of their cars because they were hit by a DUI or reckless driver with multiple priors how violent the crime felt. And, they never carried insurance, so you get 🪛trying to piece your life back together.

I absolutely think it should have been dismissed. Yes, he should have checked, but if in his shoes, working for months with the armory person who seemed to know her job and handling the gun frequently, i can see that extra safety check being skipped…..and it really seems like state and police WERE doing things dirty to make sure they got a conviction….plus the whole thing about the police ‘accidentally’ destroyed the gun

Baldwin only worked with the armorer for 3 weeks, not months. He was a producer on the film which means he was responsible for that armorer being hired. A live round should not have been anywhere on that set. He irresponsibly pulled that trigger, he claims he didn’t. That test that destroyed that gun proved that the gun couldn’t discharge without the trigger being pulled.

​@@ASchwa29it seems to me that his alleged negligence as a producer (running a sloppy set, etc.) is entirely separate from his alleged negligence as a performer. I've also read that while, yes, basic gun safety requires a shooter to always check, etc., in practice on a Hollywood set, actors rely pretty heavily on the armorers to ensure safety.

@@EbonMaster Yeah, I think this is basically right, though I'm not 100% up on the case. If there's an issue about Baldwin it's about not maintaining the industry standards of care on the set as a producer. Which BTW I'm still unclear on. Producer tiles can mean "guy in charge" to "courtesy title to the writer of the first draft in 1992, so he won't sue us" and anything in between. Was Baldwin a "real" producer?

Okay, as far as the Crazy Contempt goes. Kellerman has nothing else to lose and he knows it. He is going away for life. And a more deserving individual would be hard to find. If the judge made rulings of contempt it would not change anything so she just did her duty to make sure that there are no grounds for appeal.

There were reports early on that he was taking it with him and firing live ammo after hours. And that he had live ammo in his prop gun belt, the theory was he mixed them up coming back to set.

I’m a bit stunned by opinions here. If someone waves a gun around on set, should they be charged with reckless endangerment or menacing of some sort? If they hide a gun during a movie, should they be charged? If an actor has a felony record, and uses a gun in a movie, is he now guilty of felony in possession of a firearm? It makes zero sense to blame an actor for pulling a trigger on a movie set. Zero sense. And it also makes zero sense to intermingle live rounds and blanks on a movie set. Mike says to read the statute regarding this. But I’m sure the state statutes don’t have any carve out provisions for menacing, carrying concealed, or felon in possession. Yet those charges are ridiculous, but he argues this shouldn’t be a mistrial? This should have never gotten to court. Period. The prosecutors were trying to get their names in the spotlight.

I agree, except I think maybe they could have brought some kind of charges against Baldwin (and others) in his capacity as a producer for negligence leading to death. It sounds like the set was unsafe and many people spoke up about it but nothing was done. Holding him responsible in his capacity as an actor is like charging a NASCAR driver with manslaughter because the pit crew didn’t put a tire on right and it flew off and killed somebody.

I agree with the first comment and the two subsequent replies. Does anyone really believe Baldwin or anyone else wanted to actually shoot someone, much less kill them? Also why in gods name are there LIVE rounds on a movie set? Baffling. The entire prosecution seems like it was done because Baldwin is rich and famous and the prosecution that put him in jail would become famous overnight. I do think there could be a civil remedy against Baldwin and from what I understand Baldwin has already made a hefty multi million dollar payment to the deceased's family. I'm still baffled why live rounds are on movie sets in the 21st century. Having said this I've not kept up with this trial at all and don't even know why this went to trial. So maybe I'm full of it but I still don't know why there were live rounds on a movie set and why this was ever a criminal charge.

And further - if that’s really what live rounds are being used for, ALL THEY HAD TO DO WAS ACCOUNT FOR THEM FORMALLY. That’s literally the only job of the armorer. But yes you’re correct. Its baffling. Well beyond stupid. One could maybe stretch an argument and say if he knew about live rounds ahead of time, perhaps scrub the set, destroy all the ammo, buy and replace, fire the armorer, etc. it’s a stretch but some degree of negligence based on those could maybe be the only logical charges. Everything prosecutors did here was ridiculous. And to cap it off, the special prosecutor was so upset about the withholding evidence issue that she quit today. Literally this morning. Yet people are still so lost as to think he should be charged. It’s beyond ridiculous

I mean, that’s quite literally what bond is and what it is for. It’s like saying “incarceration will keep you locked up” - obviously that isn’t strictly true - people do get out - but that’s the point of incarceration. The point of bond is an incentive to behave and participate prior to being determined guilty (or not).

he will end up pleading this large list of offences down to maximum of 15 years at most. And be out in 10 years if he can behave himself in prison, yes that will be a massive if. But today in courts how often do you see murderers and rapists get released early and have sentences set in stone pre trial via bloody plea deals.

Mike made a very good point, I watched a lot of the hearing today and don't quite understand why the "withheld" evidence was even material to the case, let alone helpful to the defense. Like Mike said, what difference does it make where the bullets came from? All that being said, the entire Baldwin prosecution may have been a huge waste of time and money.

I think the main point was that the manufacturer mixed up live rounds in with the fake ones so the rounds they loaded in the gun should have been the fake rounds

@@suepongallo from my understanding the manufacturer/supplier of the bullets shipped them that way. some real rounds were in the batch and were not supposed to be. does that make it 100% their fault probably not but the fact that they suppressed that mistake

The prosecution of Alec Baldwin was a *BS* prosecution that wreaked of politics. The reality is that no, an actor is not liable or responsible for a firearm on set. That is the role of the armorer. Having the actor check the firearm is pointless since it is unlikely they will know much about the firearm or its status. The armorer assume all luability and responsibility for the firearm.

Judge was right to dismiss, I’m glad the State messed up but there shouldn’t have been a case against Alec Baldwin anyway, he wasn’t at fault for the shooting, he would never think there was live rounds in the gun.

In my 54yrs on this planet, I have never heard of a rap sheet that extensive (6:44 to 23:15). It took the judge 15+ minutes to even READ his record. Must be nice for Melissa with him finally being locked up. His eulogy will have to include the word "devoted". Who wants action on that bet.
